This  is  claimants&#8217;  appeal for  enhancement  of  the<\/p>\n<p>   compensation awarded by the Additional Motor Accident Claims <\/p>\n<p>   Tribunal, Dhamtari (for short, &#8220;the Tribunal&#8221;) vide award<\/p>\n<p>   dated 17-1-2004 passed in Claim Case No. 133\/2004.\n<\/p>\n<p>2.   As against the compensation of Rs.11,52,000\/- claimed<br \/>\nby the appellants\/claimants, unfortunate parents of deceased<br \/>\nDamru, by filing a claim petition under Section 166 of the<br \/>\nMotor Vehicles Act, for his death in the motor accident  on<br \/>\n25-4-2003, the Tribunal awarded a total sum of Rs. 55,000\/-<br \/>\nas compensation along with interest @ 6% per annum from the<br \/>\ndate of filing of the claim petition till the date of actual<br \/>\npayment.\n<\/p>\n<p>3.   Shri Wasim Miyam, learned counsel appearing for the<br \/>\nappellants vehemently argued that the Tribunal has erred in<br \/>\nawarding low compensation of Rs. 55,000\/- only though the<br \/>\nappellants&#8217; son deceased Damru was only son upon whom  the<br \/>\nappellants  depended at their old age.\n<\/p>\n<p>4.   Per contra, Shri Avinash Mishra, learned counsel<br \/>\nappearing for respondent No.3 Oriental Insurance Company<br \/>\nLimited, supporting  the impugned award contended that as<br \/>\ndeceased Damru was not having any independent  income of his<br \/>\nown, the compensation of Rs. 55,000\/- awarded by the<br \/>\nTribunal is just and proper compensation  in the facts and<br \/>\ncircumstances of the present case.\n<\/p>\n<p>5.   Shri P.P. Sahu, learned counsel for respondents No. 1<br \/>\nand 2  the owner and driver of the offending vehicle also<br \/>\nsupported the award.\n<\/p>\n<p>6.   I have heard learned counsel for the parties, perused<br \/>\nthe impugned award and record of the Tribunal.\n<\/p>\n<p>7.   On perusal of the record, it is clear that appellants&#8217;<br \/>\nson Damru was shown to be 5 years of age in his postmortem<br \/>\nreport (Ex.P\/7) at the time of accident.  Heman (AW\/1),<br \/>\nfather of the deceased Damru, has categorically deposed in<br \/>\nhis statement that at the time of accident,  his son Damru<br \/>\nwas about five years old and  was a student of Ist standard.<br \/>\nOn a close scrutiny of the aforesaid evidence, it is proved<br \/>\nthat the age of deceased Damru was certainly five years at<br \/>\nthe time of accident.\n<\/p>\n<p>8.   Hon&#8217;ble the Supreme Court while considering as to what<br \/>\nwould be the just and proper compensation for the death of a<br \/>\nchild aged about  7 years in the case of Oriental Insurance<br \/>\nCompany Ltd., Vs. Syed Ibrahim and others, reported in 2007<br \/>\n(4) TAC 385 (SC) has observed in paras 9 &amp; 10 which read as<br \/>\nbelow:\n<\/p>\n<blockquote><p>           &#8220;9.    This  court in Lata  Wadhwa  while<br \/>\n           computing  compensation made  distinction<br \/>\n           between  the  deceased  children  falling<br \/>\n           within the age group of 5 to 10 years and<br \/>\n           age group of 10 to 15 years.\n<\/p><\/blockquote>\n<blockquote><p>           10.  In cases of young children of tender<br \/>\n           age,  in  view  of uncertainties  abound,<br \/>\n           neither their income at the time of death<br \/>\n           nor  the proposals of the future increase<br \/>\n           in    their   income   nor   chances   of<br \/>\n           advancement  of their career are  capable<br \/>\n           of   proper  determination  on  estimated<br \/>\n           basis.   The  reason is that at  such  an<br \/>\n           early age, the uncertainties in regard to<br \/>\n           their academic pursuits, achievements  in<br \/>\n           career and thereafter advancement in life<br \/>\n           are  so  many that nothing can be assumed<br \/>\n           with  reasonable  certainty.   Therefore,<br \/>\n           neither  is  the income of  the  deceased<br \/>\n           child  capable of assessment on estimated<br \/>\n           basis  nor is the financial loss suffered<br \/>\n           by  the  parents capable of  mathematical<br \/>\n           computation.&#8221;\n<\/p><\/blockquote>\n<p>9.    The  compensation  of  Rs.  55,000\/-  awarded  by  the<\/p>\n<p>   Tribunal when examined in the context of the above-mentioned<\/p>\n<p>   dictum of the Hon&#8217;ble Supreme Court in the case of  Oriental<\/p>\n<p>   Insurance  Co.  Ltd.,  (supra)  and  the  fact  that  the<\/p>\n<p>   appellants&#8217; son Damru was about 5 years on the date of the<\/p>\n<p>   accident, I am satisfied,  is just and proper compensation<\/p>\n<p>   and  the same does not call for any interference  in this<\/p>\n<p>   appeal.\n<\/p>\n<p>10.  Accordingly, the appeal filed by the<br \/>\nappellants\/claimants for enhancement of the compensation is<br \/>\nliable to be dismissed and is hereby dismissed.\n<\/p>\n<p>11.
