Muralidhar, J.\n<\/p>\n<p>LPA No.418 of 2007<\/p>\n<p>1. The first-mentioned appeal LPA No. 418 of 2007 is by the Office of the<\/p>\n<p>Chief Post Master General and is directed against a judgment dated<\/p>\n<p>28.03.2007 passed by the learned single Judge allowing the respondents&#8217;<\/p>\n<p>WP(C) No. 22679-80\/2005. The aforesaid mentioned writ petition was filed<\/p>\n<p>by the respondents challenging the communication dated 08.11.2005 of the<\/p>\n<p>of the appellant whereby the respondents were informed that the booklet<\/p>\n<p>containing the advertisement of Toyota Motor Corporation in the form of a<\/p>\n<p>calendar, inserted in the Reader&#8217;s Digest issue of December 2005 was<\/p>\n<p>neither a supplement nor part and parcel of the publication and therefore, the<\/p>\n<p>request for mailing of that issue on concessional rates cannot be acceded to.<\/p>\n<p>This was followed by another letter to the same effect on 21.11.2005. It may<\/p>\n<p>be mentioned here that Respondent No.1 is the publisher of Reader&#8217;s Digest<\/p>\n<p>and is publishing it under a licence from The Raeder&#8217;s Digest Association<\/p>\n<p>Inc. in the USA since October 2003. Prior thereto it was being published in<\/p>\n<p>India by the R.D.I. Print and Publishing Ltd.\n<\/p>\n<\/p>\n<p>2. The reasons given by the appellant for the denial of concessional rate was<\/p>\n<p>that &#8220;the said booklet has been bound and printed separately and merely<\/p>\n<p>stapled to the Reader&#8217;s Digest&#8221;. Secondly, &#8220;the booklet did not conform to<\/p>\n<p>the conditions prescribed in the department&#8217;s letter No. 22.15\/2000 PO (Part-<\/p>\n<p>II) dated 09.10.2001&#8221;.\n<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                        Page 2 of 15<\/span>\n<\/p>\n<p> 3. The conditions in the letter dated 09.10.2001 were that for bringing out a<\/p>\n<p>multi-page Toyota advertisement in the December 2001 issue of Reader&#8217;s<\/p>\n<p>Digest, the respondents had to ensure the following :\n<\/p>\n<blockquote><p>       (i)     The advertisement had to be printed and bound along with other<\/p>\n<p>               advertisement and articles in the magazine.\n<\/p><\/blockquote>\n<blockquote><p>       (ii)    The advertisement had to be numbered in running numerical<\/p>\n<p>               sequence and will also have the name of the magazine and issue<\/p>\n<p>               month printed in a prominent position.\n<\/p><\/blockquote>\n<blockquote><p>       (iii)   The extended cover would also be included in the total number<\/p>\n<p>               of pages so that it will be conformity with the requirement of a<\/p>\n<p>               registered newspaper.\n<\/p><\/blockquote>\n<p>4. The learned single Judge relied upon the earlier decision in <a href=\"\/doc\/1070893\/\">Competition<\/p>\n<p>Success Review v. Union of India,<\/a> 106 (2003) DLT 469 in which the<\/p>\n<p>provisions of Section 9 of the Indian Post Office Act, 1898 as well as Clause<\/p>\n<p>139 of the Posts Office Guide, Part-I had been examined. The circulars<\/p>\n<p>dated 19.05.1999 and 25\/28.06.1999 issued by the Postal Department with<\/p>\n<p>regard to the grant of concessional rates to magazines which included<\/p>\n<p>advertisements, were also discussed. As regards the first circular dated<\/p>\n<p>19.05.1999, it was held that only where the pages constituting the<\/p>\n<p>advertisement are not accounted for in the pagination of the publication as a<\/p>\n<p>whole, the concessional rate would be unavailable. As regards the second<\/p>\n<p>circular dated 25\/28.6.1999, it was held that it was not necessary that each of<\/p>\n<p>the pages containing the advertisement were also to be numbered as long so<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                         Page 3 of 15<\/span><br \/>\n long as the pages were accounted for in the overall numbering of pages of<\/p>\n<p>the magazine.