H P SINGH - Petitioner(s)\n \n\nVersus\n \n\nJAYESH\nS PATEL - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nSACHIN D VASAVADA for\nPetitioner(s) : 1, \nMR PM LAKHANI for Respondent(s) : 1, \nMRS RP\nLAKHANI for Respondent(s) : 1, \nMR RH RUPARELIYA for Respondent(s)\n: 1, \nMR.MANOJ T DANAK for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 09\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npetitioner has approached this Court for appointment of an arbitrator<br \/>\nin terms of agreement dated 01.04.2008 in which, Clause 28 reads as<br \/>\nunder:-\n<\/p>\n<p>&#8220;28.1.\n<\/p>\n<p>Any dispute between the Parties inter se arising  out of or in<br \/>\nrelation to this Agreement shall be resolved by the Parties mutually<br \/>\nwithin fifteen days of one party giving to the others, notice of the<br \/>\nsaid dispute, failing which the said dispute shall be referred to<br \/>\narbitration in accordance with the provisions of the Arbitration and<br \/>\nConciliation Act, 1996.\n<\/p>\n<p>2.\tSince the dispute<br \/>\narose between the parties while working out the said agreement, the<br \/>\npetitioner issued notice dated 28.02.2011 to the respondent for<br \/>\nmaking appointment of an arbitrator of the petitioner&#8217;s choice<br \/>\nand urging the respondent to do so.\n<\/p>\n<p>However, since the respondent did not suggest any name of an<br \/>\narbitrator of his choice, the petitioner has approached this Court in<br \/>\nthe present Arbitration Petition seeking appointment of an arbitrator<br \/>\nunder Section 11 of the Arbitration and Conciliation Act.\n<\/p>\n<p>3.\tNotice to the<br \/>\nrespondent issued. The respondent appeared through the advocate and<br \/>\nfiled affidavit-in-reply.\n<\/p>\n<p>Main objection of the respondent is that Arbitration Clause<br \/>\nenvisages that the proceedings shall be held at New Delhi and<br \/>\ntherefore, present petition filed in this Court is not maintainable.\n<\/p>\n<p>\tHowever,<br \/>\nit is not in dispute that the respondent is stationed at Vadodara,<br \/>\nthe agreement required certain channel work to be done at Vadodara<br \/>\nand it is out of such an agreement that dispute arose between the<br \/>\nparties.\n<\/p>\n<p>4.\tIn<br \/>\nthat view of the matter, simply because the agreement envisages<br \/>\nsitting of Arbitrator at<br \/>\nNew Delhi, it cannot be said that the present application is not<br \/>\nmaintainable before this Court.\n<\/p>\n<p>5.\tAnother<br \/>\nobjection of the respondent is that the petitioner is the Den<br \/>\nNetworks Limited whereas, the agreement was enter into between the<br \/>\nrespondent and Den Digital Entertainment Networks Pvt.Ltd.\n<\/p>\n<p>6.\tLearned<br \/>\ncounsel for the petitioner pointed out that the present petitioner<br \/>\nDen Networks Limited was formerly known as Den Digital Entertainment<br \/>\nNetworks Pvt.Ltd. There is no other change of constitution of the<br \/>\ncompany.\n<\/p>\n<p>7.\tIn<br \/>\nthat view of the matter, this objection is also not entertained.\n<\/p>\n<p>8.\tIn<br \/>\nview of the above, Justice D.A. Mehta (Retd.) is requested to act as<br \/>\nan arbitrator to resolve the disputes between parties arose out of<br \/>\nthe said agreement dated 01.04.2008.
