THE STATE OF BIHAR\n                              ************\n<\/pre>\n<p>3    21\/06\/2011             Heard Counsel for the petitioner and the A.P.P.<\/p>\n<p>                  appearing on behalf of the State.\n<\/p>\n<p>                            The main question that has been raised in this<\/p>\n<p>                  application is that the petitioner was remanded in the<\/p>\n<p>                  present case only in the month of November, 2006<\/p>\n<p>                  whereas the order to supply police papers was issued on<\/p>\n<p>                  07.03.1990.\n<\/p>\n<p>                            One witness has been examined in this case.<\/p>\n<p>                  The main contention on behalf of the petitioner is,<\/p>\n<p>                  therefore, that the petitioner could not have been asked<\/p>\n<p>                  to face trial without him being personally present before<\/p>\n<p>                  the Court, without being supply of police papers as<\/p>\n<p>                  required under Section 207, 208 and 209 of the Code of<\/p>\n<p>                  Criminal Procedure.\n<\/p>\n<p>                            As such, I direct that the police papers should<\/p>\n<p>                  be supplied to the petitioner and charges be framed<\/p>\n<p>                  against the petitioner and thereafter PW 1 should be<\/p>\n<p>                  recalled to lead his evidence.\n<\/p>\n<p>                            The entire procedure should be completed<\/p>\n<p>                  within a period of four months from the date of receipt of<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        the L.C.R.\n<\/p>\n<p>                  The Office is directed to send the L.C.R.<\/p>\n<p>        through the Special Messenger within a period of ten<\/p>\n<p>        days from today.\n<\/p>\n<p>                  The Court below is directed to expedite the trial<\/p>\n<p>        of Sessions Trial No. 121 (B) of 1990.<\/p>\n<p>                  The matter should be brought to the notice of<\/p>\n<p>        the Sessions Judge, Lakhisarai so that he may allot this<\/p>\n<p>        case to the appropriate Court for the purpose of<\/p>\n<p>        expediting the trial at the earliest.<\/p>\n<p>                  This   application   is   allowed   to   the   extent<\/p>\n<p>        indicated aforesaid.\n<\/p>\n<\/p>\n<pre>Anand                                           ( Sheema Ali Khan, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Yogi Singh vs State Of Bihar on 21 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
