SRINIVASAN\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This appeal  is directed  against the  judgment of\t the<br \/>\nCentral Administrative\tTribunal, Principal Bench, New Delhi<br \/>\ndated 13.11.1992. By the impugned judgment, the Tribunal had<br \/>\ncalled upon  the appellants  to consider  the  case  of\t the<br \/>\nrespondents, who  admittedly possessed\tthe qualification of<br \/>\nVaidya Visharad\t from Hindi  Sahitya Sammelan, Allahabad for<br \/>\nthe post  of Pharmacist after relaxing the qualification and<br \/>\nexperience for the post whenever any future vacancy arises.\n<\/p>\n<p>     Mrs. Amreshwari,  the learned  senior counsel  for\t the<br \/>\nappellants contends  that a  Vaidya Visharad  recognised  by<br \/>\nHindi  Sahitya\t Sammelan  is  not  one\t of  the  recognised<br \/>\nqualifications for  the post  of Pharmacist  and the minimum<br \/>\nqualification for  a post  cannot be relaxed and, therefore,<br \/>\nTribunal was  in error\tin directing to consider the case of<br \/>\nthe  respondents  on  relaxation  of  the  qualification  in<br \/>\nquestion. Learned  counsel for the respondents, on the other<br \/>\nhand, contended\t that the  degree of Vaidya Visharad awarded<br \/>\nby  Hindi   Sahitya  Sammelan,\t Allahabad   is\t  recognised<br \/>\nqualification under  the Central  Government  Health  Scheme<br \/>\nDelhi (Group  C) Ayurvedic, Recruitment Rules, 1978. In view<br \/>\nof the\trival stand  taken by the parties, the only question<br \/>\nthat arises  for consideration\tis  whether  the  degree  of<br \/>\nVaidya\tVisharad   awarded     by  Hindi  Sahitya  Sammelan,<br \/>\nAllahabad can  be held\tto be  a recognised    qualification<br \/>\nunder  the   Recruitment  Rules.  Looking  to  the  Schedule<br \/>\nattached to the Rules which prescribed the qualification, it<br \/>\nis apparent that it is `Vaidya Visharad&#8217; which is awarded by<br \/>\nAll India  Ayurvedic Congress  is recognised  and it is only<br \/>\nAyurved Ratna  which is\t awarded by  Hindi Sahitya  Sammelan<br \/>\nwhich\tis  recognised.\t Therefore,  the  degree  of  Vaidya<br \/>\nVisharad  awarded   by\tHindi  Sahitya\tSammelan,  which  is<br \/>\npossessed  by  the  respondents\t cannot\t be  held  to  be  a<br \/>\nrecognised qualification under the Recruitment Rules. It may<br \/>\nbe stated  that in  the application before the Tribunal, the<br \/>\nrespondents have  categorically asserted that they possessed<br \/>\nthe qualification  of Vaidya  Visharad recognised  by  Hindi<br \/>\nSahitya Sammelan.  In that  view of the matter, the Tribunal<br \/>\nwas wholly  in error  in directing consideration of the case<br \/>\nof the\trespondents in\tcase of\t future vacancies  against a<br \/>\npost of\t Pharmacist. The  respondents  do  not\tpossess\t the<br \/>\nrequisite qualification\t under the  Recruitment Rules.\tThey<br \/>\ncannot have  any right of appointment.
