Justice V.K.MOHANAN\n\n Dated :11\/03\/2008\n\n O R D E R\n           P.R.RAMAN &amp; V.K.MOHANAN, JJ.\n           ---------------------------------------------\n                W.P.(Crl).No. 70 of 2008\n           ---------------------------------------------\n          Dated this the 11th day of March, 2008\n\n                      J U D G M E N T\n<\/pre>\n<p>Raman,J:\n<\/p>\n<p>           The petitioners approached this Court alleging<\/p>\n<p>that their daughter Soorya Rajan is under the illegal<\/p>\n<p>confinement of respondents 2 to 4. It is their case that she<\/p>\n<p>is 19 years old and studying for Nursing in St.Daniel&#8217;s<\/p>\n<p>College, Hyderabad.        The alleged detenue, after the<\/p>\n<p>recess, booked a ticket in Sabari Express bound for<\/p>\n<p>Hyderabad     on     16.2.2008,      for    appearing    in the<\/p>\n<p>examination.    She boarded the train at 8.55 am from<\/p>\n<p>Kayamkulam Railway Station. It is stated that the second<\/p>\n<p>petitioner received a call from Soorya intimating that she<\/p>\n<p>had reached Hyderabad, but when she tried to contact<\/p>\n<p>Soorya at the landline at the place of her residence in<\/p>\n<p>Hyderabad, it was informed that she had not reached<\/p>\n<p>there. Enquiries were made. However, the same did not<\/p>\n<p>turn fruitful. It is admitted that they got information from<\/p>\n<p>a relative of respondents 2 to 4, Smt.Sudharma that<\/p>\n<p>Soorya is with the second respondent and they wanted a<\/p>\n<p>WP(Crl) NO. 70 of 2008<\/p>\n<p>                           :-2-:\n<\/p>\n<p>formal marriage between Soorya and the second<\/p>\n<p>respondent. The petitioners were also informed that the<\/p>\n<p>alleged detenue is in passionate love with the second<\/p>\n<p>respondent. The first petitioner, father of the alleged<\/p>\n<p>detenue is working in abroad and he came to Kerala on<\/p>\n<p>knowing the incident.\n<\/p>\n<p>      2.   Pursuant to the notice issued, the alleged<\/p>\n<p>detenue Soorya as also respondents 2 and 3 appeared<\/p>\n<p>before us. We have interacted with the girl. It is learnt<\/p>\n<p>that the girl has married the second respondent in a<\/p>\n<p>temple. She stated that she is a major and she is not<\/p>\n<p>under illegal confinement and she is the wife of second<\/p>\n<p>respondent and residing in the parental home. She is<\/p>\n<p>not under illegal custody. We gave opportunity to the<\/p>\n<p>petitioners to interact with their daughter. Thereafter,<\/p>\n<p>again we interacted with the alleged detenue, but she<\/p>\n<p>stated that she wants to go with the second respondent.<\/p>\n<p>      3.
