Tripathi vs The State Of Madhya Pradesh on 14 October, 2011<\/div>\n<pre>                                                                   1\n\n\n\n\n                    W.A.No.1008\/11\n\nR.S.Tripathi                                  State of M.P. &amp; others\n\n\n\n\n14.10.2011\n      Shri V.K.Shukla, Counsel for appellant.\n       This appeal is directed against an order dated 9.9.2011\npassed by the learned Single Judge in Writ Petition No.9957\/11\nby which writ petition preferred by the appellant\/petitioner\nassailing the order dated 7.6.2011 transferring the appellant\nfrom the post as Incharge CMO, Nagar Panchayat, Pali to his\nsubstantive post at Dhanpuri, District Anuppur, was dismissed.\n       Learned counsel for appellant submitted:-\n(I)    That, respondent No.3 who has been made Incharge<\/pre>\n<p>CMO at Nagar Panchayat, Pali is facing a departmental enquiry<br \/>\nand charge of embezzlement of more than Rs.5 Lakhs is<br \/>\nagainst him, but spite of this, he has been made Incharge<br \/>\nCMO in place of appellant.\n<\/p>\n<p>(ii)   That, at Dhanpuri, there is no post of Revenue Sub-<br \/>\nInspector where appellant has been posted by the respondents.\n<\/p>\n<p>       Learned Single Judge has considered all these aspects<br \/>\nin the impugned order and found that there was no substance in<br \/>\nthe petition.\n<\/p>\n<p>       So far as first contention of the appellant that there are<br \/>\nallegations against respondent No.3 who has been made<br \/>\nIncharge CMO in place of appellant is concerned, it is for the<br \/>\nrespondent No.1\/2 to look into the matter, but merely on this<br \/>\nground, the transfer order of appellant cannot be interfered. So<br \/>\nfar as second contention of the appellant is concerned, the<br \/>\nappellant may join at the transferred place and in case,<br \/>\nappellant is not paid salary, appellant may submit his<br \/>\nrepresentation to respondent No.1 who shall forthwith see that<br \/>\nthe appellant is paid his salary immediately after joining at<br \/>\nDhanpuri, District Anuppur. Considering peculiar facts of the<br \/>\ncase, we allow an opportunity to the appellant to submit a fresh<br \/>\nrepresentation against the transfer order, but only after joining at<br \/>\n<span class=\"hidden_text\">                                                                      2<\/span><\/p>\n<p>                         W.A.No.1008\/11<\/p>\n<p>     R.S.Tripathi                               State of M.P. &amp; others<\/p>\n<p>     14.10.2011<br \/>\n     Dhanpuri, District Anuppur.
