\n173(1) of MV Act against the judgment and award dated
\n24.3.2008 passed in MVC No.l56\/200? on the file of the V11
\nAddl. Judge, Court of Small Causes. Member Mg.\/3&CT–3,
\nmetropolitan area, Bangalore, {SCCH.No.3), Awardin_g7.._ a<\/p>\n
compensation of Rs.1,50,700\/– with interest @ 7.5%g’.f.A._’fro’m<\/p>\n
the date of petition till deposit.\n<\/p>\n

\noccurred on 12.11.2006  pl  Canara Bank
\non D.V.G.Road in Bagepalli-‘toivriip The appellant\n<\/p>\n
— insurance   this appeal the
\ncorrectness oflthe’::..li’i_dgrrentfandtillinraifdlldated 24th March 2008
\npassed   the M.A.C.’I’.-Ill, Bangalore<\/p>\n
City {hereinafterireferreldlto  ‘Tribunal’ for short).<\/p>\n
 factuml’oi7~–accident, sustaining of injuries by the<\/p>\n
resp.onden’t._ \u00a5l_”‘clai:f11ant, nature of injury resulting in his<\/p>\n
  permanent  involvement of said Vehicle in the said<\/p>\n
 ‘accident  also the fact that the appellant — Insurance<\/p>\n
 V’ Company ulrlas the insurer of the said vehicle as on the relevant<\/p>\n
 ‘daterofl accident, are all not in dispute.<\/p>\n

3. I have heard the arguments of learned Advocates for
\nboth the sides and perused the impugned Judgment and __Award
\nand also entire material found in the original r\u20acCOTdS’O1\u00a77;Eti\ufb02.Cd<\/p>\n
from the Tribunal.\n<\/p>\n
4. Three grounds on which thejlirnpugned J\u00abu.dgment:l’and<\/p>\n
Award is challenged by the appellant –  ~.<\/p>\n
[i] The Tribunal   hoiding
\nthat the driveztiozf thjeh  was negligent in
\ncausinggthe said  l i<\/p>\n
{ii} The    in taking 10%
\na\u00a7=i’  in calculating the loss of<\/p>\n
(iii)   another error in awarding<\/p>\n
interest annum on the total amount of
\n;,,;Scon1zpensatio*i1′ awarded in favour of the respondent. —<\/p>\n
it ‘* _ ”\n<\/p>\n
 On careful reading of the averments in the claim<\/p>\n
~ \u00ab.fi.”,i”petit:ion and the evidence of injured claimant {PW1}, it could be<\/p>\n
4’seen’that he has averred in his petition and has also stated in<\/p>\n
‘j”‘n.is_..e.xamination–i.n~chief that, while he was on the road as<\/p>\n
  ~-pedestrian, the driver of the said tempo, by driving in a rash and<\/p>\n
arm”\n<\/p>\n
.. 4 ..\n<\/p>\n
negligent manner, dashed against him and thus, the driver of
\nthe said vehicle was solely responsible for the accident. He has
\ndenied the suggestion put to him by the learned Counsellor the<\/p>\n
insurer that himself was negligent in crossing the <\/p>\n
therefore, he was solely responsible for the occurrence  <\/p>\n
accident. The insurer has not chosen-to”addv.ee  ‘evidence in<\/p>\n
support of his plea that the said   _<\/p>\n
negligence or contributory neg1,i4genceA.’on   the”?<\/p>\n
claimant. RW1, who has been_..e\u00a7{aniined on–b,eh.s.lf of the<\/p>\n
insurer, was not an eye witr1ess.accitlent.._\n<\/p>\n
8. Further, the .insu\u00a7rer”Vhas nlaced reliance on Ex.Rl, the
\nsketch of sceneolf  ljt._rei{eals  the road at the place of<\/p>\n
accident {was ‘rnnni’ii,<_\u00a7'Eae_t:\u00a5We'st' and injured claimant was<\/p>\n
crossing the road vfrorn'E'slo3:tli'*…to Vsouth. The place of accident is<\/p>\n
'vshownhaltlv the nolithern edge of the road. Since it is not in<\/p>\n
Zngdivspute  t3ne…_vehicle in question was moving from East to<\/p>\n

