RAMACHANDRAN NAIR, J.\n               ---------------------------------------\n                   W.P.(C) No.25941 OF 2009\n               ---------------------------------------\n           Dated this the 7th day of October, 2009.\n\n\n                         J U D G M E N T\n<\/pre>\n<p>       The petitioner is presently working as Higher Secondary<\/p>\n<p>School Teacher (Hindi) in the Government Higher Secondary<\/p>\n<p>School, Kadammanitta in Pathanamthitta District. She has been<\/p>\n<p>working there since 06.09.2007.        Her husband is working as<\/p>\n<p>Assistant Surgeon in Government Medical Service, Tamilnadu<\/p>\n<p>State at Kulasekharam in Kanyakumari District.             Since the<\/p>\n<p>petitioner and her husband are working in two different districts,<\/p>\n<p>it is submitted that they are facing personal difficulties to manage<\/p>\n<p>the family affairs.\n<\/p>\n<p>       2. Earlier the petitioner filed appropriate representations<\/p>\n<p>seeking for a transfer to Trivandrum District. Exhibits P4 and P5<\/p>\n<p>are the representations thus filed. The petitioner had approached<\/p>\n<p>this Court by filing W.P.(C) No.29839\/2008 and Exhibit P6 is the<\/p>\n<p>copy of the judgment in the said writ petition. In terms of the<\/p>\n<p>directions issued, the claim of the petitioner was considered, but<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25941\/2009             2<\/span><\/p>\n<p>rejected as per Exhibit P7.\n<\/p>\n<p>       3. In Exhibit P7, the plea for transfer to Trivandrum District<\/p>\n<p>was rejected mainly for the reason that there is no vacancy of<\/p>\n<p>H.S.S.T (Hindi) in any of the schools pointed out by the petitioner<\/p>\n<p>or in any schools in Trivandrum District.\n<\/p>\n<p>       4.     The petitioner, in Exhibit P8, has pointed out two<\/p>\n<p>existing vacancies in Trivandrum District namely, in Government<\/p>\n<p>Higher Secondary School, Balaramapuram and in Government<\/p>\n<p>Boys&#8217; Higher Secondary School, Pettah, Trivandrum.               One<\/p>\n<p>vacancy has arisen due to promotion and another consequent on<\/p>\n<p>retirement of a teacher.        It is in these circumstances, the<\/p>\n<p>petitioner has approached this Court seeking for a direction to the<\/p>\n<p>2nd respondent to transfer her to Trivandrum district, in any of<\/p>\n<p>the existing vacancies.\n<\/p>\n<p>       5. As directed by this Court, a statement has been filed on<\/p>\n<p>behalf of the 2nd respondent. The existence of the two vacancies<\/p>\n<p>have been admitted in the statement. It is pointed out that the<\/p>\n<p>application for general transfer will be invited soon after resolving<\/p>\n<p>the issue regarding appointment of Principals in the Higher<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25941\/2009              3<\/span><\/p>\n<p>Secondary School and the general transfer can be effected only<\/p>\n<p>after inviting applications from the Higher Secondary School<\/p>\n<p>Teachers. It is also pointed out that there are other seniors also<\/p>\n<p>whose claims will have to be considered.\n<\/p>\n<p>       Therefore, if the petitioner submits an application pursuant<\/p>\n<p>to the invitation of application of teachers for general transfer,<\/p>\n<p>her plea will be considered sympathetically in any of the<\/p>\n<p>vacancies apart from the vacancies pointed out in the writ<\/p>\n<p>petition along with the applications of others and in accordance<\/p>\n<p>with the norms and appropriate orders shall be passed after<\/p>\n<p>considering her claim also.\n<\/p>\n<p>       With the above observation, this writ petition is disposed of.<\/p>\n<p>                                   T.R.
