It was alleged that<br \/>\n\ton 29-8-2002 at 4 p.m., when the applicant went to accused Nos.1 and<br \/>\n\t2 for tea and bidi, the accused asked to pay the old dues. Since he<br \/>\n\ttold to pay after some days, the accused beat and abused the<br \/>\n\tapplicant telling about his caste causing  injuries to the<br \/>\n\tapplicant. A complaint was therefore lodged before Jamnagar Police<br \/>\n\tStation. At the end of investigation, police filed charge sheet<br \/>\n\tagainst the accused. The case was numbered as Special Case No.5 of<br \/>\n\t2003 before the learned J.M.F.C., Jamangar and it was committed to<br \/>\n\tthe Court of Special Judge, Jamnagar. At the end of trial, learned<br \/>\n\tSpecial Judge vide impugned judgment and order acquitted the<br \/>\n\taccused. Hence, the present revision by the applicant-original<br \/>\n\tcomplainant.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mrs.Krishna G.Rawal for the applicant, learned<br \/>\n\tAPP, Mr.L.R.Pujari for the respondent No.1-State and learned<br \/>\n\tadvocate, Mr.Premal S.Rachh for the respondent No.2 to 3-original<br \/>\n\taccused. This Court has gone through the judgment and order of<br \/>\n\tacquittal passed by the learned<br \/>\n\tSpecial Judge.\n<\/p>\n<p>It<br \/>\n\tis submitted by learned advocate, Mrs.Krishna Rawal for the<br \/>\n\tapplicant-original complainant that applicant is a poor person<br \/>\n\tcoming from backward class of the community and hence, he was under<br \/>\n\tfear, complaint could not be lodged in time.  It is further<br \/>\n\tsubmitted that the learned Special Judge has not considered the<br \/>\n\tmedical treatment taken by the complainant. It is also submitted<br \/>\n\tthat the court below has wrongly interpreted the provisions of<br \/>\n\tAtrocity Act. Though the case against the accused has been proved<br \/>\n\tbeyond reasonable doubt, learned Special Judge has committed error<br \/>\n\tin acquitting the accused persons.\n<\/p>\n<p>It<br \/>\n\tis however submitted by learned advocate, Mr.Premal S.Rachh<br \/>\n\tthat trial court has discussed the medical evidence in great<br \/>\n\tdetail. It was also held by the learned Special Judge that<br \/>\n\tinvestigation has been carried out below the rank of Dy.S.P. which<br \/>\n\tis against the mandatory provisions and hence, the accused is<br \/>\n\tentitled to get order of acquittal. In view of the above, it is<br \/>\n\tstated that this revision be dismissed.\n<\/p>\n<p>It<br \/>\n\tappears from the impugned judgment that prosecution has failed to<br \/>\n\tprove the charges against the accused beyond reasonable doubt. As<br \/>\n\tregards the explanation given by the learned advocate for the<br \/>\n\tapplicant for late lodging of FIR is concerned, nothing has come out<br \/>\n\tfrom the evidence to show that  because of fear or threat of accused<br \/>\n\tpersons as they are alleged to be head strong persons, he could not<br \/>\n\tfile the complaint  in time. Apart from that, the learned Special<br \/>\n\tJudge has discussed the medical evidence in great detail and came to<br \/>\n\tthe conclusion that case could not be proved by the prosecution<br \/>\n\tbeyond reasonable doubt and hence, the accused were rightly<br \/>\n\tacquitted by the learned Special Court.\n<\/p>\n<p>It<br \/>\n\tappears that investigation has been carried out under the<br \/>\n\tsupervision of DY.S.P. and hence, from any stretch of imagination,<br \/>\n\tit could not be said that investigation was carried out by an<br \/>\n\tofficer below the rank of Dy.S.P. Even if it is believed that<br \/>\n\tinvestigation is carried out by the competent authority who has<br \/>\n\tauthority to carry out the investigation, then also, as discussed<br \/>\n\tabove, the prosecution has failed to prove its case beyond<br \/>\n\treasonable doubt and hence, this revision requires to be dismissed.