\nhis extreme right hand side and dashed against the claimant,
\nwho was about to cross the road. Therefore. I am of the
\nconsidered opinion that the positive evidence of the V–i’i”.1_jured<\/p>\n
claimant as to the negligence on the part of the diiver <\/p>\n
tempo has remained totally unrebutted by the <\/p>\n
being so. E do not find any reason to.interfere5_’with”the  V<\/p>\n
recorded by the Tribunal that the driyer  the<\/p>\n
solely negligent in causing the said:”ae_cident,_p .<\/p>\n
7. PW2 is the Doctor,’.Who&V.eXam*ined. the  claimant
\nfor his physical disability’ the disability
\ncertificate. He  as a result of
\nfracture to hip.   of pain in the pubic
\nregion, finds it  abduction of each hip<\/p>\n
joint is restricytedvvby   external rotation is restricted by<\/p>\n
__l20  thus, the claimant suffers physical imperative to the<\/p>\n
v.’v.’.e;){:”[\u20ac11l;vl..0f  respect of his whole body. Referring to the<\/p>\n
fulithler this witness that the x–ray that was taken on<\/p>\n

:’l.v4.u’co’unsel for the appellant ~\u00ab~ insurer strongly contends that the<\/p>\n
  committed an error in taking permanent disability of<\/p>\n
 ‘theinjured claimant at 10%. Having regard to the nature of the<\/p>\n
 “union of the fractured bone and other complaints, the Doctor<\/p>\n

\nhas given evidence and the same has been rightly accepted by<\/p>\n
the Tribunai.\n<\/p>\n
8. Further, though the claimant has stated in his evidence<\/p>\n
that he was earning Rs.7,000\/– per month, the ‘I’rib:u11″.:\u00a7ii,Lhas<\/p>\n
taken notional income of Rs.3.000\/– per month   <\/p>\n
the loss of future earnings. It has chosen\u00e9the.’  if<\/p>\n
the injured was aged about 35 years   the  of <\/p>\n
There is no dispute as to the adoptingfofpthe saici\u00ab:._:r11t11ti:p1ier.’Vat<\/p>\n
Having regard to the nature of the__iir’ijiu1’ties sus’t\u00abairiAecViV.i\u00a7 period of
\ntreatment undergone    inpatient, the
\npercentage of permanent disabiility’;  any reason to<\/p>\n
interfere with avifarc\u00e9iiiigg  loss of future<\/p>\n
income or.._reduction ‘ofcapacity of the claimant in terms
\nof the same.  ”\n<\/p>\n
9%: ‘iLearneVd”~CVoVuVnsev1 for the appellant — insurer is quite<\/p>\n
justified infufstibmitting that the Tribunal committed an error in<\/p>\n
awarding –i.nteVrest_–=on the total amount of compensation of<\/p>\n
if  Rs.1,A5’Q,’7Q’C1\/'<i@Af7.5% per annum. Law is well settled that the<\/p>\n
– –rate of interest shall be maximum of 6% per annum. Therefore,<\/p>\n
   deserves to be reduced from 7.5% to 6% per annum.<\/p>\n

\nFor the reasons aforesaid, the present appeal is allowed in
\npart. While leaving the impugned Judgment and Award<\/p>\n
undisturbed, the rate of interest is hereby reduced fronig7.5%<\/p>\n
per annum to 6% per annum. Award shall <\/p>\n
accordingly. The amount, which is deposited in t.hi.s.”C<Jart;l <\/p>\n
be transmitted to the Tribunal coneeri*1e'd.so–l_4as_,l<$tenable.\u00bbthe<\/p>\n