\n<\/p>\n<\/p>\n<p>5. On the facts of the present case, it was held that the impugned<\/p>\n<p>advertisement in the Reader&#8217;s Digest issue of December 2005 was<\/p>\n<p>consecutively numbered. Both in the first and last pages it was prominently<\/p>\n<p>indicated that the advertisement was part and parcel of the issue. It was<\/p>\n<p>accordingly held that the impugned letters dated 8.11.2005 and 21.11.2005<\/p>\n<p>were required to be set aside. The writ petition was allowed.<\/p>\n<p>6. We have heard Mr. P.P. Malhotra, learned Additional Solicitor General,<\/p>\n<p>on behalf of the appellant and Mr. Rajiv Nayyar, learned senior counsel on<\/p>\n<p>behalf of the respondents. It is submitted by Mr. Malhotra that the Toyota<\/p>\n<p>Calendar 2006 was not an integral part of the main magazine and, therefore,<\/p>\n<p>not in conformity with Section 9(3) of the Indian Post Office Act (Act) and<\/p>\n<p>the Indian Post Office Rules, 1933 (&#8220;Rules&#8217;). It was submitted that the<\/p>\n<p>advertisement was in the form of calendar which could be pulled out and<\/p>\n<p>used separately. It was really not a supplement to the magazine itself. If the<\/p>\n<p>advertisement was separated one could still read the magazine. It was<\/p>\n<p>contended that the booklet also was violative of Rule 30 of the Rules as no<\/p>\n<p>paper or thing could be enclosed in or with a registered newspaper other than<\/p>\n<p>an extra supplement in terms of Section 9 of the Act. The quality and size of<\/p>\n<p>the paper was different from the main magazine. If the calendar had been<\/p>\n<p>transmitted separately through the Post Office network, the sender would<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                        Page 4 of 15<\/span><br \/>\n have been paid a minimum of Rs.4\/- per article. However, respondent was<\/p>\n<p>seeking the concessional rate applicable to registered newspapers and this<\/p>\n<p>resulted in the appellant being denied its revenue. Reliance was also placed<\/p>\n<p>on the order dated 29.07.1982 passed by the Division Bench of this Court<\/p>\n<p>dismissing Civil Writ No. 607\/1982 titled R.D.I. Print and Publishing<\/p>\n<p>Private Limited v. Union of India and Anr. That order was upheld by the<\/p>\n<p>Supreme Court by an order dated 25.11.1992 in Civil Appeal No.3517\/1984.<\/p>\n<p>7. Mr. Nayyar, on the other hand, contends that the order dated 29.07.1982<\/p>\n<p>of this Court was in a different context. There on facts it was found that if<\/p>\n<p>the advertisement pages were pulled out it did not detract from the value of<\/p>\n<p>the magazine and only amounted to the advertisement concerned not being<\/p>\n<p>distributed. However, it was clarified that &#8220;those pages which have an<\/p>\n<p>advertisement on both sides, and are properly numbered may not perhaps<\/p>\n<p>infringe note (i)&#8221; of the below Clause 132, P. &amp; T. Guide Volume I, as the<\/p>\n<p>taking out of &#8220;such pages may result in enquiries being made from the<\/p>\n<p>petitioner as to what was contained on those pages, which the readers would<\/p>\n<p>find to be missing&#8221;. It is submitted that the issues raised in this appeal have<\/p>\n<p>been considered in detail in <a href=\"\/doc\/1070893\/\">Competition Success Review v. Union of India<\/a><\/p>\n<p>which judgment has not been challenged and has attained finality. It is<\/p>\n<p>submitted that the impugned booklet does not violate any circular of the<\/p>\n<p>department and therefore no interference is called for with the impugned<\/p>\n<p>order of the learned single Judge.\n<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                         Page 5 of 15<\/span>\n<\/p>\n<p> 8. In order to appreciate the above contentions reference may be first made<\/p>\n<p>to the relevant statutory provisions. Section 9 of the Act reads as under:<\/p>\n<blockquote><p>               &#8220;9.Power to make rules as to registered newspapers &#8211;<br \/>\n               (1) [Central Government] may make rules providing for<br \/>\n               the registration of newspapers for transmission by inland<br \/>\n               post as registered newspapers.