It was seen from the record that the appellant had<br \/>\npractically failed in even pursuing the litigation properly while the<br \/>\nrespondent is stated to have remained unemployed all throughout. It<br \/>\nwas, in that context, submitted by learned A.G.P. Ms.Punani that it<br \/>\nwas not possible that the respondent would have survived without any<br \/>\neconomic activity and, therefore, the award of back wages was<br \/>\nrequired to be suitably modified while maintaining the order to<br \/>\nreinstate the respondent.\n<\/p>\n<p>2.\t\tLearned<br \/>\ncounsel Mr.Mishra submitted that the Court may pass appropriate order<br \/>\nas regards back wages. There being a broad consensus in the above<br \/>\nterms, without entering into merits of the appeal, it was agreed that<br \/>\nthe respondent would be reinstated in service with continuity of<br \/>\nservice, within two weeks, and paid such amount of back wages as may<br \/>\nbe ordered by the Court. Accordingly, it is directed that the<br \/>\nrespondent shall be reinstated within two weeks and paid 45% of back<br \/>\nwages for the period from termination till reinstatement, within a<br \/>\nperiod of two months.\n<\/p>\n<p>\t\tThe<br \/>\nabove order having been based upon the proposal made before the Court<br \/>\nand its acceptance, it is expected that no further litigation would<br \/>\nsurvive and the order as aforesaid shall be complied with in time.<br \/>\nAppeal is accordingly disposed in terms of the above directions and<br \/>\nwith no order as to costs.
