C No.1895 of 2009\n          ------------------------------------------------\n          Dated this the 19th day of January, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>    Petitioner       is       the       sole         defendant  in<\/p>\n<p>O.S.No.67\/08 on the file of the Munsiff&#8217;s<\/p>\n<p>Court, Kannur and the respondent is the sole<\/p>\n<p>plaintiff in the said suit. The respondent<\/p>\n<p>alleged that he has got a right to use the<\/p>\n<p>plaint  schedule        property            for        ingress and<\/p>\n<p>egress to his property and building and filed<\/p>\n<p>the  said  suit       for       a    decree          of   permanent<\/p>\n<p>prohibitory      injunction                 restraining        the<\/p>\n<p>defendant from locking the iron gate installed<\/p>\n<p>at the south western corner of the scheduled<\/p>\n<p>property and from making any construction so<\/p>\n<p>as to obstruct or reduce the width and length<\/p>\n<p>of  plaint  &#8216;C&#8217;        schedule            pathway        and  from<\/p>\n<p>preventing  the       plaintiff            to      take    vehicles<\/p>\n<p>through  plaint        &#8216;C&#8217;        schedule            pathway  and<\/p>\n<p>directing the defendant to remove the block<\/p>\n<p><span class=\"hidden_text\">W. P. C No.1895 of 2009           -2-<\/span><\/p>\n<p>        created by him at the south western corner of<\/p>\n<p>        plaint       &#8216;C&#8217;  schedule property  and  to  open<\/p>\n<p>        plaint       &#8216;C&#8217;  schedule pathway  for  vehicular<\/p>\n<p>        traffic. Petitioner\/defendant filed Exhibit P2<\/p>\n<p>        written        statement   resisting   the   suit.<\/p>\n<p>        Respondent\/plaintiff         filed   Exhibit    P3<\/p>\n<p>        affidavit along with an application seeking<\/p>\n<p>        for     a     mandatory  inunction  directing the<\/p>\n<p>        petitioner\/defendant to demolish and remove<\/p>\n<p>        the obstructions and the iron gate at the<\/p>\n<p>        south western corner of the schedule property<\/p>\n<p>        so as to make plaint &#8216;C&#8217; schedule pathway<\/p>\n<p>        convenient       for  vehicular   traffic and  on<\/p>\n<p>        failure to depute a court Amin to execute the<\/p>\n<p>        order. Petitioner\/defendant filed Exhibit P4<\/p>\n<p>        counter and objected to the grant of mandatory<\/p>\n<p>        injunction prayed for.\n<\/p>\n<p>               2. I.A.453\/08 filed by the respondent\/<\/p>\n<p>        plaintiff for injunction and I.A.454\/08 filed<\/p>\n<p><span class=\"hidden_text\">W. P. C No.1895 of 2009            -3-<\/span><\/p>\n<p>        by    the      respondent\/plaintiff  for  mandatory<\/p>\n<p>        injunction were disposed of by the court below<\/p>\n<p>        vide        Ext.P5    common    order   dt.04\/03\/08<\/p>\n<p>        dismissing I.A.453\/08 and allowing I.A.454\/08<\/p>\n<p>        directing the petitioner\/defendant to remove<\/p>\n<p>        the gate installed on the western side of &#8216;C&#8217;<\/p>\n<p>        schedule way within three days so as to enable<\/p>\n<p>        the respondent\/plaintiff and his tenants to<\/p>\n<p>        use the &#8216;C&#8217; schedule way and ordering that<\/p>\n<p>        Ext.C2 shall form part of the order. The said<\/p>\n<p>        Ext.C2 is stated to be Ext.P13 produced by the<\/p>\n<p>        petitioner. The petitioner filed C.M.A.31\/08<\/p>\n<p>        assailing        the   said   mandatory  order  of<\/p>\n<p>        injunction and the said appeal was dismissed<\/p>\n<p>        by    the     first  appellate  court  vide  Ext.P8<\/p>\n<p>        judgment in the said C.M.A.31\/08 dt.14\/10\/08.<\/p>\n<p>        It    is     assailing  the   said Ext.P8  judgment<\/p>\n<p>        confirming Ext.P5 order passed by the trial<\/p>\n<p>        court that this Writ Petition is filed.<\/p>\n<p><span class=\"hidden_text\">W. P. C No.1895 of 2009         -4-<\/span><\/p>\n<p>               3. Arguments of counsel on both sides<\/p>\n<p>        were heard at length. The direction of the<\/p>\n<p>        court below was to remove the gate installed<\/p>\n<p>        on the western side of the &#8216;C&#8217; schedule way.<\/p>\n<p>        Counsel for the petitioner\/defendant submits<\/p>\n<p>        that      if   the gate is removed the  entire<\/p>\n<p>        property will be left open even during night<\/p>\n<p>        time and that it will render insecurity and<\/p>\n<p>        therefore, he may be allowed to keep the gate<\/p>\n<p>        locked between 9.00 p.m. and 7.00 a.m. and<\/p>\n<p>        that to that extent the direction to remove<\/p>\n<p>        the gate so installed may be modified. I am of<\/p>\n<p>        the view that the purpose will be served by<\/p>\n<p>        making a modification in Ext.P5 order to that<\/p>\n<p>        much extent till disposal of the court by the<\/p>\n<p>        court below.\n<\/p>\n<p>               4. In the result, I order that the gate<\/p>\n<p>        on the western side of &#8216;C&#8217; schedule pathway<\/p>\n<p>        directed to be removed by Ext.P5 order and<\/p>\n<p><span class=\"hidden_text\">W. P. C No.1895 of 2009          -5-<\/span><\/p>\n<p>        confirmed       by Ext.P8  judgment shall stand<\/p>\n<p>        modified to the extent that the gate need not<\/p>\n<p>        be removed, but shall be kept open between<\/p>\n<p>        7.00 a.m and 9.00 p.m until disposal of the<\/p>\n<p>        suit by the court below.\n<\/p>\n<p>               5. Counsel for the respondent submits<\/p>\n<p>        that even after the said time there may be<\/p>\n<p>        necessity for himself and his tenants to have<\/p>\n<p>        the gate opened and therefore, key may be<\/p>\n<p>        ordered to be provided to all of them. The<\/p>\n<p>        respondent himself shall provide a lock to the<\/p>\n<p>        gate with one key furnished to the appellant<\/p>\n<p>        and he can serve necessary duplicate keys to<\/p>\n<p>        his tenants as he pleases. If he does not do<\/p>\n<p>        so in another two days, the petitioner is<\/p>\n<p>        allowed to use his own lock and furnish one<\/p>\n<p>        key to the respondent and the respondent may<\/p>\n<p>        have the key duplicated so as to give the<\/p>\n<p>        necessary duplicated keys to his tenants. This<\/p>\n<p><span class=\"hidden_text\">W. P. C No.1895 of 2009       -6-<\/span><\/p>\n<p>        direction shall remain in force till disposal<\/p>\n<p>        of the suit by the court below.\n<\/p>\n<p>               6.
