No.19 of<br \/>\n1983 whereby, the said application was partly allowed.\n<\/p>\n<p>2.\tThe<br \/>\nrespondent no. 2 herein was running a glass factory wherein, the<br \/>\nappellant was employed to do the work of crushing glass by respondent<br \/>\nno. 1 on contract basis. On 06.08.1982, at around 0800 hrs., while<br \/>\nthe appellant was doing his work, his right hand accidentally got<br \/>\nentangled in the machine. As a result thereof, the appellant<br \/>\nsustained severe injury on his right hand.\n<\/p>\n<p>2.1\tThe<br \/>\nappellant, therefore, filed the aforesaid case before the Court below<br \/>\nclaiming total compensation of Rs.36,280\/-. The Court below, after<br \/>\nappreciating the evidence on record, partly allowed the case by<br \/>\nawarding a sum of Rs.16,400\/- towards compensation. Being aggrieved<br \/>\nby the said order, the appellant has preferred this appeal before<br \/>\nthis Court.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is not in dispute that the appellant sustained the<br \/>\ninjury in question during the course of employment. As per the<br \/>\nmedical evidence on record, the appellant was having 50% permanent<br \/>\ndisability for the body as a whole. On the basis of the said<br \/>\nevidence, the respondents have admitted before the Court below that<br \/>\nthe appellant had lost 75% of his earning capacity as against the<br \/>\nclaim of 100% made by the appellant. Accordingly, the Court below<br \/>\nassessed the loss of earning capacity of the appellant at 75%.\n<\/p>\n<p>4.\tSo<br \/>\nfar as the amount of compensation awarded by the Court below is<br \/>\nconcerned, in my opinion, the same is just and proper, if we look at<br \/>\nthe overall evidence available on record. No other view is possible<br \/>\nthan the one taken by the Court below. Nothing has been shown from<br \/>\nthe record which may warrant interference from this Court in this<br \/>\nappeal. I am in complete agreement with the reasonings given by and<br \/>\nthe findings arrived at by the Court below.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the appeal is dismissed.