\n<\/p><\/blockquote>\n<blockquote><p>               (2) For the purpose of such registration, every<br \/>\n               publication, consisting wholly or in great art of political<br \/>\n               or other news, or of articles relating thereto or to other<br \/>\n               current topics, with or without advertisements, shall be<br \/>\n               deemed a newspaper, subject to the following conditions,<br \/>\n               namely :-\n<\/p><\/blockquote>\n<blockquote><p>               (a) that it is published in numbers at intervals of not<br \/>\n               more than thirty one days; and<\/p>\n<\/blockquote>\n<blockquote><p>               (b)    that it has a bona fide list of subscribers<\/p>\n<p>               (3) An extra or supplement to a newspaper, bearing<br \/>\n               the same date as the newspaper and transmitted<br \/>\n               therewith, shall be deemed to be part of the newspaper:\n<\/p><\/blockquote>\n<blockquote><p>                     Provided that no such extra or supplement shall be<br \/>\n               so deemed unless it consists wholly or in great part of<br \/>\n               matter like that of the newspaper and has the title and<br \/>\n               date of publication of the newspaper printed at the top of<br \/>\n               each page.\n<\/p><\/blockquote>\n<blockquote><p>               Explanation &#8211; Nothing in this section or in the rules<br \/>\n               thereunder shall be construed to render it compulsory to<br \/>\n               send newspapers by the inland post.&#8221;\n<\/p><\/blockquote>\n<p>9. Rule 30 of the Rules reads as follows:\n<\/p>\n<blockquote><p>               &#8220;30(1) A: A newspaper as defined in Section 9 of the<br \/>\n               Act and complying with the conditions specified below<br \/>\n               shall be transmitted by post as registered newspaper from<br \/>\n               the place of publication thereof and may also be so<br \/>\n               transmitted from any other place with the permission in<br \/>\n               writing of the Postmaster &#8211; General or officer exercising<br \/>\n               the powers of the Postmaster &#8211; General of the Postal<br \/>\n               Circle in which such other place is situated.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                                Page 6 of 15<\/span><\/p>\n<blockquote><p>                (a) The Postmaster &#8211; General, of the Postal Circle in<br \/>\n               which it is published or, as the case may be, posted and<br \/>\n               the period for which its registration or the last renewal<br \/>\n               thereof as the case may be, remains in force shall not<br \/>\n               have expired.\n<\/p><\/blockquote>\n<blockquote><p>               (b) The full postage shall be prepaid unless the<br \/>\n               newspaper is exempted from prepayment of postage by a<br \/>\n               valid licence.\n<\/p><\/blockquote>\n<pre>               (c)    ..............\n\n               (d)    ..............\n\n               (e)    ..............\n\n               (f)    ...............\n\n<\/pre>\n<blockquote><p>               (g) There shall be no paper or thing enclosed in or<br \/>\n               with any such, newspaper other than an extra supplement<br \/>\n               as specified in Section 9 of the Act.