THE NON-FORMAL EDUCATION PROJECT OFFICER,\n              MUNGER.\n\n                                          -----------\n<\/pre>\n<p>4   20\/09\/2010           One of the reasons why this Court does not want<\/p>\n<p>                 to pass any categorical order in favour of the petitioner<\/p>\n<p>                 for payment of certain claim made by the petitioner is<\/p>\n<p>                 that the petitioner retired from service way back in the<\/p>\n<p>                 year 1999 but approached this Court only in the year<\/p>\n<p>                 2005 raising certain claim on the ground of non-payment<\/p>\n<p>                 for no apparent reason. Petitioner was supposed to be an<\/p>\n<p>                 employee of District Mass Education relating to Non-<\/p>\n<p>                 formal Education Project.\n<\/p>\n<p><span class=\"hidden_text\">                            -2-<\/span><\/p>\n<p>                Some payment of salary etc. has now been made<\/p>\n<p>        but the petitioner claims that Dearness Allowance and<\/p>\n<p>        increment etc. has not been paid to him. Even increase in<\/p>\n<p>        basic pay has not been allowed.\n<\/p>\n<p>                Since counter affidavit has not been filed by the<\/p>\n<p>        State in all these years, the Court cannot decide the issue<\/p>\n<p>        raised herein. But if the petitioner now files a fresh<\/p>\n<p>        application before respondent no. 7, the District Mass<\/p>\n<p>        Education Officer, Nalanda at Biharsharif with his claim,<\/p>\n<p>        the matter would be verified by him and the outcome will<\/p>\n<p>        be known to the petitioner within a period of six months<\/p>\n<p>        from the date of filing of such application by the<\/p>\n<p>        petitioner with a copy of this order.
