No. 853 of 2008\n                  in W.P.(C).7847 of 2006\n       - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 26th day of August 2008\n\n                            O R D E R\n<\/pre>\n<p>        Having         heard        the       learned         Government<\/p>\n<p>Pleader   and       learned         counsel          for      the   writ<\/p>\n<p>petitioner, I do not find any grounds to review the<\/p>\n<p>judgment as such.\n<\/p>\n<p>        2. Learned Government Pleader presses into<\/p>\n<p>service Rule 4(viii) of the Kerala Revenue Recovery<\/p>\n<p>Rules to justify the demand for collection charges.<\/p>\n<p>He further submits that the validity of Rule 4<\/p>\n<p>(viii) was not the subject matter of challenge in<\/p>\n<p>any other writ petition.              I find that Rule 4(viii)<\/p>\n<p>was not a matter of fact pressed into service at<\/p>\n<p>the time of hearing of the writ petition.                           But,<\/p>\n<p>prima facie, I am of the view that, the arguments<\/p>\n<p>which were found to be not weighty enough by this<\/p>\n<p>court in relation to Rule 5, would apply to Rule 4<\/p>\n<p>(viii) also.         It is not necessary to finally<\/p>\n<p>pronounce on this aspect, in as much as the parties<\/p>\n<p>have not joined issue on this aspect in the instant<\/p>\n<p>case.  But, nevertheless, I do not find any ground<\/p>\n<p>to take a different view from what I have already<\/p>\n<p>taken in the judgment.               I had taken note of the<\/p>\n<p> RP No.853 OF 2008<br \/>\nin W.P.(C).7847 of 2006<br \/>\n<span class=\"hidden_text\">                            -: 2 :-<\/span><\/p>\n<p>fact that both State and writ petitioner were<\/p>\n<p>respondents in the land acquisition awards and<\/p>\n<p>ultimately the writ petitioner had satisfied the<\/p>\n<p>award by depositing the amount in court.<\/p>\n<p>            For all these reasons, I do not find any<\/p>\n<p>grounds to review the judgment.        But, I make it<\/p>\n<p>clear that, I have not considered the issue, which<\/p>\n<p>the learned Government Pleader submits, arises from<\/p>\n<p>Rule 4(viii) of the Kerala Revenue Recovery Rules<\/p>\n<p>either in this Review Petition or in the judgment<\/p>\n<p>which has led to this Review Petition as such.<\/p>\n<p>                                           Sd\/-\n<\/p>\n<p>                                          (V.GIRI)<br \/>\n                                          JUDGE)<\/p>\n<p>sk\/-\n<\/p>\n<blockquote><p>             \/\/true copy\/\/<\/p>\n<p>                    P.S.