\n<\/p><\/blockquote>\n<blockquote><p>               Note: Any newspaper in which a document of any of the<br \/>\n               following description is enclosed as a supplement shall<br \/>\n               be treated as a book packet:\n<\/p><\/blockquote>\n<blockquote><p>               (i)    an advertisement sheet printed for an advertiser<br \/>\n               and sent to the publisher of newspaper for distribution<br \/>\n               with it;\n<\/p><\/blockquote>\n<blockquote><p>               (ii) an advertisement sheet with an order form attached<br \/>\n               a prospectus with an application form attached or a<br \/>\n               proposal or enquiry form;\n<\/p><\/blockquote>\n<blockquote><p>               (iii) any document drawn up in the form of a direct<br \/>\n               personal communication to the recipient such as a printed<br \/>\n               circular in the form of a letter purporting to be addressed<br \/>\n               to a person by whom the newspaper in which it is<br \/>\n               enclosed is received.\n<\/p><\/blockquote>\n<pre>               (2)    ..............\n\n               (3)    ..............\n\n<\/pre>\n<blockquote><p>               (4) Nothing in this rule shall be deemed to prevent<br \/>\n               newspapers from being transmitted by post, either singly<br \/>\n               or otherwise, at the rates and under the conditions<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                          Page 7 of 15<\/span><br \/>\n                prescribed for book packets, or for book packets<br \/>\n               containing periodicals, and if a newspaper sought to be<br \/>\n               transmitted by post as a registered newspaper fails to<br \/>\n               comply with any of the conditions specified in sub-rule<br \/>\n               (1) it shall be transmitted by post at the said rates and<br \/>\n               under the said conditions.\n<\/p><\/blockquote>\n<p>               (5)    &#8230;&#8230;&#8230;&#8230;&#8230;&#8221;<\/p>\n<p>10.    It must be mentioned that there is also what is called the Post Office<\/p>\n<p>Guide which compiles the rules and regulations relating to Indian post. We<\/p>\n<p>have been shown by Mr. Malhotra the photocopy of the relevant extract of<\/p>\n<p>Post Office Guide Part I as corrected up to 1st July, 1985. Clause 139 in<\/p>\n<p>Section II of this Guide concerns Registered Newspapers. It gives the<\/p>\n<p>definition of a registered newspaper as contained in the Act and proceeds to<\/p>\n<p>repeat Section 9(3). However, it further adds a note which reads as under:<\/p>\n<blockquote><p>               &#8220;Note: Any registered newspaper in which a document of<br \/>\n               any of the following descriptions in particular is enclosed<br \/>\n               as a supplement should be treated as a book packet:\n<\/p><\/blockquote>\n<blockquote><p>               (i)    an advertisement sheet printed for an advertiser<br \/>\n               and sent to the publisher of a newspaper for distribution<br \/>\n               with it;\n<\/p><\/blockquote>\n<blockquote><p>               (ii) an advertisement sheet with an order form<br \/>\n               attached, a prospectus with an application form attached<br \/>\n               or a proposal enquiry form;\n<\/p><\/blockquote>\n<blockquote><p>               (iii) any document drawn up in the form of a direct<br \/>\n               personal communication t the recipient such as printed<br \/>\n               circular in the form of a letter purporting to be addressed<br \/>\n               to a person by whom the newspaper in which it is<br \/>\n               enclosed is received.&#8221;\n<\/p><\/blockquote>\n<p>11. The contention is that the Toyota booklet is like a book packet and<\/p>\n<p>therefore would not be treated as a supplement. A conspectus of the above<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                          Page 8 of 15<\/span><br \/>\n provisions shows that in order to avail of the concessional rates applicable to<\/p>\n<p>a registered newspaper, the publisher would have to satisfy the postal<\/p>\n<p>authority that the advertisement in question is treated as part and parcel of<\/p>\n<p>the issue of the magazine in which it is inserted. Section 9(3) says that &#8220;an<\/p>\n<p>extra or supplement to a newspaper, bearing the same date as the newspaper<\/p>\n<p>and transmitted therewith, shall be deemed to be part of the newspaper&#8221;.