Munshaw, learned advocate for respondents Nos.2 and 3<br \/>\nand Mr. Dharmesh D. Nanavati, learned advocate for respondent No.5.\n<\/p>\n<p>\tIt<br \/>\nis submitted by Mr. Satyen B. Rawal, learned advocate for the<br \/>\npetitioner that by way of an advertisement, 259 posts were advertised<br \/>\nfor appointment of Vidya Sahayak. The petitioner is physically<br \/>\ndisabled and as per provisions of The Persons with Disabilities<br \/>\n(Equal Opportunities, Protection of Rights and Full Participation)<br \/>\nAct, 1995, 3% reservation should be given to physically disabled<br \/>\npersons. Therefore, out of 259 posts, eight posts should have been<br \/>\nreserved for physically disabled persons. It is contended that<br \/>\ninstead of eight posts, the respondents have filled-in seven posts in<br \/>\nthe said category and the petitioner has not been given appointment.<br \/>\nIt is further submitted that certain irregularities have taken place<br \/>\nin the selection process, which vitiate the appointment of respondent<br \/>\nNo.5.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>H.S. Munshaw, learned advocate for respondents Nos.2 and 3 submits<br \/>\nthat the advertisement makes it clear that out of 259 posts, 38 posts<br \/>\nhave been carried forward as a backlog in the S.E.B.C. category,<br \/>\ntherefore, these posts have been excluded from 259 posts while<br \/>\ncomputing 3% reservation for physically disabled persons. It is<br \/>\ncontended that the posts remaining would be 221, out of which, if 3%<br \/>\nreservation is computed, seven seats are reserved for physically<br \/>\ndisabled persons. The respondents have already given appointment to<br \/>\nseven persons in the said category, calculating 1% each in the<br \/>\ncategories of (a) blindness or low vision, (b) hearing impairment and\n<\/p>\n<p>(c) locomotor disability or cerebral palsy. It is emphasised that<br \/>\nrespondent No.3 and the petitioner both suffer from locomotor<br \/>\ndisability but respondent No.5 is higher in merit, therefore, she has<br \/>\nbeen given appointment.\n<\/p>\n<p>Mr. Dharmesh D. Nanavati, learned advocate for respondent No.5<br \/>\nsubmits that the said respondent has been working since the past two<br \/>\nyears, and even otherwise, there is no illegality or infirmity in her<br \/>\nappointment, as she is higher in merit than the petitioner.\n<\/p>\n<p>\tRule,<br \/>\nreturnable on 01.03.2011.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>M.R.
