SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 15\/11\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>1.\tThis<br \/>\nLetters Patent Appeal has been preferred against the judgment and<br \/>\norder dated 01.02.1995 passed by the learned Single Judge in Special<br \/>\nCivil Application No.1471 of 1983.\n<\/p>\n<p>2.\tWe<br \/>\nhave heard Mr. NJ Shah learned AGP for the appellants and Mrs.<br \/>\nSangita Pahwa learned counsel for respondent no.1. While deciding the<br \/>\nwrit petition, the learned Single Judge observed that in none of the<br \/>\nreplies to the representations submitted by the respondent-employee,<br \/>\nit was pointed out that he could not be considered for promotion as<br \/>\nhe had not passed the departmental examination. Thus, it was never<br \/>\nbrought to the notice of the respondent-employee that he was required<br \/>\nto pass the departmental examination, which was a condition<br \/>\nprecedent, for getting promotion to the next higher post.\n<\/p>\n<p>3.\tFurther,<br \/>\nit was urged on behalf of the appellants that as the<br \/>\nrespondent-employee had passed the departmental examination in 1963<br \/>\nwhile he was serving under the State and had resigned from the State<br \/>\nservice and joined the Panchayat service in the year 1965, the<br \/>\npassing of the departmental examination before his appointment in<br \/>\nPanchayat service cannot be taken into consideration for the purpose<br \/>\nof promotion as the syllabus of examination, which was in force in<br \/>\n1963, had changed. However, the said submission did not find<br \/>\nacceptance with the learned Single Judge since it ran counter to the<br \/>\nGujarat Panchayat Service (Promotion to Cadres in State Services)<br \/>\nRules, 1974 wherein, the only condition stipulated is to clear the<br \/>\ndepartmental examination and to submit option within four months from<br \/>\nthe date of publication of the Rules or appointment on the post. The<br \/>\nrespondent-employee had fulfilled both the requirements and<br \/>\ntherefore, the learned Single Judge allowed the writ petition filed<br \/>\nby the respondent.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, we find no merits in the appeal and hence, the<br \/>\nappeal is dismissed.\n<\/p>\n<p>\tConsequently,<br \/>\nthe civil application is also dismissed.