<\/p>\n<p>The proviso further requires that such extra or supplement will be deemed to<\/p>\n<p>be part of the newspaper only if &#8220;it consists wholly or in great part of matter<\/p>\n<p>like that of the newspaper and has the title and date of publication of the<\/p>\n<p>newspaper printed at the top of each page&#8221;.\n<\/p>\n<\/p>\n<p>12. In order to deal with the possible confusion arising out of the above<\/p>\n<p>provisions, clarificatory circulars have been issued by the department. On<\/p>\n<p>19.5.1999 the department announced a decision to withdraw the<\/p>\n<p>concessional tariff rates to magazine which did not contain pagination on all<\/p>\n<p>pages of the advertisement. On a representation being made by the Indian<\/p>\n<p>Newspaper Society, the department came out with the clarificatory letter<\/p>\n<p>dated 25\/28.6.1999 clarifying &#8220;the concessional tariff would extend to all<\/p>\n<p>magazines\/periodicals booked as registered newspapers even if some pages<\/p>\n<p>carrying advertisements are not numbered, provided, such advertisement<\/p>\n<p>sheets are accounted for in the sequential page numbering of the magazine&#8221;.<\/p>\n<p>In the clarificatory letter an example to the following effect was given:<\/p>\n<blockquote><p>               &#8220;For example, a magazine having 76 pages out of which<br \/>\n               25 pages are devoted to advertisements and these pages<br \/>\n               are not numbered. It is not necessary to insist on<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                         Page 9 of 15<\/span><br \/>\n                numbering of such page so long as these 25 pages are<br \/>\n               accounted for in 76 pages of the magazine counted<br \/>\n               consecutively.     Example pages 1-5 news, 6-7-8<br \/>\n               (advertisement but not paginated), 9-13.&#8221;\n<\/p><\/blockquote>\n<p>13. It is plain that the above circular basically follows the line of reasoning<\/p>\n<p>adopted by Division Bench of this Court in its order dated 29.7.1982 in Civil<\/p>\n<p>Writ No. 607\/1982. That was a writ petition filed by R.D.I. Print and<\/p>\n<p>Publishing Ltd. and concerned its September 1980 issue. The advertisement<\/p>\n<p>in question was by Canara Bank. It was contended in that said case that &#8220;the<\/p>\n<p>petitioner collected the advertisement, printed it, put it at a proper place in<\/p>\n<p>the magazine, bound the magazine and distributed the magazine.&#8221; It was<\/p>\n<p>observed that the advertisement had been printed for the advertiser, namely<\/p>\n<p>the Canara Bank and then had been sent to the publisher, i.e., Reader&#8217;s<\/p>\n<p>Digest, for distribution. Therefore, Clause I of the note below Clause 132 of<\/p>\n<p>the Post Office Guide (Corresponding to Clause 139 referred to<\/p>\n<p>hereinbefore) was attracted. As regards the numbering of the pages it was<\/p>\n<p>found that they were numbered as 148 c, etc. and therefore if the pages were<\/p>\n<p>pulled out, it did not detract from the value of the magazine. However, it<\/p>\n<p>was clarified that if the pages had been numbered consecutively it would not<\/p>\n<p>infringe note (i).\n<\/p>\n<\/p>\n<p>14. A perusal of the judgment in Competition Success Review shows that the<\/p>\n<p>records of the Civil Writ No. 607\/1982 were called for by the learned single<\/p>\n<p>Judge. It was found that the advertisement inserted in the Reader&#8217;s Digest<\/p>\n<p>issue of September 1980 were numbered as 160A, 160B &#8230;&#8230;&#8230;&#8230; 160H.<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                         Page 10 of 15<\/span><br \/>\n The advertisements were inserted in the publication but there was no<\/p>\n<p>mention of them in the contents\/index page. They were also not accounted<\/p>\n<p>for in the overall page numbering. In the Competition Success Review Case<\/p>\n<p>the learned single Judge observed that the four offending pages 54A, 54B,<\/p>\n<p>106A and 106B were in fact accounted for in the overall publication.