According to sec 40(6), (xii) all the public authorities are mandate to publish this information on the<br \/>\n    website of the department, but there is no such information available on your website, therefore<br \/>\n    kindly provide me the following information in context to this:\n<\/p>\n<p>i) Which officer was responsible to publish all the information on the website.\n<\/p>\n<p>ii) This information has not been published on the website therefore what action the department is going<br \/>\n     to take against the responsible officer?\n<\/p>\n<p>iii) By when this information would be published on the website?<br \/>\n Reply from PIO:-\n<\/p>\n<p>Reply to QI &amp; 2: The requisite information in r\/o 20 schools of this district running into 20 CDs is<br \/>\navailable in the office of undersigned which you may obtain on any working day during office hours by<br \/>\npaying Rs. 50\/- per CD i.e. a total amount of Rs.1000<br \/>\nReply to Q3: The information have already uploaded by the HQ on the website of the department.\n<\/p>\n<p>Ground of the Complaint:\n<\/p>\n<p>The PIO has not mentioned anywhere that for how many schools the information is yet to be provided.<br \/>\nWe had talked to the PIO and PIO himself informed us that he has compiled the information before<br \/>\nforwarding to the Head Quarters, but he is providing us 20 CDs and the rest of the information for left out<br \/>\nschool is still awaited. This shows that PIO is harassing us.<br \/>\nHe has also informed that the information would be available on website but he himself is not sure that<br \/>\ninformation is positively available on website or not.<br \/>\nIn the order no. CIC\/SG\/A\/2009\/001209\/3974 dated 2nd July 2009 the Commission directed the &#8216;PIO to<br \/>\nensure that the details of information about admission to Economically Weaker Section for past three<br \/>\nyears for all schools must be put up on the website U\/s 4 before 15th Aug 2009.<br \/>\nI want to inform you that the ADE (Act) has informed the Commission dated 12\/8\/09 that the<br \/>\nCommission&#8217;s order has been compiled with and all the required information is available on website<br \/>\nwhich is completely wrong and misleading information, because this information is not available till date<br \/>\non the website.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nComplainant: Absent;\n<\/p>\n<p>Respondent : Mr. J. B. Singh, Public Information Officer &amp; Dy. Director;\n<\/p>\n<p>       The Commission discussed with the PIO that as per a letter received on 12\/08\/2009 from<br \/>\nADE(Act) information sought in the present application should be on the website as per the Commission&#8217;s<br \/>\ndecision no. CIC\/SG\/A\/2009\/001209\/3974. The Commission directs the PIO to ensure that the relevant<br \/>\ninformation about admissions under the EWS Quota is put-up on the website before 15 May 2011 and<br \/>\nupdated regularly. The Commission hereby warns the PIO that if this is not done the Commission will<br \/>\nexpect the PIO to furnish information to RTI applicants who wants this infroamtion free of cost and in<br \/>\ncase any appeals or complaints comes to the Commission about non availability of this information, the<br \/>\nCommission will consider awarding compensation to the such applicants\/complainants for the harassment<br \/>\nand the loss and detriment suffered by them.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The complaint is allowed.\n<\/p>\n<p>      The PIO is directed to ensure that the data is put up on the website before<br \/>\n15 May 2011 under its obligation as per Section-4(1)(b) of the RTI Act.
