Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  Writ  of Habeas Corpus to call for the records pertaining to the\ndetention order in B.D.F.G.I.S.V.No.06\/2006, dated 18.02.2006, passed  by  the\nsecond respondent herein, quash the same, direct the respondent to produce the\nbody  of the person of the detenu namely Gundumani @ Vedagiri, son of Chellan,\nbefore Court and set him at liberty.\n\n!For Petitioner         :  Mr.S.Palanikumar\n\n^For Respondents        :  Mr.  M.Babu Muthu Meeran,\n                           Addl.  Public Prosecutor.\n:ORDER  \n<\/pre>\n<p>(Order of the Court was made by P.SATHASIVAM, J.)   <\/p>\n<p>        The  petitioner  challenges  the  detention  order,  dated 18.02.2006,<br \/>\ndetaining him as Bootlegger as contemplated under the Tamil Nadu  Prevention<br \/>\nof  Dangerous  Activities  of  Bootleggers,  Drug Offenders, Forest Offenders,<br \/>\nGoondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act,  1982<br \/>\n(Tamil Nadu Act 14 of 1982).\n<\/p>\n<p>        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nAdditional Public Prosecutor for the respondents.\n<\/p>\n<p>        2.  At the foremost, learned counsel for the petitioner submitted that<br \/>\npursuant to the representation dated  23.03.2006,  the  Government,  in  their<br \/>\nReply  dated  05.05.2006, though assured to supply certain documents, the same<br \/>\nhave not been supplied.  According to the counsel, due to non-supply of  those<br \/>\ndocuments,  the  detenu  was  prevented  from making effective representation,<br \/>\nhence, the impugned order of detention is liable to be quashed.\n<\/p>\n<p>        4.  We verified the records.   In  the  reply  dated  05.05.2006,  the<br \/>\nGovernment,  while  considering  the  representation  of the detenu dated 23.0<br \/>\n3.2006, informed that a copy of the bail application is to be served; and also<br \/>\ncommunicated the letter dated 5.5.2006 to all the  authorities  including  the<br \/>\nDetaining Authority  at  Kancheepuram.   In the absence of any proof that copy<br \/>\nwas supplied to the detenu as assured in the letter dated 05.05.2006,  we  are<br \/>\nof   the   view   that   the   detenu  was  handicapped  in  making  effective<br \/>\nrepresentation.  On this ground, the detention order is liable to be quashed.\n<\/p>\n<p>        5.  Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and  the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>JI<\/p>\n<p>To<\/p>\n<p>1.
