JOSEPH FRANCIS, JJ.\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      F.A.O.No. 298 of 2009\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 13th day of November, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>Joseph, J.\n<\/p>\n<p>      This appeal is directed against the order passed in<\/p>\n<p>I.A.No. 760 of 2009 in O.S.No. 101 of 2009. The above<\/p>\n<p>application was filed for temporary injunction restraining the<\/p>\n<p>appellants\/counter petitioners from holding themselves as<\/p>\n<p>owners of the plaint schedule property, from encumbering<\/p>\n<p>them in any manner, from alienating the same from making<\/p>\n<p>any improvements therein and from establishing and<\/p>\n<p>conducting any College             or other Educational            and<\/p>\n<p>Commercial institution therein.\n<\/p>\n<p>     2.    We heard the learned               Senior counsel for the<\/p>\n<p>appellants and the learned counsel for the caveator.<\/p>\n<p>F.A.O.No. 298 of 2009<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>      3.    The learned Senior counsel for the appellants, of course,<\/p>\n<p>would point out that the grounds available to the appellants have<\/p>\n<p>not been taken up as stated in the memorandum of appeal. We do<\/p>\n<p>not see any infirmity with the order so as to warrant interference in<\/p>\n<p>this appeal. At the same time, in the facts of the case, we feel that<\/p>\n<p>the suit itself should be directed to be disposed of finally within an<\/p>\n<p>outer time limit.\n<\/p>\n<p>      4. Accordingly, while dismissing the appeal, we direct the<\/p>\n<p>Sub Court, Neyyattinkara to take up O.S.No. 101 of 2009 and<\/p>\n<p>dispose of the same finally on or before 31.3.2010.<\/p>\n<p>                                           (K.
