Justice K.M.JOSEPH\n\n Dated :01\/04\/2008\n\n O R D E R\n                          H.L.Dattu,C.J. &amp; K.M.Joseph,J.\n                      ---------------------------------------------------\n                      Cont.Case (C).No.1163 of 2007-S\n                      ----------------------------------------------------\n                       Dated, this the 1st day of April, 2008.\n\n                                       JUDGMENT\n<\/pre>\n<p>H.L.Dattu,C.J.\n<\/p>\n<p>               The one and only direction that was issued by this Court while<\/p>\n<p>disposing of O.P.No.14855 of 2002 dated 21\/10\/2005 is to consider and dispose<\/p>\n<p>of the grievance made out by the petitioner in Exhibit P11 notice\/representation.<\/p>\n<p>               (2)   After the disposal of the writ petition, the respondents have<\/p>\n<p>passed an order dated 22.11.2006. In that, after considering the request made<\/p>\n<p>by the petitioner in Exhibit P11 notice, they have rejected the same.<\/p>\n<p>               (3) In our opinion, if the petitioner is aggrieved by the aforesaid<\/p>\n<p>order, he has to question the same before the appropriate forum.<\/p>\n<p>               (4) In that view of the matter, we are of the opinion that there is<\/p>\n<p>neither deliberate nor wilful disobedience of the orders passed by this Court.<\/p>\n<p>Therefore, we do not intend to take cognizance of this contempt petition.<\/p>\n<p>Accordingly, the proceedings requires to be dropped and it is dropped.<\/p>\n<p>               (5) However, liberty is reserved to the complainant\/petitioner, if he<\/p>\n<p>so desires, to question the correctness or otherwise of the orders passed by the<\/p>\n<p>respondents dated 22.11.2006 before the appropriate forum in appropriate<\/p>\n<p>proceedings.\n<\/p>\n<p>               Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                                                     H.L.Dattu<br \/>\n                                                                  Chief Justice<\/p>\n<p>                                                                   K.M.Joseph<br \/>\n                                                                       Judge<br \/>\nvku\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.Ramachandran vs Dr.M.K.Ramachandran Nair on 1 April, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Con Case(C) No. 1163 of 2007(S) 1.
