KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nKHARE J.\n<\/p>\n<p>     The appellant,  who is  a dealer in Ayurvedic herbs and<br \/>\noils, supplied\tayurvedic herds\t to the Government Ayurvedic<br \/>\nCollege, Trivandrum  during the\t assessment  years  1984-85,<br \/>\n1985-86 and 1986-87 and, consequently, filed returns in Form<br \/>\n8 of  Kerala General  Sales Tax Act (hereinafter referred to<br \/>\nas `the\t Act&#8217;), claiming  exemption on\tentire turn-over for<br \/>\nthe aforesaid  three  assessment  years.  The  exemption  so<br \/>\nclaimed was on the basis that ayurvedic herds are taxable at<br \/>\nthe point  of last  purchase in the State by a dealer who is<br \/>\nliable to  pay tax.  The Ayurvedic  College being  the\tlast<br \/>\npurchaser, the appellant obtained valuation certificate from<br \/>\nthe College  for quantity  of herds  purchased by  them\t and<br \/>\nfurnished  the\tsame  before  the  Sales  Tax  Officer.\t The<br \/>\nAdditional Sales  Tax Officer,\tTrivandrum and\tfurther\t two<br \/>\nappellate courts  did not  accept the claim of the appellant<br \/>\nfor  exemption\t of  tax  in  view  of\tthe  fact  that\t the<br \/>\ncertificate produced  by the  appellant was  not in Form-25.<br \/>\nThe Writ  Partition filed  at the  instance of the appellant<br \/>\nagainst the  order of  the Sales  Tax Authorities  was\talso<br \/>\ndismissed by  the  High\t Court\tof  Kerala.  The  Sales\t Tax<br \/>\nAuthorities as\twell as the High Court were of the view sub-<br \/>\nrile (14)  of Rule  32 being mandatory, the appellant is not<br \/>\nentitled to claim any exemption from tax unless he furnishes<br \/>\na certificate  of declaration  in Form-25 from the person to<br \/>\nwhom he\t sold the  goods. This\tview taken by the High Court<br \/>\nhas been  challenged in\t this appeal.  It was urged that the<br \/>\nvaluation certificate  obtained from  the party\t to whom the<br \/>\ngoods  had   been  sold\t  was  substantial   compliance\t  of<br \/>\nrequirement of sub-rule (14) of Rule 32 of the Rules, having<br \/>\nregard to  the fact  that party,  being a  government  body,<br \/>\ncould not fulfil all the requirements of Form-25.\n<\/p>\n<p>     Having heard the matter and perused the record, we find<br \/>\nthe crucial  question that arises in the present appeals is,<br \/>\nas to  whether the  Government Ayurvedic College, Trivandrum<br \/>\ncomes within  the expression&#8221;  State&#8221; occurring\t in  Section<br \/>\n2(viii) of  the Act  which defines  &#8220;dealer&#8221;.  Further,\t the<br \/>\nsecond question\t that arises  for consideration\t is,  as  to<br \/>\nwhether the  certificate issued\t by  the    Govt.  Ayurvedic<br \/>\nCollege substantially satisfied the requirements of sub-rule<br \/>\n(14) of\t Rule 32  and Form-25.\tBut,  these  questions\thave<br \/>\nneither been  dealt with by the Sales Tax Authorities nor by<br \/>\nHigh Court.  Initially, we thought to decide these questions<br \/>\nhere. But,  in the absence of material facts, it is not safe<br \/>\nto  decide   these  questions\tin  this   appeal.  In\tsuch<br \/>\ncircumstances, we  set aside  the order\t and judgment of the<br \/>\nHigh Court  of Kerala dated 3.9.1989 in TRC Nos. 106,107 and<br \/>\n108 of\t1989, send  these cases\t back to  the High Court for<br \/>\ndeciding the  questions referred  to above.
