NO. 709 OF 2008\n\n          ============================\n\n      DATED THIS THE 21ST DAY OF JANUARY 2010\n\n                           JUDGMENT\n<\/pre>\n<p>Basant,J.\n<\/p>\n<p>      The injured\/claimant is the appellant. He suffered injuries<\/p>\n<p>in a motor accident which took place on 18-9-1999. He was aged<\/p>\n<p>23 years on the date of the accident. He was travelling in a two<\/p>\n<p>wheeler as pillion. The rider of the vehicle died as a result of<\/p>\n<p>injuries suffered in the accident. The appellant was hospitalised<\/p>\n<p>and he underwent treatment as inpatient for a period of eight<\/p>\n<p>days. The documents would suggest that there was long delay in<\/p>\n<p>correctly diagnosing that he had a fracture on the right hand<\/p>\n<p>(scaphoid right). Thereafter scaphoid cast was applied and the<\/p>\n<p>treatment continued.\n<\/p>\n<p>      2. The Tribunal on an anxious consideration of all the<\/p>\n<p>relevant inputs proceeded to pass the impugned award directing<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><br \/>\nM.A.C.A.709\/2008<\/p>\n<p>payment of a total amount of Rs.10,350\/- as compensation as per<\/p>\n<p>the details given below:\n<\/p>\n<\/p>\n<p>1) Loss of earning          : 1500 x 3 = Rs. 4,500\/-\n<\/p>\n<pre>2) Transport to hospital    :            Rs. 750\/-\n\n3) Extra nourishment             :       Rs.1,000\/-\n\n4) Damage to clothing            :       Rs. 500\/-\n\n5)Bystanders expenses            :       Rs. 600\/-\n\n6)Pain and suffering             :       Rs.3,000\/-\n\n                       Total     :       Rs.10,350\/-\n\n\n\n<\/pre>\n<p>     3. The Tribunal directed payment of that amount along with<\/p>\n<p>interest at the rate of 6% per annum.\n<\/p>\n<p>     4. The appellant\/claimant claims to be aggrieved by the<\/p>\n<p>impugned award. What is his grievance?        The learned counsel<\/p>\n<p>for the appellant contends that the Tribunal&#8217;s approach was too<\/p>\n<p>technical and unrealistic. Telltale materials were available to<\/p>\n<p>indicate that the appellant had suffered fracture on the right<\/p>\n<p>scaphoid. The Tribunal did not adopt a reasonable approach and<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><br \/>\nM.A.C.A.709\/2008<\/p>\n<p>did not accept that there was a fracture       consequent to the<\/p>\n<p>accident.    The appellant had examined himself as PW1 and the<\/p>\n<p>relevant documents including the case sheet from the hospital<\/p>\n<p>were produced.\n<\/p>\n<p>      5. It is absolutely certain on a perusal of the documents,<\/p>\n<p>copies of which have been made available to us for our perusal,<\/p>\n<p>that the appellant had complained of pain on the right hand &#8211;<\/p>\n<p>site of the fracture , from the very first day and X-rays were<\/p>\n<p>taken earlier. It is true that a couple of X-rays taken earlier did<\/p>\n<p>not precisely detect the fracture on the scaphoid.        But the<\/p>\n<p>conclusion appears to be reasonable and irresistible from the<\/p>\n<p>totality of circumstances that though late, the fracture was<\/p>\n<p>detected and that fracture was the result of injury suffered in the<\/p>\n<p>accident. The tribunal found and the counsel for the Insurer<\/p>\n<p>vehemently contends that the fracture cannot be accepted as a<\/p>\n<p>consequence of the injury suffered in the accident.       We find<\/p>\n<p>absolutely no merit in this approach. In spite of the treatment<\/p>\n<p>granted initially from the date of the accident, i.e. 18\/9\/1999 to<\/p>\n<p>25\/9\/1999, it would appear that the fracture was not specifically<\/p>\n<p><span class=\"hidden_text\">                                 4<\/span><br \/>\nM.A.C.A.709\/2008<\/p>\n<p>detected, though pain on the site of the fracture was continuing.<\/p>\n<p>We are left with not a semblance of doubt on the question that<\/p>\n<p>the appellant had suffered scaphoid fracture as a result of the<\/p>\n<p>accident. That conclusion appears to us to be reasonable and<\/p>\n<p>irresistible. The Tribunal had found that the appellant had<\/p>\n<p>suffered injuries and had to be involuntary unemployed for a<\/p>\n<p>period of three months. Documents produced show that he was<\/p>\n<p>an inpatient for a period of eight days, i.e. 18-9-1999 to 25-9-<\/p>\n<p>1999 and that subsequently pain was continuing and he had to<\/p>\n<p>continue treatment as outpatient. The indication suggest that he<\/p>\n<p>had    continued treatment     as inpatient till 13-12-1999. The<\/p>\n<p>learned counsel for the appellant contends that the amounts<\/p>\n<p>awarded under the heads of bystanders expenses , medical<\/p>\n<p>expenses and pain and suffering did not reflect the reality of the<\/p>\n<p>suffering endured by him. We find force in the contention of the<\/p>\n<p>learned counsel for the appellant.    We are satisfied that the<\/p>\n<p>appellant is entitled to further amounts by way of compensation<\/p>\n<p>in addition to the amounts awarded by the Tribunal as per the<\/p>\n<p>details shown below:\n<\/p>\n<p><span class=\"hidden_text\">                                 5<\/span><br \/>\nM.A.C.A.709\/2008<\/p>\n<p>1)Medical and miscellaneous<br \/>\nexpenses (scaphoid cast )                              =      Rs.3,500\/-\n<\/p>\n<p>2) Bystanders expenses: 8 x 100=800 minus 600          =      Rs. 200\/-<\/p>\n<p>3)Pain and suffering  :Rs.8000 minus Rs.3000           =      Rs.5,000\/-\n<\/p>\n<blockquote><p>                                                  &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<\/blockquote>\n<pre>                           Total                      =      Rs.8,700\/-\n\n                                                  ===========\n\n<\/pre>\n<p>     6. The counsel contends that with the help of the decision<\/p>\n<p>in <a href=\"\/doc\/1803341\/\">Dharampal v. U.P.State Road Transport Corporation<\/a><\/p>\n<p>[2008(2)KLT 691(SC)] and we agree that interest awarded at<\/p>\n<p>the rate of 6% per annum is too inadequate and interest must be<\/p>\n<p>awarded at the rate of 7.5% per annum.\n<\/p>\n<p>     7. In the result:\n<\/p>\n<p>     a) this appeal is allowed in part.\n<\/p>\n<p>      b)The appellant is found entitled to a further amount of<\/p>\n<p>      Rs.8,700\/- in addition to the amounts already awarded<\/p>\n<p>      by the Tribunal.\n<\/p>\n<p><span class=\"hidden_text\">                                  6<\/span><br \/>\nM.A.C.A.709\/2008<\/p>\n<p>      c) It is directed that the entire amount of compensation<\/p>\n<p>      shall bear interest at the rate of 7.5% per annum from<\/p>\n<p>      the date of the petition to the date of the payment.<\/p>\n<p>     d) All other directions of the Tribunal are upheld.<\/p>\n<p>                                        R.
