KRISHNAN, J.\n                    ...........................................\n                       F.A.O.No.188 OF 2008\n                   .............................................\n           Dated this the 25th day of November, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>       This is an appeal preferred against the order of the<\/p>\n<p>District Judge, Ernakulam in O.P.No.305\/2008. The original<\/p>\n<p>petition was      filed under Section 92 of the C.P.C for<\/p>\n<p>permission to institute a suit for the removal of the trustees<\/p>\n<p>in respect of a trust and for vesting of the properties of the<\/p>\n<p>trust in the new trust etc. The learned District Judge after<\/p>\n<p>exhaustive consideration held that the petitioners are not<\/p>\n<p>entitled to get leave of the court under Section 92 of the<\/p>\n<p>C.P.C and therefore dismissed the petition. It is against that<\/p>\n<p>decision, the petitioners have come up with this appeal.<\/p>\n<p>      2. The name of the institution is Cochin Islamic Welfare<\/p>\n<p>Trust. There was a parallel proceeding before the Wakf<\/p>\n<p>Board constituted under the Wakf Act and the Wakf Board<\/p>\n<p>by its ordered dated 11.11.2009 held as follows:<\/p>\n<blockquote><p>        In the circumstances, the Board comes to<br \/>\n       the definite finding that the first party namely<br \/>\n       Mr. Hashim Haji in his                    capacity        as the<br \/>\n       Chairman of the Cochin Islamic Welfare Trust<br \/>\n       is the Mutawalli of the Wakf in dispute.                    The<br \/>\n       office is directed to take all steps to register<br \/>\n       an extent of 15.716 cents of land comprised in<\/p>\n<p><span class=\"hidden_text\">                                : 2 :<\/span><br \/>\nF.A.O.No.188 OF 2008<\/p>\n<p>       Sy.Nos.64\/1 and 611\/02 of Ernakulam village<br \/>\n       and    the     structures,    buildings and other<br \/>\n       improvements including the Masjid         situated<br \/>\n       in the said property as a Wakf under the Wakf<br \/>\n       Board in the name of Mr. Hashim Haji, the<br \/>\n       party herein in his capacity      as the Chairman<br \/>\n       of the Cochin Islamic Welfare Trust Pullepady,<br \/>\n       Ernakulam.        The office is also directed to<br \/>\n       complete the process of registration        of the<br \/>\n       Wakf within a period of one month from the<br \/>\n       date of this order&#8221;.<\/p><\/blockquote>\n<p>      3. So, the competent statutory authority has entered<\/p>\n<p>into   a definite    finding  to the effect that    the property<\/p>\n<p>covered by the trust is a Wakf property to be governed<\/p>\n<p>under the provisions of the Wakf Act. The Wakf Act is a self<\/p>\n<p>governed Act which provides remedy for the persons who<\/p>\n<p>are aggrieved with respect         to the management etc of the<\/p>\n<p>Wakf as contemplated therein. So in the light of the finding<\/p>\n<p>that it is a Wakf property, the jurisdiction also vests with the<\/p>\n<p>Wakf Tribunal constituted under the Act          to consider the<\/p>\n<p>grievance, if it is in accordance with law.<\/p>\n<p>      4. Therefore, a civil suit to be filed under Section 92 of<\/p>\n<p>the CPC as a public trust does not survive for consideration<\/p>\n<p>at this stage in the light of the backdrop of the order of the<\/p>\n<p>Wakf Board. On that ground I hold that the original petition<\/p>\n<p><span class=\"hidden_text\">                             : 3 :<\/span><br \/>\nF.A.O.No.188 OF 2008<\/p>\n<p>need not be entertained and dismissal of the original petition<\/p>\n<p>by the learned District Judge is confirmed on other grounds<\/p>\n<p>as mentioned above. Therefore, the FAO is dismissed. I make<\/p>\n<p>it clear that any person aggrieved by the order of the Wakf<\/p>\n<p>Board is at   liberty to challenge it in the forum which is<\/p>\n<p>contemplated and everything will depend upon         the final<\/p>\n<p>outcome of the same. If at any stage the order of the Wakf<\/p>\n<p>Board is vacated, and it becomes the non Wakf property,<\/p>\n<p>the person aggrieved may again approach the court for<\/p>\n<p>sanction under Section 92 of the CPC and           it may be<\/p>\n<p>considered in accordance with law at that point of time.<\/p>\n<p>     Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                M.N.
