JUSTICE MAHESH BHAGWATI<\/p>\n<p>Mr. Liyakat Ali, for the petitioner.\n<\/p>\n<p>Mr. G.S. Fauzdar, Public Prosecutor for the State.\n<\/p>\n<p>\t\tThis order governs the disposal of  bail application filed under Section 439 of Cr.P.C. by Mr. Liyakat Ali Advocate on behalf of the applicant Mohd. Sallam pertaining to F.I.R. No. 142\/2009 registered at police station Bhim Ganj Mandi, Kota City, in the offences under Sections 452, 323, 327, 379, 427 and 34 of IPC.\n<\/p>\n<p>2.\t\tHeard the learned counsel for the petitioner, learned Public Prosecutor appearing for the State and perused the relevant material available on record.\n<\/p>\n<p>3.\t\tLearned counsel for the petitioner has canvassed that the injured Shakti Sen is found to have sustained only two abrasions which are simple in nature. No fire arm has been recovered from the possession. The offences are triable by the court of Judicial Magistrate, First Class, hence, he may be granted indulgence of bail.\n<\/p>\n<p>4.\t\tLearned Public Prosecutor has opposed the bail petition.\n<\/p>\n<p>5.\t\tHaving considered the submissions made at the bar and carefully scanned the relevant material available on record, I, without expressing any opinion on the merits of the case, do feel inclined to grant indulgence of bail to the accused petitioner.\n<\/p>\n<p>6.\t\tIt is, therefore, ordered that the accused petitioner Mohd. Sallam S\/o. Mohd. Gulam in F.I.R. No. 142\/2009 registered at police station Bhim Ganj Mandi, Kota City shall be released on bail on furnishing a personal bond each in the sum of Rs.10,000\/- together with two surety bonds each in the sum of Rs. 5,000\/- to the satisfaction of the learned trial Court with the stipulation that he shall appear before that Court on all dates of hearing and as and when called upon to do so till the trial is concluded.\n<\/p>\n<p>(MAHESH BHAGWATI),J.\n<\/p>\n<p>Mak\/-\n<\/p>\n<p>s-26<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Mohd.
