DAVE\n\t\t\n\t\n\n \n\nDate\n: 03\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nthe learned counsel for the petitioner.\n<\/p>\n<p>\tIt<br \/>\nis submitted that, after issuance of a show cause notice,<br \/>\ncharge-sheet dated 2nd June 2005 was served upon the<br \/>\npetitioner, to which, a reply was given by the petitioner<br \/>\nimmediately. It is further submitted that various government<br \/>\nresolutions and circulars provide for completion of departmental<br \/>\ninquiry as expeditiously as possible and, even in a given case, an<br \/>\nemployee, who is charge-sheeted departmentally, can be considered for<br \/>\npromotion on ad-hoc basis and reliance is placed on Government<br \/>\nResolution dated 30th October 1993 issued by the General<br \/>\nAdministration Department. In spite of the above, by an order dated<br \/>\n5th January 2011, the juniors to the petitioner have been<br \/>\npromoted ignoring the claim of the petitioner.\n<\/p>\n<p>\tIn<br \/>\nthe above circumstances, the respondents are directed to answer for<br \/>\nnon-compliance of their own government resolution, as relied upon by<br \/>\nthe petitioner, on or before 19th October 2011.\n<\/p>\n<p>\tIssue<br \/>\nnotice returnable on 19th October 2011.\n<\/p>\n<p>(ANANT<br \/>\nS.