\n<\/p>\n<p>This<br \/>\n\tCourt has gone through the judgment delivered by the Sessions Court.<br \/>\n\tNo plausible explanation has been given by the complainant for<br \/>\n\tlodging the complaint late by five days. Before the doctor in the<br \/>\n\thospital, it is stated by the complainant that unknown person caused<br \/>\n\tinjuries. Prima facie it seems that complaint is an after thought as<br \/>\n\tcomplaint was lodged after five days. It is not the case of the<br \/>\n\tprosecution that the complainant was not knowing the accused persons<br \/>\n\twhen the incident took place as they are residing in the same<br \/>\n\tVillage and they are knowing   each other since long. Therefore, the<br \/>\n\tcomplainant could have disclosed the name of accused person before<br \/>\n\tthe doctor when he went for taking treatment. No doubt, it is not a<br \/>\n\tlaw that name of the accused should be disclosed before the doctor.<br \/>\n\tHowever, in this case, it is very well disclosed before the doctor<br \/>\n\tthat assault by is caused by unknown persons. This is very<br \/>\n\tsignificance as complaint was lodged after five days. Learned<br \/>\n\tSessions Judge has discussed the entire evidence in great detail<br \/>\n\tand thereafter came to the conclusion that prosecution failed to<br \/>\n\tprove the case beyond reasonable doubt. Even if two views are<br \/>\n\tpossible, then also, if the view taken by the learned Sessions Judge<br \/>\n\tis probable, then also, in revision, this Court has limited power to<br \/>\n\tinterfere with the findings of the Sessions Court.\n<\/p>\n<p>In<br \/>\n\tthis connection, reliance is made by this Court on a decision of the<br \/>\n\tApex Court reported in (2010)2 Supreme Court Cases page 190 in<br \/>\n\tthe case of Sheetala Prasad and Others Vs. Sri Kant and<br \/>\n\tanother wherein it has been held para 12 as under:\n<\/p>\n<p>&#8220;12.\n<\/p>\n<p>\tThe High Court was exercising the revisional jurisdiction at the<br \/>\n\tinstance of a private complainant and, therefore, it is necessary to<br \/>\n\tnotice the principles on which such revisional jurisdiction can be<br \/>\n\texercised. Sub-section (3) of Section 401 of Code of Criminal<br \/>\n\tProcedure prohibits conversion of a finding of acquittal into one of<br \/>\n\tconviction. Without making the categories exhaustive, revisional<br \/>\n\tjurisdiction can be exercised by the High Court at the instance of<br \/>\n\tprivate complainant-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>\twhere the trial Court has wrongly shut out evidence which the<br \/>\n\tprosecution wished to produce, <\/p>\n<p><span class=\"hidden_text\">(2)<\/span><br \/>\n\twhere the admissible evidence is wrongly brushed aside as<br \/>\n\tinadmissible, <\/p>\n<p><span class=\"hidden_text\">(3)<\/span><br \/>\n\twhere the trial Court has no jurisdiction to try the case and has<br \/>\n\tstill acquitted the accused, <\/p>\n<p><span class=\"hidden_text\">(4)<\/span><br \/>\n\twhere the material evidence has been overlooked either by the trial<br \/>\n\tCourt or the appellate Court or the order is passed by considering<br \/>\n\tirrelevant evidence and <\/p>\n<p><span class=\"hidden_text\">(5)<\/span><br \/>\n\twhere the acquittal is based on the compounding of the offence which<br \/>\n\tis invalid under the law.&#8221;\n<\/p>\n<p>In<br \/>\n\tview of the principles laid down as aforesaid,  since the case of<br \/>\n\tthe applicant- original complainant, is not falling in any of the<br \/>\n\tfive categories carved out by the Hon&#8217;ble Apex Court in the above<br \/>\n\treported judgment, this revision<br \/>\n\trequires to be dismissed.\n<\/p>\n<p>Thus,<br \/>\n\tthis revision is dismissed. Rule is discharged.
