MAULIK NANAVATI, APP for\nRespondent(s) : 1, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>The<br \/>\n\tpresent Petition has been filed by the Petitioner under Articles 14,<br \/>\n\t21 and 226 of the Constitution of India as well as under Section 482<br \/>\n\tof the Criminal Procedure Code for the prayer that the FIR being<br \/>\n\tI-CR No. 26 of 2011 registered with DCB Police Station, Vadodara<br \/>\n\tCity (at Annexure-A) may be quashed and set aside on the grounds<br \/>\n\tstated in the memo of the Petition inter alia that the present FIR<br \/>\n\tis not maintainable.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. P.P.Majmudar for the Petitioners as well as<br \/>\n\tlearned APP Mr. Maulik Nanavati for the Respondent &#8211; State of<br \/>\n\tGujarat.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Majmudar submitted that for the same or the similar<br \/>\n\toffence, earlier FIR being I-CR No.279 of 2010 was registered with<br \/>\n\tSayaniganj Police Station, Vadodara for the same allegations, and<br \/>\n\ttherefore, the subsequent FIR, i.e. the present FIR being I-CR No.<br \/>\n\t26 of 2011 is not maintainable as it would amount an abuse of<br \/>\n\tprocess of law.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Majmudar has also referred to and relied upon the<br \/>\n\tjudgment of the Hon&#8217;ble Apex Court in case of <a href=\"\/doc\/1974324\/\">T.T.Antony v. State<br \/>\n\tof Kerala and Others,<\/a> (2001) 6 SCC 181 in<br \/>\n\tsupport of his submission and pointedly referred to the observations<br \/>\n\tmade in paragraphs 19, 20 and 27 thereof.  He therefore submitted<br \/>\n\tthat this is a fit case to exercise the discretion under Section 482<br \/>\n\tof Cr.PC or under Article 226 \/ 227 of the Constitution of India.\n<\/p>\n<p>\tLearned<br \/>\n\tAdvocate Mr. Majmudar has also submitted that even on merits, there<br \/>\n\tis no cause to file any such complaint as no case has been made out.<br \/>\n\t He submitted that the scheme was made and it was regarding the<br \/>\n\tinvestment for profit sharing in the business of gold, and if the<br \/>\n\tamount was collected and deposited on profit sharing basis, no<br \/>\n\tgrievance could be made, and therefore, whatever the amount which<br \/>\n\twas invested was with a clear understanding, and the alleged offence<br \/>\n\tcannot be said to have been made out.  He therefore submitted that<br \/>\n\tthe present FIR may be quashed and set aside and the present<br \/>\n\tPetition may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tAPP Mr. Maulik Nanavati submitted that as per the say of the<br \/>\n\tPetitioner himself the earlier FIR being I-CR No.279\/2010<br \/>\n\twhich has been registered for a similar offence, the charge sheet<br \/>\n\thas been filed and it has not been challenged.  Further, if there is<br \/>\n\tanother FIR, which is filed by a different complainant for the<br \/>\n\talleged offence qua him the complaint would be maintainable and in a<br \/>\n\tsubsequent judgment the Hon&#8217;ble Apex Court has clarified that the<br \/>\n\tratio in case of <a href=\"\/doc\/1974324\/\">T.T.Antony v. State of Kerala and Others<\/a><br \/>\n\t(supra) do not lay down any guideline, and therefore, the submission<br \/>\n\tthat subsequent FIR is not maintainable may not be accepted.  He has<br \/>\n\treferred to and relied upon the judgment of the Hon&#8217;ble Apex Court<br \/>\n\tin case of (2004) 13 SCC 292, <a href=\"\/doc\/1054183\/\">Upkar Singh v. Ved Prakash<br \/>\n\tAnd Others and Kari<br \/>\n\tChoudhary<\/a> v. Mst. Sita Devi and Others, (2002) 1 SCC 714.\n<\/p>\n<p>\tLearned<br \/>\n\tAPP Mr. Maulik Nanavati referred to the papers and submitted that a<br \/>\n\tbare perusal of the FIR itself discloses the cognizable offence<br \/>\n\tunder Section 154, and therefore, it cannot be said that the FIR is<br \/>\n\tnot maintainable.  He therefore submitted that considering the scope<br \/>\n\tof exercise of inherent powers under Section 482, the discretion may<br \/>\n\tnot be exercised.\n<\/p>\n<p>\tIn view of<br \/>\n\tthe rival submissions, it is required to be considered whether the<br \/>\n\tpresent Petition can be entertained or not.\n<\/p>\n<p>\tThough the<br \/>\n\tsubmission has been made by learned Advocate Mr. Majmudar for the<br \/>\n\tPetitioner that the earlier FIR being I-CR No.279\/2010 has been<br \/>\n\tregistered with Sayajiganj Police Station for the similar or the<br \/>\n\tsame offence, the present FIR being I-CR No.26\/2011 registered with<br \/>\n\tDCB Police Station, Vadodara is not maintainable.\n<\/p>\n<p>\tIt is required to be<br \/>\n\tmentioned that merely because the Sections or the alleged offences<br \/>\n\tare the same qua the Petitioner \/ Accused, it cannot be said that a<br \/>\n\tseparate FIR is not maintainable.  The complainant in both the FIRs<br \/>\n\tis different, and therefore, a different cause of action would arise<br \/>\n\tqua the separate complainant with regard to the transaction<br \/>\n\tregarding the alleged offence and \/ or having duped him, and<br \/>\n\ttherefore, the submission cannot be accepted that it would be an<br \/>\n\tabuse of process of Court.  It is also to be mentioned that at the<br \/>\n\tthreshold such an FIR cannot be thrown out.  At the most, if there<br \/>\n\tare many such complainants, it could be a recourse available to the<br \/>\n\tPetitioners to apply for clubbing as it was done in Telgi&#8217;s case.\n<\/p>\n<p>\tFurther,<br \/>\n\tthe submission made by learned Advocate Mr. Majmudar that even on<br \/>\n\tmerits, considering the FIR, no offence is made out and the scheme<br \/>\n\twas regarding the profit sharing and the investment was made with<br \/>\n\tfull knowledge and awareness, cannot be accepted at the face value<br \/>\n\tin light of the averments made in the complaint itself. As the Court<br \/>\n\tis not required to go into these details at this stage, it is<br \/>\n\tsuffice to say, a bare perusal of FIR clearly discloses the<br \/>\n\tcognizable offence, and therefore, it cannot be said that it has<br \/>\n\tbeen wrongly registered.\n<\/p>\n<p>\tLearned<br \/>\n\tAdvocate Mr. Majmudar has submitted that  Petitioner No.2 was not<br \/>\n\tthe Director at the relevant time in the Company.  Though this<br \/>\n\tsubmission has been made as it is stated in the FIR itself that for<br \/>\n\tduping the people the letters have been sent with the photographs of<br \/>\n\tthe Director or the officer concerned including the present<br \/>\n\tPetitioners.\n<\/p>\n<p>\tTherefore,<br \/>\n\thaving regard to the aforesaid aspect and also considering the scope<br \/>\n\tof exercise of inherent powers under Section 482 of Cr.PC or<br \/>\n\tconsidering the exercise of discretionary powers under Article<br \/>\n\t226\/227 of the Constitution of India, the Court is not inclined to<br \/>\n\texercise such discretion as no case has been made out for such<br \/>\n\tdiscretion and the present Petition deserves to be dismissed and<br \/>\n\taccordingly stands dismissed.
