RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.4715 of 2009-J\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n     Dated this the 25th day of February, 2009.\n\n                     JUDGMENT\n<\/pre>\n<p> The petitioner availed a loan for a business<\/p>\n<p> purpose and is facing action under the SARFAESI<\/p>\n<p> Act on account of failure to repay. Though the<\/p>\n<p> petitioner holds out Ext.P1 saying that he had<\/p>\n<p> been sick some time in 2004, even the loan was<\/p>\n<p> availed only in 2004 February. With the passage<\/p>\n<p> of time, the amount accrued is more than Rs.33<\/p>\n<p> lakhs. It may not be feasible for this Court to<\/p>\n<p> issue any direction to regularize the transaction<\/p>\n<p> on repayment of amounts. The action taken by the<\/p>\n<p> bank is essentially a measure falling within<\/p>\n<p> Section 13(4) and therefore, the petitioner will<\/p>\n<p> have adequate remedy by recourse to Section 17 of<\/p>\n<p> the SARFAESI Act. The writ petition is dismissed<\/p>\n<p> without prejudice to such course.<\/p>\n<p>                      THOTTATHIL B.
