1.\t\tRule.\n<\/p>\n
Mr. L.B. Dabhi, learned Additional Public Prosecutor waives service
\nof notice of Rule on behalf of the respondent-State of Gujarat.\n<\/p>\n
2.\t\tThis
\napplication has been filed under Section 439 of the Code of Criminal
\nProcedure, 1973, for grant of bail in connection with FIR being
\nI-C.R. No. 30 of 2009, registered at Jamnagar Panchkoshi  B
\nDivision Police Station, for offences punishable under Sections 366,
\n365, 341, 323, 114 and 34 of the Indian Penal Code.\n<\/p>\n
3.\t\tThe
\nallegation contained in the FIR is that five unknown persons abducted
\nthe fiance of the complainant, while they were coming back to
\nJamnagar from Reliance Mall. It is alleged that  the applicant is
\ninvolved in the commission of the above mentioned offences.\n<\/p>\n
4.\t\tMr.\n<\/p>\n
P.M. Thakkar, learned Sr. Counsel for the applicant has submitted
\nthat the applicant is innocent and he has been falsely implicated in
\nthe commission of the alleged offence. That, no role is attributed to
\nthe applicant in the FIR and, in fact, the applicant is not connected
\nwith the offences mentioned above.  That, the applicant is not
\nidentified, as being one of the five accused persons, involved in the
\ncommission of the alleged offence.  That, in fact, the story narrated
\nin the FIR is not correct and the fact is that the fiance of the
\ncomplainant wanted to marry one Girish, who happened to be closely
\nrelated to her, and, therefore, she had gone with the accused persons
\nvoluntarily. That, as per the case of the prosecution, the fiance of
\nthe complainant was taken to Vadodara from Jamnagar and then to
\nMumbai, and from Mumbai, she came to Rajkot by plane and was
\napprehended at Rajkot, air port. The aforesaid fact itself, clearly
\nshows that she had not been forcibly abducted, as she could have
\nraised a hue and cry, had that been the case and, therefore, the
\napplication for bail may be favorably considered.\n<\/p>\n
5.\t\tMr.\n<\/p>\n
L.B. Dabhi, learned APP on behalf of the respondent-State has
\nstrongly opposed the grant of bail to the applicant.\n<\/p>\n
6.\t\tI
\nhave considered the submissions made by the learned Counsel for the
\nrespective parties, and perused the contents of the FIR as well as
\nother material on record. From a perusal thereof, prima facie, it
\ntranspires that the involvement of the applicant, in the commission
\nof the alleged offence, is not clearly borne out. It cannot be lost
\nsight that the fiance of the complainant went from Jamnagar to
\nVadodara, Mumbai and Rajkot, with one of the accused persons.  Prima
\nfacie, it does not appear that she was forcibly taken away by the
\naccused persons. Considering the totality of the facts
\nand circumstances of the case, the manner in which the offence is
\nalleged to have taken place, the material on record and the nature
\nand gravity of offence and as the role attributed to the applicant is
\nnot clearly borne out from the record, the application deserves to be
\nallowed.\n<\/p>\n
7.\t\tFor
\nthe reasons stated above, the
\napplication is allowed. The applicant is ordered to be released on
\nbail in connection with FIR being I-C.R. No. 30 of 2009 registered
\nwith Jamnagar Panchkoshi  B  Division Police Station, on his
\nexecuting a personal bond to the tune of Rs.10,000\/- (Rupees Ten
\nThousand Only), with one solvent surety of the like amount to the
\nsatisfaction of the trial Court and subject to the conditions that
\nthe applicant:\n<\/p>\n
\ta)\tshall
\n\tnot take undue advantage of his \tliberty or abuse his liberty in any
\n\t\tmanner;\n<\/p>\n
\tb)\tshall
\n\tnot act in a manner injurious to \tthe \tinterest of the prosecution
\n\tor \ttamper with \tevidence or intimidate \twitnesses;\n<\/p>\n
\tc)
\n\t \tshall maintain law and order and shall \tcooperate fully with the
\n\tinvestigating \tofficers and shall make himself \tavailable \tfor
\n\tinvestigation, as and \twhenever directed;\n<\/p>\n
\td)\tshall
\n\tmark his presence before the \tInvestigating Officer of the concerned
\n\t\tPolice Station on the 15th and 30th day of
\n\t\tevery English calendar month, between \t10:00 am to
\n\t5:00 pm, till the\tcommencement of trial;\n<\/p>\n
\te)\tshall
\n\tnot leave the local limits of the \tState of Gujarat without the
\n\tprior \tpermission of the concerned Sessions \tJudge;\n<\/p>\n
\tf)\tshall
\n\tfurnish his residential address \tto \tthe \tInvestigating Officer and
\n\talso to \tthe \tcourt at the time of execution of \tthe \tbond and shall
\n\tnot change his\tresidential \taddress \twithout prior permission of
\n\tthis \tCourt;\n<\/p>\n
\tg)\tshall
\n\tsurrender his Passport, if any, \tto \tthe \tlower Court within a week.\n<\/p>\n
8.\t\tIf
\nthe applicant commits breach of any of the above conditions, the
\nconcerned Sessions Judge will be free to issue warrants or take
\nappropriate action in the matter.\n<\/p>\n
9.\t\tIt
\nis made clear that no observations made by this Court be construed as
\nhaving any bearing on the merits of the case, at the time of the
\ntrial. The trial Court will proceed in accordance with law,
\nunaffected and uninfluenced by any observations contained in this
\norder.\n<\/p>\n
10.\t\tBail
\nbefore the lower Court having jurisdiction to try the case. It would
\nbe open to the trial Court concerned to give time to furnish the
\nsolvency certificate, if prayed for.\n<\/p>\n
11.\t\tRule
\nis made absolute. Direct Service is permitted.\n<\/p>\n
