BASANT, J.\n           -------------------------------------------------\n               B.A. Nos. 276 &amp; 278 OF 2008\n           -------------------------------------------------\n         Dated this the 11th day of January, 2008\n\n                              ORDER\n<\/pre>\n<p>      These petitions are filed by the common petitioner<\/p>\n<p>against whom prosecutions under Sec.138 of the Negotiable<\/p>\n<p>Instruments Act are pending in two different courts.           The<\/p>\n<p>prosecutions are initiated by different complainants also.<\/p>\n<p>Though the proceedings were initiated much earlier, the<\/p>\n<p>petitioner has not entered appearance and the cases against<\/p>\n<p>him stand transferred to the list of Long Pending Cases.<\/p>\n<p>Reckoning the petitioner as an absconding accused, warrants<\/p>\n<p>of arrest have been issued by the learned Magistrates against<\/p>\n<p>the petitioner. The petitioner finds such warrants of arrest<\/p>\n<p>chasing him now.\n<\/p>\n<p>      2. According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence earlier before the courts was not wilful or<\/p>\n<p> B.A. Nos. 276 &amp;<br \/>\n<span class=\"hidden_text\"> 278 OF 2008                   -: 2 :-<\/span><\/p>\n<p>deliberate. He is willing to surrender before the courts<\/p>\n<p>concerned and seek regular bail. The petitioner apprehends that<\/p>\n<p>his applications for regular bail may not be considered by the<\/p>\n<p>learned Magistrates on merits, in accordance with law and<\/p>\n<p>expeditiously. It is, in these circumstances, that the petitioner<\/p>\n<p>has come to this Court for a direction to the learned Magistrates<\/p>\n<p>to release him on bail when he appears before the learned<\/p>\n<p>Magistrates.\n<\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrates and explain to the learned Magistrates the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrates. I have no reason to assume that the<\/p>\n<p>learned Magistrates would not consider the petitioner&#8217;s<\/p>\n<p>applications for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.     No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>     4. In the result, these bail applications are dismissed; but<\/p>\n<p>with the observation that if the petitioner surrenders before the<\/p>\n<p>learned Magistrates and seeks bail, after giving sufficient prior<\/p>\n<p>B.A. Nos. 276 &amp;<br \/>\n<span class=\"hidden_text\">278 OF 2008                   -: 3 :-<\/span><\/p>\n<p>notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrates must proceed to pass appropriate orders on merits<\/p>\n<p>and expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>                                         (R.
