{"id":85978,"date":"2010-07-29T00:00:00","date_gmt":"2010-07-28T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/cm-dunka-higher-secondary-vs-state-of-u-p-others-on-29-july-2010-2"},"modified":"2016-12-27T00:14:26","modified_gmt":"2016-12-26T18:44:26","slug":"cm-dunka-higher-secondary-vs-state-of-u-p-others-on-29-july-2010-2","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/cm-dunka-higher-secondary-vs-state-of-u-p-others-on-29-july-2010-2","title":{"rendered":"C\/M, Dunka Higher Secondary &#8230; vs State Of U.P. &amp; Others on 29 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">C\/M, Dunka Higher Secondary &#8230; vs State Of U.P. &amp; Others on 29 July, 2010<\/div>\n<pre>Court No. - 39\n\nCase :- WRIT - C No. - 67086 of 2009\n\nPetitioner :- C\/M, Dunka Higher Secondary School &amp; Anr.\nRespondent :- State Of U.P. &amp; Others\nPetitioner Counsel :- Anil Bhushan\nRespondent Counsel :- C.S.C.\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The petitioners have sought the quashing of the order dated 28th<br \/>\nOctober, 2009 passed by the Regional Secretary, Madhyamik<br \/>\nShiksha Parishad, Bareilly by which the application submitted by<br \/>\nthe petitioners for upgradation of the Institution to the Intermediate<br \/>\nlevel has been rejected on the ground that the petitioner-Institution<br \/>\ndoes not have one alternative room measuring 6 x 5 sq. meters.\n<\/p>\n<p>It is submitted by Sri Anil Bhushan, learned counsel appearing for<br \/>\nthe petitioners that the District Inspector of Schools in his report<br \/>\ndated 11st September, 2009 has mentioned that the petitioner-<br \/>\nInstitution has 29 rooms as against the requirement of 18 rooms<br \/>\nand, therefore, it cannot be said that the petitioner-Institution does<br \/>\nnot have the alternative room.\n<\/p>\n<p>A counter affidavit has been filed on behalf of the respondents. All<br \/>\nthat has been stated is that the petitioner-Institution does not have<br \/>\nthe alternative room measuring 6 x 5 sq. meters. There is no denial<br \/>\nat all that the Institution has 29 rooms as against the requirement<br \/>\nof 18 rooms. Learned counsel for the petitioners, therefore,<br \/>\nsubmitted that the reason assigned by the Regional Secretary for<br \/>\nrejecting the application filed by the petitioner for upgradation of<br \/>\nthe Institution to the Intermediate level, is not correct.\n<\/p>\n<p>Learned Standing Counsel appearing for the respondents has not<br \/>\nbeen able to substantiate how the report dated 11th September,<br \/>\n2009 submitted by the District Inspector of Schools is incorrect.\n<\/p>\n<p>Such being the position, the order dated 28th October, 2009 passed<br \/>\nby the Regional Secretary, Madhyamik Shiksha Parishad, Bareilly<br \/>\ncannot be sustained. It is, accordingly, set aside.
