UDAYABHANU, J.\n\n\n                          W.P.C.NO.36028 OF 2004\n\n\n          DATED THIS THE 6th    DAY OF DECEMBER    2006\n\n\n                                    JUDGMENT\n<\/pre>\n<p>       The petitioner who is the father of the deceased Noble Varghese<\/p>\n<p>@ Noby, aged 23, who was found dead  and lying in the well situated<\/p>\n<p>in the   house   compound of the neighbour of the petitioner, i.e.Babu,<\/p>\n<p>S\/o.George on 15-5-2004 in the middle of the night and whose  death<\/p>\n<p>has been written off as accidental by the police, has sought for further<\/p>\n<p>investigation   into   the   matter   by   the   C.B.I.     It   is   stated   that   the<\/p>\n<p>deceased son of the petitioner had gone out of the house at about 10<\/p>\n<p>p.m. with one Santhosh and at about 4.30 a.m.the petitioner  woke up<\/p>\n<p>hearing the barking of the dog and the  commotion and came to know<\/p>\n<p>that   his   son   was   found   dead.   The   role   of   Babu,   owner   of     the<\/p>\n<p>compound     who   is   the   proprietor   of     Nedumparambil   Bankers,   is<\/p>\n<p>strongly suspected.    According to the petitioner, the above Babu who<\/p>\n<p>is a rich person has influenced   the police.   The petitioner is a retired<\/p>\n<p>driver   of   the   K.S.R.T.C.     Detailed   questioning   of   the   friends   of   the<\/p>\n<p>deceased     including   Santhosh   is   necessary   to     unravel   the   truth.<\/p>\n<p>According to the petitioner, the F.I.S.by Babu contained discrepancies<\/p>\n<p>and   contradictions.   According to the   petitioner, the chappals found<\/p>\n<p>near the well were of  different size.\n<\/p>\n<p>\n<span class=\"hidden_text\">WPC.36028\/2004                             -2-<\/span><\/p>\n<p>       2.     As   directed   by   this   Court,   the   Sub   Inspector,   who<\/p>\n<p>investigated the case has filed a   statement.   It is stated therein that<\/p>\n<p>as per the F.I.S. at night at about 10.30, the wife of the     informant<\/p>\n<p>Babu George, heard  the sound  of somebody walking on the roof top<\/p>\n<p>of his house and the cracking sound of tiles.  The lady raised a hue and<\/p>\n<p>cry   and   the   informant   and   his   wife   heard   the   sound   of   somebody<\/p>\n<p>jumping   from   the   roof   top   and   running   away.     They   alerted   the<\/p>\n<p>neighbours   and   on   a   combing     operation   by   the   local   people   in   the<\/p>\n<p>neighbourhood,     a   pair   of   chappals   lying     near   the   well   situated   at<\/p>\n<p>about 5 metres away from the staircase  was found and the nylon net<\/p>\n<p>covering the mouth of the well was found torn.   Fire force  was called<\/p>\n<p>and the person lying inside  the well was lifted up and was found dead.<\/p>\n<p>The   postmortem   conducted     at   the   Medical   College,   Allappuzha<\/p>\n<p>indicated that the deceased   had consumed   alcohol.   There were  12<\/p>\n<p>anti-mortem   injuries   which   were   just   abrasions   and   one     lacerated<\/p>\n<p>wound at the back of left foot.  The finding of the Forensic Surgeon is<\/p>\n<p>that   the   deceased     died   due   to   drowning.     33   witnesses   have   been<\/p>\n<p>questioned.   A report  has been filed in this regard   before the   Sub-<\/p>\n<p>Divisional Magistrate.\n<\/p>\n<\/p>\n<p>       3. The Case Diary was produced and the counsel was heard.<\/p>\n<p>       4. On a perusal of the Case Diary, I find that no witnesses have<\/p>\n<p><span class=\"hidden_text\">WPC.36028\/2004                                -3-<\/span><\/p>\n<p>mentioned anything  suspicious about the conduct of Babu Goerge, the<\/p>\n<p>first   informant.     Further   the   mahazar   showed   that   the   height   of   the<\/p>\n<p>well   is   only   50   cms.   and   the   same   is   situated   5.8   metres   from   the<\/p>\n<p>house,   on   its   back side.   The    evidence  is  that the chappals  were<\/p>\n<p>found near the well and that the same was a pair.   The investigation<\/p>\n<p>has revealed  nothing incriminating with respect to the role of the first<\/p>\n<p>informant.    There   is   no  evidence   as   to  any  animosity  entertained   by<\/p>\n<p>anybody against  the deceased.    The  statement  of the witnesses  who<\/p>\n<p>are  the   friends   and  the   elder   brother   of  the   deceased  show  that  the<\/p>\n<p>deceased was drunk to the gills when he was going out of the house<\/p>\n<p>after   10   p.m.    I   find   that   the   investigation   by   the   C.B.I.is   not   at   all<\/p>\n<p>warranted in the circumstances.\n<\/p>\n<\/p>\n<p>        All   the   same,   the   Superintendent   of     Police,   Ernakulam   is<\/p>\n<p>directed   to  see  that  the  investigation  is  verified  and  if   necessary   the<\/p>\n<p>same   is   to   be   further   investigated.     The   same   shall   be   done   at   the<\/p>\n<p>earliest.
