Justice V.GIRI\n\n Dated :03\/06\/2009\n\n O R D E R\n                          V.GIRI, J.\n              ---------------------------\n                   W.P.(C).14011 of 2009\n              ---------------------------\n          Dated this the 3rd day of June, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>            The petitioner is a trader in Foodgrains. According<\/p>\n<p>to him, though he has applied for a licence under the Kerala<\/p>\n<p>Foodgrain Dealers&#8217; Licensing Order, 1967, the application is<\/p>\n<p>pending. A consignment of 150 quintals of rice stated to be<\/p>\n<p>purchased by him from a dealer in Palakkad was transported in<\/p>\n<p>a vehicle belonging to the second petitioner, who is stated to<\/p>\n<p>have a valid inter state permit. The consignment was seized by<\/p>\n<p>the 3rd respondent apparently on the premise that the<\/p>\n<p>transportation is without authority.     Hence this writ petition<\/p>\n<p>seeking a direction for release of the lorry along with the goods.<\/p>\n<p>            2. Learned Government Pleader, on instructions,<\/p>\n<p>submits that the vehicle along with the goods have been<\/p>\n<p>produced before the District Collector and infraction of the<\/p>\n<p>Rationing Order and Essential Commodities Act is suspected.<\/p>\n<p>            3. I heard learned counsel for the petitioner and<\/p>\n<p>the learned Government Pleader.\n<\/p>\n<p>W.P.(C).14011 of 2009<\/p>\n<p>                               :: 2 ::\n<\/p>\n<p>             4. The District Collector is competent to take a<\/p>\n<p>decision on the release of goods and the vehicle. The District<\/p>\n<p>Collector is empowered under Section 6 A of the Essential<\/p>\n<p>Commodities Act to take a decision.\n<\/p>\n<p>             5. In the result, if the petitioner moves the 2nd<\/p>\n<p>respondent District Collector, he shall consider the petitioner&#8217;s<\/p>\n<p>request for release of the goods as also the vehicle, within one<\/p>\n<p>month from the date of receipt of a copy of this judgment.<\/p>\n<p>Before taking a decision by the District Collector, he shall give an<\/p>\n<p>opportunity to the petitioner to show cause.
