Heard the learned counsels for the parties on<\/p>\n<p>                    the Interlocutory Application No.1112 of 2009.<\/p>\n<p>                                (2) This Interlocutory application has been filed<\/p>\n<p>                    by   the    appellant   praying   therein   to   stay   further<\/p>\n<p>                    proceeding in the Court below in title Suit No.97 of 1988<\/p>\n<p>                    pending in the Court of Civil Judge, Sr. Division, 2nd Court<\/p>\n<p>                    at Buxar.\n<\/p>\n<p>                                (3) It appears that the plaintiff-respondent<\/p>\n<p>                    No.1, Ramji Singh, filed the aforesaid suit for specific<\/p>\n<p>                    performance of contract and also for confirmation of<\/p>\n<p>                    possession over the suit house and in the alternative for<\/p>\n<p>                    recovery of possession. According to the plaintiff, he was<\/p>\n<p>                    tenant in the suit house and was conducting his business.<\/p>\n<p>                    The defendant No.1, Bishwambhar Pd. Aggrawal, in the<\/p>\n<p>                    capacity of Karta of the joint family approached the<\/p>\n<p>                    defendant to sell the suit house as defendant No.1 had to<\/p>\n<p>                    perform marriage of his daughter and was in need of<\/p>\n<p>                    money.      Consideration was fixed at Rs.4,10,000\/-.      The<\/p>\n<p>                    contract was finalized on 24.08.1987.             Advance of<\/p>\n<p>                    Rs.1,14,000\/- was paid to the defendant No.1 on<\/p>\n<p>                    12.09.1987 and deed of agreement was prepared and<\/p>\n<p>                    signed by the parties. The appellants are the subsequent<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>purchaser with notice of this agreement. The appellants<\/p>\n<p>got executed 4 sale deeds.\n<\/p>\n<p>            (4) The original defendant appeared and filed<\/p>\n<p>contesting written statement. However, he died and then<\/p>\n<p>the legal representatives were substituted.     The son of<\/p>\n<p>the original defendant No.1 who was original defendant<\/p>\n<p>No.4 supported the case of the plaintiff.    After trial, the<\/p>\n<p>learned Court below decreed the plaintiff-respondent suit.<\/p>\n<p>Now, according to the decree, the learned court below is<\/p>\n<p>proceeding ahead to execute the decree.<\/p>\n<p>            (5) The learned counsel for the appellant<\/p>\n<p>submitted that if further proceeding is not stayed then<\/p>\n<p>the appellant shall suffer serious loss and irreparable<\/p>\n<p>injury because the appellants are in possession of the<\/p>\n<p>property.     To this submission, the learned counsel<\/p>\n<p>appearing on behalf of the respondent submitted that<\/p>\n<p>there is no question of possession of the appellant<\/p>\n<p>because admittedly, the plaintiff-respondent No.1 was<\/p>\n<p>the tenant in the suit house from the very beginning.<\/p>\n<p>And, therefore, he filed suit for specific performance of<\/p>\n<p>contract and also confirmation of possession.         In the<\/p>\n<p>alternative, he prayed for recovery of possession.<\/p>\n<p>            (6) In view of the above submission, it appears<\/p>\n<p>that the appellants are claiming to be in possession<\/p>\n<p>whereas the plaintiff-respondent No.1 is also claiming to<\/p>\n<p>be in possession.          The   learned   counsel   for   the<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>           respondent submitted that since plaintiff is in possession<\/p>\n<p>           so only sale deed is to be executed.        The learned trial<\/p>\n<p>           Court also found possession of plaintiff no, no question of<\/p>\n<p>           dispossessing the appellant arises.\n<\/p>\n<p>                       (7) From perusal of the impugned Judgment, it<\/p>\n<p>           appears that the plaintiff case itself was that he was a<\/p>\n<p>           tenant in the suit premises and the trial Court also found<\/p>\n<p>           possession of plaintiff-respondent. At this stage, there is<\/p>\n<p>           no material to show that when the plaintiff was disposed<\/p>\n<p>           by what means and by whom.           However, this question<\/p>\n<p>           will be decided finally at the time of hearing of the Appeal<\/p>\n<p>           itself.   At present, it will suffice, if status quo regarding<\/p>\n<p>           possession is maintained during the pendency of this<\/p>\n<p>           Appeal. It is clarified that the lower Court shall proceed<\/p>\n<p>           to execute the decree by completing all other formalities.<\/p>\n<p>           In other words, further proceeding is not stayed.         The<\/p>\n<p>           earlier order passed by this Court dated 13.07.2010<\/p>\n<p>           accordingly stands modified.\n<\/p>\n<p>                       (8) Accordingly, this I.A.