<\/p>\n<p>Moreover in the Competition Success Review case the advertisement was<\/p>\n<p>printed by the publisher itself and not by the advertiser.                    In the<\/p>\n<p>circumstances, the writ petition by Competition Success Review challenging<\/p>\n<p>the decision of the department not to extend concessional tariff was quashed<\/p>\n<p>by the learned single Judge.\n<\/p>\n<\/p>\n<p>15. We have carefully examined the December 2005 issue of Reader&#8217;s<\/p>\n<p>Digest. The page 1 of the issue has a prominent box which reads as under:<\/p>\n<blockquote><p>                         &#8220;TOYOTA Dream Car Art Contest<\/p>\n<p>        This issue of Reader&#8217;s Digest carries Toyota&#8217;s 28-page<br \/>\n        advertisement, featuring 12 superb drawings from the winners<br \/>\n        of the 2004 TOYOTA Dream Car Art Contest.                  The<br \/>\n        advertisement is also being simultaneously published by a large<br \/>\n        number of editions of The Digest in Asia and Europe. See<br \/>\n        pages 55 to 82.&#8221;\n<\/p><\/blockquote>\n<p>What is significant in the above insertion is that it clearly tells the reader on<\/p>\n<p>the first page of the issue in a separate box that there is a 28-page<\/p>\n<p>advertisement which is at pages 55 to 82. If the advertisement was therefore<\/p>\n<p>to be detached from the issue, a subscriber or purchaser would certainly raise<\/p>\n<p>a query as to why it was not supplied as assured in page 1 of the issue. This<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                          Page 11 of 15<\/span><br \/>\n clearly falls in the category envisaged by the Division Bench of this Court in<\/p>\n<p>the order dated 29.7.1982 referred to hereinbefore. It may be recalled that<\/p>\n<p>the Division Bench observed that advertisements of this nature would not<\/p>\n<p>offend Note (i) below Clause 132 of the Post Office Guide (Corresponding<\/p>\n<p>to Clause 139 of the present Guide).\n<\/p>\n<\/p>\n<p>16. Then we turn to the impugned advertisement itself. The first page of the<\/p>\n<p>advertisement indicates the page number as 55 and at the bottom it is clearly<\/p>\n<p>printed: &#8220;Reader&#8217;s Digest\/December 2005&#8221;. Although the other pages of<\/p>\n<p>the Calendar 2006 are not consecutively numbered, the last page indicates<\/p>\n<p>the page number as 82 and again at the bottom carries the words &#8220;Reader&#8217;s<\/p>\n<p>Digest\/December 2005&#8221;. This, therefore, conforms to the requirement of<\/p>\n<p>the clarification issued by the department on 25\/28.06.1999.<\/p>\n<p>17. In the impugned letter dated 21.11.2005 written by the department<\/p>\n<p>declining the concessional tariff it is merely stated that the calendar did not<\/p>\n<p>conform to the conditions contained in the letter dated 09.10.2001. That<\/p>\n<p>letter had stated that &#8220;advertisement will be numbered in running numerical<\/p>\n<p>sequence and will also have the name of the issue, month printed in the<\/p>\n<p>prominent position&#8221;. The specific conditions listed out in this letter have<\/p>\n<p>already been extracted in para 3 hereinbefore. This Court does not find any<\/p>\n<p>of them having been violated as far as the present case is concerned. Further<\/p>\n<p>the need for numbering each page of the advertisement was already<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                         Page 12 of 15<\/span><br \/>\n dispensed with by the department itself in its clarificatory circular dated<\/p>\n<p>25\/28.06.1999.\n<\/p>\n<\/p>\n<p>18. This Court finds that the advertisement in question forms part of the<\/p>\n<p>December 2005 issue of Reader&#8217;s Digest and the pages of the advertisement<\/p>\n<p>have been expressly included in the total number of pages of the said issue.