5. Normally the cons_t.itutioVn.alV:A”tra’ii.dity.’oi\u00ab:t_het.vEstatute
\nwill be challenged if  by the
\nLegislature, if it isyieiative;ief ag :fueVeiementeitight or if it is
\nultra vires the   of the Legislature in
\nquestion. if  the Court finds that
\nthe Legisla’ture.’_  ‘beyond its power or
\ncompetence orllin_tra.n’5gAr’essi.on of limits imposed by the
\n i.tself._,_’sulchwanenactment is called a colourable<\/p>\n
legisVlat’iVo_n.V\u00abi’ iti’f\u00ab..itvhejjLe~gislature enacts the law in the pretext<\/p>\n
the exercise .ofAthe legislative power though actually it<\/p>\n
l”4″do4es:’r1otpossess such power, the legislation to that extent<\/p>\n
 yoi’d’._lo’r”becomes voidabie on a deciaration to that effect<\/p>\n
 Constitutional Court. In the instant case, the learned<\/p>\n
ex<\/p>\n
counsel for the petitioner has not pointed out these aspects<\/p>\n
whether the law made or the Circular is violative,..oif-.._:th_e<\/p>\n
fundamental rights or the Legislature did not  <\/p>\n

pe’ti.tione{..gha\u00a7~..r;ie’nti.oned that he has got 60 days time t_o<\/p>\n
 an lalapleail ‘giaaieriaule 7(2) of the EPF Appellate Tribunal<\/p>\n
 199’7.v$”A’;_53lv.lt it is his contention that appeal is not an<\/p>\n
 remedy. The Appellate Tribunal which deals<\/p>\n
‘  the EFF Act is specialised in examining the levy of<\/p>\n
:*tl’*int.erest and also the damages. But in the instant case,<\/p>\n
if,<\/p>\n
result of that appeal has not been furnished to this Court.<\/p>\n
EPF Act provides for the institution of compulsory Provident<\/p>\n
(pension) Fund and Deposit-linked Insurance <\/p>\n
benefit of the employees in factories~””‘\u00a7\ufb01d:Jiotherl\u00e9 <\/p>\n
establishments. Such being the case,, thei::jon’tention'”of-..the_:A<\/p>\n
