It is the case<br \/>\nof the prosecution that the appellant was aggrieved against the<br \/>\ndeceased by his conviction in connection with the offence of<br \/>\nattempted murder and he, therefore, at the relevant time assaulted<br \/>\nthe deceased with a sickle and inflicted blows on head and other<br \/>\nparts of the body. He also intimidated the deceased. An FIR was,<br \/>\ntherefore, lodged with Pethapur Police Station vide CR No.181 of<br \/>\n2002. Offence was registered and investigated and ultimately<br \/>\ncharge-sheet was filed in the Court of JMFC, Gandhinagar, who, in<br \/>\nturn, committed the case to the Court of Sessions and Sessions Case<br \/>\nNo.42 of 2003 came to be registered.\n<\/p>\n<p>3.\tCharges<br \/>\nwere framed against the accused at Exh.4 for the offences punishable<br \/>\nunder Sections 323, 324, 326, 302, 504 and 506(2) of IPC, to which he<br \/>\npleaded not guilty and claimed to be tried. The trial Court found<br \/>\nthat the prosecution was successful in proving charge of murder<br \/>\nagainst the appellant and, therefore, convicted him for the same and<br \/>\nsentenced him to undergo imprisonment for life with a fine of<br \/>\nRs.1000\/-, in default, to undergo RI for six months, whereas the<br \/>\naccused-appellant came to be acquitted for rest of the charges.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Ms Banna Dutta for the appellant submitted that though the<br \/>\nprosecution has examined as many as three eye-witnesses, the fact<br \/>\nremains that the deceased died after a long spell of about six weeks.<br \/>\nAfter the incident, the deceased was admitted to the hospital for<br \/>\ntreatment and was discharged on 28.10.2002. However, he again got<br \/>\nadmitted in the hospital on 28.11.2002 and died on that very day. The<br \/>\nprosecution has not been able to establish that the deceased died<br \/>\nbecause of the injuries suffered by him. Ms Dutta further submitted<br \/>\nthat in fact the deceased had recovered and was discharged from<br \/>\nhospital and, therefore, the nexus between the cause of death and the<br \/>\nincident is not established. The trial Court has overlooked this<br \/>\naspect while recording conviction. Therefore, the appeal may be<br \/>\nallowed and the order of conviction may be set aside.\n<\/p>\n<p>5.\tLearned<br \/>\nAPP Mr Parikh has opposed this appeal. According to him, there are<br \/>\neye-witnesses to the incident. He submitted that though there is a<br \/>\ntime lag between the incident and the death, the medical evidence<br \/>\nwould show that though the deceased was discharged from hospital, he<br \/>\nhad not fully recovered and he developed complications in the<br \/>\ninjuries  caused by the appellant to him, which ultimately resulted<br \/>\ninto his death. Mr Parikh, therefore, submitted that the appeal may<br \/>\nbe dismissed.\n<\/p>\n<p>6.\tWe<br \/>\nhave examined the record and proceedings in the context of rival<br \/>\nsubmissions.\n<\/p>\n<p>7.\tInvolvement<br \/>\nof the appellant in the incident is established by the prosecution by<br \/>\nexamining Kalabhai Vahjibhai Raval (Exh.7), Naranbhai Bhalabhai Raval<br \/>\n(Exh.15) and Sankabhai Vahjibhai Raval (Exh.19). All the three<br \/>\neye-witnesses have rendered consistent evidence as to how the<br \/>\nincident occurred and how the appellant assaulted the deceased and<br \/>\ncaused injuries to him. All the witnesses have been tested on the<br \/>\ntouchstone of cross-examination, but nothing substantial emerges to<br \/>\nrender any of the deposition doubtful. Learned advocate for the<br \/>\nappellant is also not in a position to point out any discrepancy or<br \/>\nweakness in the evidence of these witnesses. Involvement  of the<br \/>\nappellant in the incident is, therefore, duly established.\n<\/p>\n<p>8.\tThe<br \/>\nmedical evidence in the form of evidence of Dr Shilpaben Kanubhai<br \/>\nYadav (Exh.16) is relevant. She had treated the deceased initially<br \/>\nand she says that on 19.10.2002 the deceased was brought to Ahmedabad<br \/>\nCivil Hospital for treatment with history of assault with sickle and<br \/>\npipe. He had injury on head 3 cm. long which was sutured. There were<br \/>\ntwo other injuries which were 5 cm. long with sutures and there was<br \/>\nan injury 3 cm. long on the occipital region. There was a sutured<br \/>\nwound on the right scapula region. There was a fracture of sphenoid<br \/>\naspect of right scapula. According to the Doctor, the patient was<br \/>\ntreated and ultimately discharged on 28.10.2002. The injuries were<br \/>\nsufficient in the ordinary course of nature to cause death and were<br \/>\npossible with muddamal sickle.\n<\/p>\n<p>9.\tThe<br \/>\nsecond evidence is of Dr Vinayak Rao Patil who had performed the<br \/>\npost-mortem. He describes the injuries noticed by him in column No.17<br \/>\nof the post-mortem notes as under :-\n<\/p>\n<p> 17.(1)\tA healed injury<br \/>\npresent over rt. mastoid region of head of size 3.5 X 1 c.m. it is<br \/>\nscar.\n<\/p>\n<p>(2)\tA healed injury<br \/>\npresent on rt. scapula of back, size 1 X 1 cm present at lower end of<br \/>\nscapula   scar;\n<\/p>\n<p>(3)\tA bony gap present in<br \/>\nrt. side of head   seen externally as depression 5.5 X 4.5 cm.<br \/>\nsized.\n<\/p>\n<p>9.1\tHe<br \/>\nalso noticed fracture of right side of skull. The injuries were<br \/>\nante-mortem. Both the lungs were congested. In his opinion, the death<br \/>\nwas due to respiratory  failure following head injury and its<br \/>\ncomplications. In his deposition, he states that during post-mortem,<br \/>\nhe found fracture of the skull. He performed a surgical operation by<br \/>\nwhich the broken pieces of skull were removed. There was bleeding<br \/>\naround the brain substance. There was also pus found there. Whitish<br \/>\nthick fluid was also found. After examining the Histo pathological<br \/>\nreport, the Doctor formed an opinion that the death was due to<br \/>\ncomplications resulting out of injury caused to the deceased. In our<br \/>\nopinion,  the death, therefore, occurred because of the injuries<br \/>\ncaused to the deceased by the appellant with sickle.\n<\/p>\n<p>10.\tAs<br \/>\ncan be seen from the nature of injuries and the manner in which the<br \/>\nincident occurred, there is no scope for forming any other opinion<br \/>\nthan to conclude that the appellant wilfully committed murder of the<br \/>\ndeceased by intentionally causing the injuries, which were sufficient<br \/>\nin the ordinary course of nature to cause death.\n<\/p>\n<p>11.\tWe<br \/>\ndo not find any merits in the appeal. The appeal must fail and stands<br \/>\ndismissed. The judgment and order dated 7.1.2004 passed by the<br \/>\nSessions Court, Ahmedabad (Rural) at Gandhinagar in Sessions Case<br \/>\nNo.42 of 2003 is hereby confirmed.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.L.\n<\/p>\n<p>DAVE, J.)<\/p>\n<p>\t\t\t\t\t\t\t(BANKIM<br \/>\nN.
