Justice M.SASIDHARAN NAMBIAR\n\n Dated :28\/09\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.1240 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Maintenance  was  granted   by  Family   Court,<\/p>\n<p>Thiruvalla  in   M.C.No.175\/2005   in   favour   of<\/p>\n<p>respondents 1 to 3. They filed Annexure-A1 petition<\/p>\n<p>(C.M.P.No.207\/2009) under Section 128 of Code of<\/p>\n<p>Criminal Procedure to issue warrant for realisation<\/p>\n<p>of the maintenance for the period from 26.7.2006 to<\/p>\n<p>26.7.2007. By Annexure-A3 order Family Court passed<\/p>\n<p>an order initiating revenue recovery proceedings<\/p>\n<p>through  District  Collector  stating  that  though<\/p>\n<p>respondents, petitioners before the Family Court,<\/p>\n<p>were present, petitioner, the counter petitioner,<\/p>\n<p>was  absent.  This  petition  is  filed  to   quash<\/p>\n<p>Annexure-A3 order contending that in view of the<\/p>\n<p>first proviso to sub-section (3) of Section 125 of<\/p>\n<p>Code of Criminal Procedure, learned Judge should<\/p>\n<p>not have issued warrant for realisation of the<\/p>\n<p>amount beyond the period provided under the proviso<\/p>\n<p><span class=\"hidden_text\">CRMC 1240\/10               2<\/span><\/p>\n<p>and after receipt of the notice in Annexure-A1<\/p>\n<p>petition, petitioner appeared and filed Annexure-A2<\/p>\n<p>objection raising this contention, but, it was not<\/p>\n<p>considered by the learned Judge.\n<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and respondents 1 to 3 were heard.\n<\/p>\n<p>    3. Annexure-A3 order shows that the order was<\/p>\n<p>passed as if petitioner\/counter petitioner did not<\/p>\n<p>appear on service of notice in C.M.P.No.207\/2009<\/p>\n<p>and   did   not  raise  any  objection.  Annexure-A2<\/p>\n<p>objection filed by the petitioner shows that on the<\/p>\n<p>day   on    which  Annexure-A3  order   was  passed,<\/p>\n<p>petitioner    filed   an   objection,  inter   alia,<\/p>\n<p>contending that in view of first proviso to sub-<\/p>\n<p>section (3) of Section 125 of Code of Criminal<\/p>\n<p>Procedure, petition will not lie. Unfortunately,<\/p>\n<p>Family Court did not consider the objection.<\/p>\n<p>    4. In such circumstances, Annexure-A3 order is<\/p>\n<p>quashed.
