JUSTICE SABINA\n\n\n\nPresent:     Mr. Tribhawan Singla, Advocate\n             for the appellant.\n                   .....\n\nSABINA, J.\n<\/pre>\n<p>             Plaintiff-appellant had filed a suit for permanent<\/p>\n<p>injunction claiming himself to be exclusive owner in possession of<\/p>\n<p>30 eucalyptus trees which had been planted on the boundary<\/p>\n<p>wall of Killa Nos. 7 and 8.\n<\/p>\n<p>             Defendants, in their written statement, denied         the<\/p>\n<p>contentions in the plaint. It was averred that eucalyptus trees<\/p>\n<p>were standing in the land belonging to the defendants bearing<\/p>\n<p>Killa No. 7\/\/4, 7\/\/3\/1, 3\/2, 3\/3 and 3\/4.<\/p>\n<p>             On the pleadings of the parties, following issues were<\/p>\n<p>framed by the trial Court:-\n<\/p>\n<blockquote><p>              &#8220;1.    Whether the plaintiff is entitled for a decree for<\/p>\n<p>                     permanent injunction is prayed for? OPP<\/p>\n<\/blockquote>\n<blockquote><p>              2.     Whether the plaintiff has no locus standi and<br \/>\n<span class=\"hidden_text\"> RSA No. 2170 of 2011 (O&amp;M)                                                   -2-<\/span><\/p>\n<p>                     cause of action to file and maintain the present<\/p>\n<p>                     suit? OPD<\/p>\n<\/blockquote>\n<blockquote><p>              3.     Whether     the   suit   of    the   plaintiff     is   not<\/p>\n<p>                     maintainable? OPD<\/p>\n<\/blockquote>\n<blockquote><p>              4.     Whether the plaintiff is estopped by his own act<\/p>\n<p>                     and conduct to file and maintain the present<\/p>\n<p>                     suit? OPD<\/p>\n<\/blockquote>\n<blockquote><p>              5.     Whether the plaintiff has concealed the true and<\/p>\n<p>                     material facts? OPD<\/p>\n<\/blockquote>\n<blockquote><p>              6.     Relief.&#8221;<\/p><\/blockquote>\n<p>             Civil Judge (Junior Division) vide judgment and decree<\/p>\n<p>dated 11.3.2010 dismissed the suit of the plaintiff. Aggrieved by<\/p>\n<p>the said judgment and decree, plaintiff filed an appeal and the<\/p>\n<p>same was also dismissed by the Additional District Judge vide<\/p>\n<p>judgment and decree dated 2.4.2011. Hence, the present appeal<\/p>\n<p>by the plaintiff.\n<\/p>\n<p>             After hearing the learned counsel for the appellant, I<\/p>\n<p>am of the opinion that the instant appeal deserves dismissal.<\/p>\n<p>             Plaintiff had filed the suit claiming himself to be the<\/p>\n<p>owner of 30 eucalyptus tress in dispute. The case of the plaintiff<\/p>\n<p>was that the eucalyptus trees were standing on the boundary wall<\/p>\n<p>of Killa No. 7 and 8, whereas the case of the defendant was that<\/p>\n<p>the eucalyptus trees were standing on their land bearing Killa<\/p>\n<p>No. 7. On an application, moved by the plaintiff, a local<\/p>\n<p>commissioner was appointed vide order dated 4.6.2008 and was<\/p>\n<p>directed to visit the spot and demarcate the land.                    The local<\/p>\n<p>commissioner-Naib Tehsildar, Shahbad inspected the spot on<\/p>\n<p>18.5.2009 and submitted his report.                As per the demarcation<br \/>\n<span class=\"hidden_text\"> RSA No. 2170 of 2011 (O&amp;M)                                           -3-<\/span><\/p>\n<p>report, the local commissioner found that the trees were standing<\/p>\n<p>on the land of the defendants.
