{"id":86926,"date":"2009-05-08T00:00:00","date_gmt":"2009-05-07T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-paras-nath-singh-vs-freedom-fighters-division-on-8-may-2009-2"},"modified":"2019-01-07T20:21:40","modified_gmt":"2019-01-07T14:51:40","slug":"shri-paras-nath-singh-vs-freedom-fighters-division-on-8-may-2009-2","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-paras-nath-singh-vs-freedom-fighters-division-on-8-may-2009-2","title":{"rendered":"Shri Paras Nath Singh vs Freedom Fighters\u2019 Division, &#8230; on 8 May, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Paras Nath Singh vs Freedom Fighters\u2019 Division, &#8230; on 8 May, 2009<\/div>\n<pre>                  CENTRAL INFORMATION COMMISSION\n                        Complaint No.- CIC\/WB\/C\/2007\/00645\n                     Right to Information Act- Section 18 (1) (b)\n\nComplainant:          Shri Paras Nath Singh\nRespondent:           Freedom Fighters' Division, Ministry of Home Affairs, (MHA)\n\n\nFacts<\/pre>\n<p>:\n<\/p>\n<p>         The Commission has received a complaint from Shri Paras Nath Singh of<br \/>\nAzamgarh, Uttar Pradesh that his request under RTI Act, 2005 seeking<br \/>\ninformation on award of freedom fighters pension to one Shri Mewa Lal Gosai of<br \/>\nAzamgarh submitted to Central Public Information Officer, Freedom Fighters&#8217;<br \/>\nDivision, Ministry of Home Affairs, New Delhi has not been responded to, even<br \/>\nthough the same was duly submitted along with the requisite fee dated 03-05-<br \/>\n2007.\n<\/p>\n<p>         Admitting the Complaint of Shri Paras Nath Singh under Section 18 (1) (b)<br \/>\nof RTI Act, 2005 the Commission issued a notice to the CPIO for furnishing<br \/>\ncomments on his complaint. In response, Joint Secretary Shri Ajay Goyal of the<br \/>\nNorth Zone Section of Freedom Fighters Division MHA submitted his comments<br \/>\ndated 27 February, 2009 with a copy endorsed to complainant Shri Paras Nath<br \/>\nSingh. This response, while supplying a copy of the guidelines governing<br \/>\nsanction of the Pension to freedom fighters, seeks further details of the pension<br \/>\nawarded to Shri Gosai to enable the MHA to offer a response<\/p>\n<p>                                 Decision Notice<\/p>\n<p>         The comments submitted by the JS (Home) fail to mention when the<br \/>\nrequest of Shri Paras Nath Singh was received by the CPIO MHA and<br \/>\nwhether it was responded to. This gives us reason to believe that the<br \/>\nrequest of Shri Singh has not been responded to by the CPIO within the<\/p>\n<p><span class=\"hidden_text\">                                         1<\/span><br \/>\n time limit of 30 days from that date of its receipt mandated under sub-Sec.<br \/>\n(1) of Sec 7 of the RTI Act, 2005. CPIO, Freedom Fighters Division,<br \/>\nMinistry of Home Affairs, New Delhi is therefore directed to show cause as<br \/>\nwhy he should not be held liable for a penalty of Rs. 250\/- per day from the<br \/>\ndate when the information fell due i.e. 03-06-2007 to the date when the<br \/>\ninformation was actually supplied, which is possibly the date of the endorsement<br \/>\nof 27 Feb of the response to the appeal notice described above, not exceeding<br \/>\nRs. 25,000\/- under Section 20(1) of the RTI Act. The CPIO will submit his\/her<br \/>\nwritten submission to this Commission on or before 19-05-2009.\n<\/p>\n<p>       Further, Shri Paras Nath Singh is advised to provide the details of the<br \/>\ninformation sought to the CPIO and the CPIO directed to respond to the request<br \/>\nappropriately within ten working days of its receipt. If the information so provided<br \/>\nby the CPIO does not satisfy complainant Shri Paras Nath Singh he may file an<br \/>\nappeal to the First Appellate Authority of the Freedom Fighters Division of MHA.<br \/>\nIf still not satisfied with the information provided on his 1st appeal Shri Paras Nath<br \/>\nSingh will be free to move a 2nd appeal before us as per sub-section (3) of Sec<br \/>\n19 of the Act.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.\n<\/p>\n<p>Wajahat Habibullah<br \/>\n(Chief Information Commissioner)<br \/>\n08-05-2009<\/p>\n<p>Authenticated true copy, additional copies of order shall be supplied against<br \/>\napplication and payment of the charge prescribed under the Act to the CPIO of<br \/>\nthis Commission.\n<\/p>\n<p>Pankaj K.
