Bhavadasan, J.\n<\/p>\n
             In this Review Petition, the petitioner seeks<\/p>\n
review of the Judgment dated 07.12.2009 in WA<\/p>\n
No.2687\/09, whereby the judgment of the learned single<\/p>\n
Judge was upheld by the Division Bench of this Court. The<\/p>\n
petitioner was directed to approach the AICTE for<\/p>\n
appropriate reliefs.\n<\/p>\n
             2. In the RP, it is pointed out that this Court had<\/p>\n
omitted to take note of the fact that deputation is treated as<\/p>\n
qualifying service and therefore, the petitioner was entitled<\/p>\n
to the benefit of the Government Order, relied on by him.<\/p>\n
The petitioner has also produced Annexure 2 order,<\/p>\n
whereby the Government have accepted the claim of the<\/p>\n
petitioner in principle.\n<\/p>\n

            3. The learned Government Pleader appearing<\/p>\n
for the State points out that Annexure 2 order produced by<\/p>\n
the petitioner shows that the Government have accepted<\/p>\n
the relief sought for by the petitioner in principle and have<\/p>\n
postponed implementation of the order, awaiting report of<\/p>\n
the Director of Technical Education, after assessing<\/p>\n
additional financial commitments of the Government.<\/p>\n
According to him, there is no final order passed by the<\/p>\n
Government, accepting the relief sought for by the<\/p>\n
petitioner.\n<\/p>\n
            4. A reading of Annexure 2 Government Order<\/p>\n
leaves one in no doubt that the Government have accepted<\/p>\n
the claim put forward by the petitioner and that he is<\/p>\n
entitled to the claim raised in the Writ Petition. The only<\/p>\n
impediment in denying the claim of the petitioner, is the<\/p>\n
financial implication that may arise while implementing the<\/p>\n
order. Accordingly, the Review Petition is allowed and the<\/p>\n
claim of the petitioner is upheld to the extent mentioned<\/p>\n

above and subject to the orders that may be subsequently<\/p>\n
passed by the Government, regarding the financial<\/p>\n
implications and such other matters.<\/p>\n
