SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\napplication has been preferred by the applicant-original<br \/>\nappellant-original opponent no.5 National Insurance Company for an<br \/>\nappropriate interim relief to stay further implementation and<br \/>\noperation of the judgment and award passed by the learned Motor<br \/>\nAccident Claims Tribunal (Main), Jamnagar dated 30.11.2010 passed in<br \/>\nMACP No.799 of 2007.\n<\/p>\n<p>2.\tHaving heard<br \/>\nShri Mehta, learned advocate for the applicant and Shri Parth Tolia,<br \/>\nlearned advocate appearing on behalf of the original claimant and<br \/>\nconsidering the impugned judgment and award, it appears that the<br \/>\napplicant Insurance Company is liable to pay compensation to the<br \/>\nextent of  25%. It is reported that applicant Insurance Company has<br \/>\ndeposited the amount due and payable under the award with<br \/>\nproportionate cost and interest. It appears that balance 70% amount<br \/>\nwith proportionate cost is required to be deposited \/ paid by the<br \/>\nInsurance Company of Truck involved in the accident and\/ or driver<br \/>\nand owner of truck involved in the accident.\n<\/p>\n<p>3.\tHaving heard<br \/>\nthe learned advocates for the respective parties and to protect the<br \/>\ninterest of the widow, ad-interim relief granted earlier vide order<br \/>\ndated 29.4.2011 is made absolute as interim relief till final<br \/>\ndisposal of the main First Appeal with further modification that Rs.<br \/>\n10,000\/- to be paid to the original claimant nos.1 and 3 each by<br \/>\nAccount Payee Cheque and thereafter rest of the  amount deposited by<br \/>\nthe applicant herein shall be invested by the Tribunal in the name of<br \/>\noriginal claimant Nos. 3 to 6 in Fixed Deposit in any Nationalized<br \/>\nBank initially for a period of five years, which shall be renewed<br \/>\nfrom time to time till final disposal of the present appeal and the<br \/>\noriginal claimant nos. 3 to 6 shall be permitted to withdraw the<br \/>\nperiodical interest on the same. The FDR be retained with the Nazir<br \/>\nof the Tribunal. There shall not be any loan and\/ or advance on the<br \/>\nsaid Fixed Deposit.
