APP (SJ) No.785 of 2009\n                                      UMESH SINGH\n                                           Versus\n                                     STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>4.       20.01.2011            I.A. No. 58 of 2011 is a petition for bail of appellant Umesh<\/p>\n<p>                      Singh who stands convicted under sections 307 of the Indian Penal<\/p>\n<p>                      Code and 27 of the Arms Act.\n<\/p>\n<p>                                 Learned counsel for the appellant submits that in this case<\/p>\n<p>                      there is no repetition of firing and the injury was also simple in nature.<\/p>\n<p>                      Further submission is that the bail prayer of this appellant was earlier<\/p>\n<p>                      rejected by this court vide order dated 17.12.2009 but with liberty to<\/p>\n<p>                      renew his prayer for bail after one year if the appeal is not heard within<\/p>\n<p>                      the period. It is submitted that the period exceeding one year has<\/p>\n<p>                      already elapsed but this appeal has not been listed for hearing nor there<\/p>\n<p>                      is any likelihood of its listing in near future.<\/p>\n<p>                                 In the facts and circumstances of the case, during the<\/p>\n<p>                      pendency of the appeal, the appellant, Umesh singh is admitted to bail<\/p>\n<p>                      on furnishing bail bond of Rs. 10, 000\/- (ten thousand) with two<\/p>\n<p>                      sureties of the like amount each to the satisfaction of Additional<\/p>\n<p>                      Sessions Judge-I, Jehanabad, in Sessions Trial No.339 of 2007\/83 of<\/p>\n<p>                      2007.\n<\/p>\n<p>                                                               (C.
