No. 925 of 2008\n                ................................................\n                        Dated: 19-03-2008\n\n                                O R D E R\n<\/pre>\n<p>     In this Revision Petition filed under Section 397 read<\/p>\n<p>with Sec. 401 Cr.P.C. the petitioner who was the accused in<\/p>\n<p>C.C. No. 5 of 1996         on the file of the J.F.C.M.,I, Punalur<\/p>\n<p>challenges the conviction entered and the sentence passed<\/p>\n<p>against him for an offence punishable under Sec. 138 of<\/p>\n<p>the Negotiable Instruments Act, 1881 (hereinafter referred<\/p>\n<p>to as &#8216;the Act&#8217;).\n<\/p>\n<\/p>\n<p>     2.    I heard the learned counsel for the Revision<\/p>\n<p>Petitioner and the learned Public Prosecutor.<\/p>\n<p>     3.    The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the<\/p>\n<p>Revision. The courts below have concurrently held that the<\/p>\n<p>cheque in question was drawn by the petitioner in favour of<\/p>\n<p>the complainant on the drawee bank, that the cheque was<\/p>\n<p>validly presented to the bank, that it was dishonoured for<\/p>\n<p>reasons which fall under Section 138 of the Act, that the<\/p>\n<p>complainant made a demand for payment by a notice in<\/p>\n<p>time in accordance with clause (b) of the proviso to Section<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 925 of 2008         -:2:-<\/span><\/p>\n<p>138 of the Act          and that the Revision Petitioner\/accused<\/p>\n<p>failed to make the payment within 15 days of receipt of the<\/p>\n<p>statutory notice.         Both the courts have considered and<\/p>\n<p>rejected the defence set up by the revision petitioner while<\/p>\n<p>entering the above finding.            The said finding has been<\/p>\n<p>recorded on an appreciation of the oral and documentary<\/p>\n<p>evidence. I do not find any error, illegality or impropriety<\/p>\n<p>in the finding so recorded concurrently by the courts below.<\/p>\n<p>The conviction was thus rightly entered against              the<\/p>\n<p>petitioner.\n<\/p>\n<\/p>\n<p>       4.        What now survives for consideration is the<\/p>\n<p>question as to whether            what should be the      proper<\/p>\n<p>sentence to be imposed on the revision petitioner. Having<\/p>\n<p>regard to the facts and circumstances of the case, I am<\/p>\n<p>inclined to modify the sentence imposed on the revision<\/p>\n<p>petitioner.       In the light of the recent decision of the<\/p>\n<p>Supreme Court in            Ettappadan Ahammedkutty       v. E.P.<\/p>\n<p>Abdullakoya &#8211; 2008 (1) KLT 851 default sentence cannot be<\/p>\n<p>imposed for the enforcement of an order for compensation<\/p>\n<p>under Sec. 357 (3) Cr.P.C. Accordingly, for the conviction<\/p>\n<p>under Section 138 of the Act the revision petitioner is<\/p>\n<p>sentenced to pay a fine of Rs. 85,000\/- (Rupees eighty five<\/p>\n<p>thousand         only).      The said     fine shall be paid as<\/p>\n<p>compensation under Section 357 (1) Cr.P.C.           The revision<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 925 of 2008     -:3:-<\/span><\/p>\n<p>petitioner is permitted     either to deposit the said fine<\/p>\n<p>amount before the Court below            or directly pay the<\/p>\n<p>compensation to the complainant within three months<\/p>\n<p>from today and produce a memo to that effect before the<\/p>\n<p>trial Court in case of direct payment. If he fails to deposit<\/p>\n<p>or pay the said amount within the aforementioned period<\/p>\n<p>he shall suffer simple imprisonment for three months by<\/p>\n<p>way of default sentence.\n<\/p>\n<\/p>\n<p>       In the result, this Revision is disposed of confirming<\/p>\n<p>the conviction entered but modifying the sentence imposed<\/p>\n<p>on the revision petitioner.\n<\/p>\n<\/p>\n<p>                                   V.
