Dua, Adv. for the Respondent<br \/>\n     The following Judgment of the Court was delivered:<\/p><\/blockquote>\n<p>      JU D G ME N T<br \/>\nNANAVATI, J.\n<\/p>\n<p>     Leave granted. Hard learned counsel for the appellants.<br \/>\nThe respondent, through served,\t has not appeared either in<br \/>\nperson or though a lawyer.\n<\/p>\n<p>     The respondent,  who had by 2.4.567 years&#8217; standing at<br \/>\nthe Bar,  joined Punjab Civil Service(Judicial)\t onthat<br \/>\ndate. He  was subsequently  promoted and  became a member of<br \/>\nthe Punjab  Civil Service  (judicial) on  that date.  He was<br \/>\nsubsequently promoted  and became  a member  of the  Punjab<br \/>\nSuperior Judicial  Service. Heretiredas\t a  District and<br \/>\nSessions Judge on 31.12.84. As he retired as a member of the<br \/>\nPunjab Superior Judicial Service.  He retired as a District<br \/>\nand Sessions  Judge on 31.12.84. As he retired as a Services<br \/>\n(Death-cum-Retirement Benefits) Rules,1958 applied tohim.<br \/>\nAccordingly his pension was fixed. On 22.02.90the State of<br \/>\nPunjab amendedRule 16 of  the  Punjab  Superior\t Judicial<br \/>\nServiceRules and made two changes. In respect of death-cum-<br \/>\nretirement benefits  ofthe  members  of\t thatService the<br \/>\nPunjab Civil  serv Rules were made applicable instead of the<br \/>\nall India  Service Rules  whichwere  applicable till  then.<br \/>\nanotherchangewas inrespectof  direct recruits  to the<br \/>\nService. In their case,the actual period of practice at the<br \/>\nBar not exceeding 10 years will have to be added now to his<br \/>\nservicequalifying  for superannuation pension  and  other<br \/>\nretirement benefits.  Rule 4.2of thePunjab Civil Service<br \/>\nRules Volume  II provides  that&#8221;an  officer appointedto a<br \/>\nservice of   post  may\tadd  his  service  qualifying for<br \/>\nsuperannuation pension(but not\tfor  any  other\t class\tof<br \/>\npension)  theactualpension )  the actual period not<br \/>\nexceeding one  fourth or  the length  of his  service of the<br \/>\nactual period  by which his  age  at  the  recruitment one<br \/>\nexceedstwentyfive  years  or a\tperiod\toffive\tyears,<br \/>\nwhichever is least, if the service or post is one:-\n<\/p>\n<p>     (a)  for which thepost graduate research or specialist<br \/>\nqualification, or experience inscientific. technological or<br \/>\nprofessional fields is essential, and\n<\/p>\n<p>     (b) &#8230;.\t   &#8230;&#8230;&#8230;&#8230;..&#8221;\n<\/p>\n<p>     The said Rule has been made applicable to those who are<br \/>\nrecruited  after   26.10.60.  validity of  that\t Rule was<br \/>\nchallenged before  the Punjab  and Haryana HighCourt in Raj<br \/>\nKumar Gupta  vs. Stateof Haryana (C.W.P.No. 11756 of 1989)<br \/>\nand 17.9.91  the High  court declared  it as  invalid  being<br \/>\nviolative of Article 14of the Constitution.\n<\/p>\n<p>     The  appellant,   therefore,  made\t a   representation<br \/>\nsometime thereafter  for refixation of his pension by giving<br \/>\nhim benefit  ofRule  4.2. It  was  rejected  by\t the  State<br \/>\nGovernment on  9.7.92 on  the ground  that the respondent at<br \/>\nthe time  of his  retirement was  governed by  the all India<br \/>\nServices (Death-cum-RetirementBenefits) Rules and not  by<br \/>\nthe Punjab  Civil Service RulesVolume II and, therefore, he<br \/>\nwas not entitled to  claim the benefit of Rule 4.2. It was<br \/>\nalso rejected  on the  ground that  theamendment of 22.2.90<br \/>\nmade in Rules 16  of the  Punjab Superior  Judicial Service<br \/>\nRules was  onlyprospective  and the benefit ofthe judgment<br \/>\nof the Punjab and Haryana High Court inS.S. Dewan vs. State<br \/>\nof Punjab  cannot be  given asthe said\tdecision was under<br \/>\nchallenge before  this Court  and  operation  of  the  order<br \/>\npassed in  thatcase  was stayed. The respondent, therefore,<br \/>\nfiled a writ petition in the Punjab and Haryana High Court.<br \/>\nIt wasallowed, following  itsjudgment  in Raj Kumar Gupta<br \/>\nvs. State of Haryana (supra) byholdingthat fixing 26.10.60<br \/>\nas thecut  -off\t date  wasarbitrary.  The Statehas,<br \/>\ntherefore, filed this appeal.\n<\/p>\n<p>     Asstatedearlierprior  to  22.2.90\tmembers\t of the<br \/>\nPunjab SuperiorJudicial Service, in respect oftheir death-<br \/>\ncum-retirement benefits were  governed by  the\tAll  India<br \/>\nServices (Death-cum-RetirementBenefits) Rules and not  by<br \/>\nthe  Punjab  Civil  Service  Rules  Volume  II. Though the<br \/>\nrespondent claimed  thebenefit of Rule\t4.2 of\tthe Punjab<br \/>\nCivil Service Rules Volume II it was really by virtue of the<br \/>\namendment madein Rule 16 ofthe Punjab  Superior Service<br \/>\nRules which  made thoseRules applicable from 22.2.90. As we<br \/>\nhave held  in State  ofPunjabvs. S.S. Dewan (Civil Appeal<br \/>\nNo. 506 of 1992) that the amendment made in Rule 16 applies<br \/>\nonly to those who  were\/are in service and  retired\/retire<br \/>\nafter it  to be regarded as  misconceived andwithout any<br \/>\nsubstance. Therefore,  in  view of  the\t decision  inS.S.<br \/>\nDewan&#8217;scase  (supra) this  appeal is  allowed.the judgment<br \/>\nand order passed by theHigh Court is set asideand thewrit<br \/>\npetition filedby therespondent stands dismissed.
