     ORAL JUDGEMENT<\/p>\n
     1.This Special Civil Application under Article 226
\n     of the Constitution of India has been filed by the
\n     petitioner challenging his detention in pursuance of the
\n     order passed against him     by   Police   Commissioner,
\n Ahmedabad City, on 06th of August, 2004, in exercise of
\npowers conferred upon him under Section 3(1) of the
\nGujarat Prevention of Anti Social Activities Act, 1985
\n(PASA Act for short). The petitioner is under detention
\nas bootlegger from 6th of August, 2004 in pursuance of
\nthe above order.\n<\/p>\n
2.The grounds of detention as placed on record
\nreveal   that   the   detaining   authority   took    into
\nconsideration the fact of filing of solitary crime
\nagainst the petitioner before Prohibition Police Station,
\nWestern Zone, on 03rd of August, 2004, under the Bombay
\nProhibition Act, whereby the petitioner was found in
\npossession of foreign liquor to the extent of 225
\nbottles. The detaining authority took into consideration
\nthoroughly the investigation papers as placed before him
\nand came to the conclusion that the petitioner was
\ndealing in storing, selling and transporting prohibited
\nforeign liquor and     therefore   the   petitioner    was
\nbootlegger within the meaning of the PASA Act. The
\ndetaining authority also came to the conclusion that the
\nactivity of the petitioner was adversely affecting the
\npublic health and maintenance of public order.         The
\ndetaining authority also came to the conclusion that the
\nactivities of the petitioner were required         to   be
\nprevented forthwith and, therefore, after considering
\nother measures which may be taken against the petitioner
\nunder the general law, as a last resort, the detaining
\nauthority passed the detention order of the petitioner
\nwhich is under challenged in this petition.\n<\/p>\n
3.Learned Advocate Ms.Shahin Qureshi      for  the
\npetitioner and learned AGP Mr.H.M. Prachchhak for the
\nrespondents were heard at length. The affidavit-in-reply
\nfiled by the detaining authority as placed on record by
\nlearned AGP is also taken into consideration.\n<\/p>\n
4.Out of various grounds urged on behalf of the
\npetitioner and controverted and opposed by learned AGP,
\nit appears that this petition can be examined and
\ndisposed of on the sole issue that whether there was
\ncredible material placed before the detaining authority
\nto come to the conclusion that by the activities of the
\npetitioner, the public order was disturbed and public
\nhealth was adversely affected.\n<\/p>\n
5.To reach to the subjective satisfaction that
\nbootlegging activities of the petitioner were prejudicial
\nto the maintenance of public order and public health, the
\ndetaining authority must rely upon credible and cogent
\nmaterial that the activities of the petitioner directly
\n or indirectly were causing or were likely to cause any
\nharm, danger or alarm or feeling of insecurity among the
\ngeneral public or any section thereof or a grave or
\nwidespread danger to life, property or the public health.
\nWhile undertaking this exercise, the detaining authority
\nmust draw a clear line between the cases falling within
\nbreach of law and order and breach of public order.\n<\/p>\n
6.The facts of the present case are squarely
\ncovered by a decision of the Apex Court in the matter of
\nDARPAN KUMAR SHARMA vs. STATE OF T.N. , as reported in
\n(2003) 2 SCC 313 while dealing with solitary instance of
\nrobbery as ground for preventive detention, the Apex
\nCourt observed that nothing on record to show that the
\nreach and potentiality of the incident was so great as to
\ndisturb the even tempo or normal life of the community in
\nthe locality or disturb general peace and tranquility or
\ncreate a sense of alarm and insecurity in the locality.
\nSolitary instance of robbery held was not relevant for
\nsustaining the order of detention and such incident
\nhardly be said to disturb public peace or pubic order in
\njeopardy so as to bring the case within the purview of
\npreventive detention.\n<\/p>\n
7.In the present case, the detaining authority has
\ntaken into consideration the investigation papers in
\nsolitary case registered against the petitioner under the
\nBombay Prohibition Act. This case is registered against
\nthe petitioner because as per allegation he was found in
\npossession of prohibited foreign liquor in breach of law.
\nThe petitioner may be tried and may be punished, if found
\nguilty for such breach of law, but the filing of such
\ncase itself has no bearing on the question of maintenance
\nof public order or public health.        Surely, the act
\nconstituting the offence cannot be said to have affected
\nthe even tempo of the life of the community.          The
\nsubjective satisfaction arrived at by the detaining
\nauthority therefore is not valid, legal and according to
\nlaw. The order under challenge is required to be quashed
\nand set aside on this ground alone.\n<\/p>\n
8.In the result,the petition is allowed. The order
\npassed by the Commissioner of Police, Ahmedabad City, on
\n6th of August, 2004, against the petitioner in exercise
\nof powers under Section 3(1) of the PASA Act is hereby
\nquashed and set aside. The petitioner – Sajid Sirajbhai
\nMansuri is hereby ordered to be set at liberty forthwith
\nif he is not required to be detained in jail for any
\nother purpose. Rule made absolute. DS permitted.