<\/p>\n<p>The first and last page of the advertisement is in sequence with the overall<\/p>\n<p>pagination of the issue. The name of the magazine and issue month is<\/p>\n<p>printed in a prominent position both in the first and last page of the<\/p>\n<p>magazine. Further to remove any doubts the readers have been informed in<\/p>\n<p>page 1 of the issue that the issue includes the Toyota advertisement which is<\/p>\n<p>at pages 55 to 82 of the magazine.\n<\/p>\n<\/p>\n<p>19. Accordingly, this Court finds no ground to interfere with the impugned<\/p>\n<p>judgment of the learned single Judge. The appeal is accordingly dismissed.<\/p>\n<p>LPA No. 1006\/2007<\/p>\n<p>20. This appeal is directed against an order dated 28 th March, 2007 passed by<\/p>\n<p>the learned single Judge allowing WP(C) No. 4985\/2006 filed by the<\/p>\n<p>respondents. In the said writ petition respondents had sought quashing of the<\/p>\n<p>revised Bills dated 16.2.2006, 17.3.2006 and a letter dated 18.2.2006 issued<\/p>\n<p>by the postal department refusing to treat the 26.12.2005 issue of India<\/p>\n<p>Today magazine published by the respondents as a deemed registered<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                        Page 13 of 15<\/span><br \/>\n newspaper and to accord to the respondents the concessional rate for<\/p>\n<p>postage.\n<\/p>\n<\/p>\n<p>21. What led to the filing of the above writ petition was that the 26.12.2005<\/p>\n<p>issue of India Today carried an advertisement for AMWAY India<\/p>\n<p>Enterprises. After issuing them the revised impugned bills, the department<\/p>\n<p>by a letter dated 18.2.2006 informed the respondents that the aforesaid<\/p>\n<p>magazine containing the advertisement booklet of AMWAY India<\/p>\n<p>Enterprises did not adhere to the terms and conditions prescribed for<\/p>\n<p>supplements contained in Section 9(3) of the Act. It was concluded that &#8220;the<\/p>\n<p>said advertisement is neither a supplement nor an integral part of the<\/p>\n<p>magazine under reference as such this should not have been accepted at<\/p>\n<p>concessional rate&#8221;.\n<\/p>\n<\/p>\n<p>22. The above writ petition was heard by the learned single Judge along with<\/p>\n<p>the writ petition filed in respect of the December 2005 issue of Reader&#8217;s<\/p>\n<p>Digest. Both writ petitions were allowed for the same reasons.<\/p>\n<p>23. The grounds urged in the present appeal are more or less similar to the<\/p>\n<p>grounds urged in LPA No. 418 of 2007. The law in this regard has been<\/p>\n<p>already discussed by us in detail hereinbefore.\n<\/p>\n<\/p>\n<p>24.The impugned advertisement booklet of AMWAY has been perused. It is<\/p>\n<p>firmly attached to the magazine. It cannot be detached easily. The beginning<\/p>\n<p><span class=\"hidden_text\">LPA No. 418-2007 &amp; LPA No. 1006-2007                       Page 14 of 15<\/span><br \/>\n page of the advertisement is 35 and the last page is 42 and this is<\/p>\n<p>consecutively numbered to fit within the overall pagination of the magazine<\/p>\n<p>itself. At the foot on every page of the advertisement the following words are<\/p>\n<p>prominently printed: DECEMBER 26, 2005 INDIA TODAY. There can be<\/p>\n<p>no manner of doubt, therefore, that the advertisement is consecutively<\/p>\n<p>numbered and forms an integral part of the magazine itself. If the<\/p>\n<p>advertisement were to be removed then following page 34 of the magazine,<\/p>\n<p>the next page would be page 43 and reader would definitely be left<\/p>\n<p>wondering where the missing pages are.\n<\/p>\n<\/p>\n<p>25. In the considered view of this Court, the impugned advertisement is in<\/p>\n<p>conformity with the requirement of the law as explained by the circulars<\/p>\n<p>issued by the department itself. Consequently, there is no merit in the<\/p>\n<p>appeal. It is dismissed.\n<\/p>\n<\/p>\n<p>                                             S.
