No. 147 of 2011\n \n\n \n \n=========================================\n\n\n \n\nNARANBHAI\nKHIMJIBHAI VEGDA &amp; 1 - Petitioner(s)\n \n\nVersus\n \n\nTHE\nMAMLATDAR &amp; 2 - Respondent(s)\n \n\n=========================================\n \nAppearance : \nMR\nUTPAL M PANCHAL for\napplicants \nMR JANAK RAVAL, AGP for Respondent(s) : 1 - 2. \nMR NV\nGANDHI for Respondent(s) :\n3, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE HARSHA DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/09\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tthis application, the applicants seek condonation of delay 314 days<br \/>\n\tcaused in filing Civil Revision Application (Stamp) No.147 of 2011.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocates for the respective parties.\n<\/p>\n<p>From<br \/>\n\tthe averments made in the application, it is apparent that the<br \/>\n\tapplicants herein had challenged the impugned order dated 16.3.2011<br \/>\n\tpassed by the Deputy Collector, Jamnagar before the Collector,<br \/>\n\tJamnagar on 6.5.2011.  However, the same came to be rejected by a<br \/>\n\tcommunication dated 27.5.2011.  Thereafter, it appears that the<br \/>\n\tapplicant No.1 not well and on account of other social work, the<br \/>\n\tapplicants could not immediately contact the advocate and therefore,<br \/>\n\tthe aforesaid delay has occasioned in filing the present revision<br \/>\n\tapplication.\n<\/p>\n<p>From<br \/>\n\tthe averments made in the application, it appears that sufficient<br \/>\n\tcause has been made out by the applicants for not filing the<br \/>\n\trevision application within the prescribed period of limitation.<br \/>\n\tMoreover, there is nothing to indicate that the applicants were<br \/>\n\tdeliberately negligent in prosecuting the remedy by way of revision,<br \/>\n\tnor can it be said that the applicants had given up the cause.  In<br \/>\n\tthe circumstances, the delay caused in filing the civil revision<br \/>\n\tapplication deserves to be condoned.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and is, accordingly,<br \/>\n\tallowed.  The delay of 314 days caused in filing Civil Revision<br \/>\n\tApplication (Stamp) No.147 of 2011 is hereby condoned.
