{"id":87463,"date":"2011-02-24T00:00:00","date_gmt":"2011-02-23T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/the-man-comm-laxmi-narayan-swa-vs-the-state-of-bihar-amp-ors-on-24-february-2011"},"modified":"2019-02-28T07:41:18","modified_gmt":"2019-02-28T02:11:18","slug":"the-man-comm-laxmi-narayan-swa-vs-the-state-of-bihar-amp-ors-on-24-february-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/the-man-comm-laxmi-narayan-swa-vs-the-state-of-bihar-amp-ors-on-24-february-2011","title":{"rendered":"The Man.Comm.Laxmi Narayan Swa vs The State Of Bihar &amp;Amp; Ors on 24 February, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">The Man.Comm.Laxmi Narayan Swa vs The State Of Bihar &amp;Amp; Ors on 24 February, 2011<\/div>\n<pre>            IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        CWJC No 2807 of 2010\nTHE MANAGING COMMITTEE, LAXMI NARAYAN SWARGIYA PANDIT RAJHANS\n  SANSKRIT PRATHMIK SAH UCHCHA VIDYALAYA @ VIDYA MANDIR &amp; ANR\n                              Versus\n                     THE STATE OF BIHAR &amp; ORS\n                             -----------\n<\/pre>\n<p>3    24.02.2011                 As pursuant to notice issued by this Court to private<\/p>\n<p>                  respondent No 7, he has appeared and filed an interlocutory application<\/p>\n<p>                  bringing on record certain facts and praying for modification of the order<\/p>\n<p>                  passed earlier on 12.04.2010 without hearing him, in my view, it is<\/p>\n<p>                  appropriate that the matter be listed For Admission before appropriate<\/p>\n<p>                  Bench which would consider the desirability of modifying the order in<\/p>\n<p>                  question in view of the facts brought on record and\/or finally dispose of<\/p>\n<p>                  the matter as it may consider appropriate.\n<\/p>\n<p>                                As respondent No 7 has, in his application, stated that the<\/p>\n<p>                  last date for filing forms and fees of Madhyama Examination is 28th of<\/p>\n<p>                  February, 2011 with late fine 03rd of March, 2011, the students will suffer<\/p>\n<p>                  irreparable injury if they are not permitted to appear.<\/p>\n<p>                                Without expressing any thing on merit and without<\/p>\n<p>                  prejudice to any party, it is directed that the Sanskrit Shiksha Board may<\/p>\n<p>                  accept the fees and forms, if otherwise they are in accordance with law, of<\/p>\n<p>                  the students but while accepting the same and issuing admit cards, it<\/p>\n<p>                  would inform the students that their results would be contingent upon the<\/p>\n<p>                  result of this writ petition. This would also be conveyed by respondent<\/p>\n<p>                  No 7 to the students who are submitting their fees and forms through him.<\/p>\n<p>                                Let the matter be listed before appropriate Bench after<\/p>\n<p>                  taking necessary permission from Hon&#8217;ble the Chief Justice and parties<br \/>\n<span class=\"hidden_text\">                                   2<\/span><br \/>\n          would be at a liberty to move the Court concerned for early disposal of the<\/p>\n<p>          case.\n<\/p>\n<\/p>\n<pre>M.E.H.\/                                       (Navaniti Prasad Singh)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
