(Mines)\n                                  ---\n\n2. 19.02.2010<\/pre>\n<p>:   The grievance of the petitioners is that the limited<br \/>\n           competitive examination has not been held for several years and<br \/>\n           therefore in view of the Circular of the Govt. of Bihar issued from<br \/>\n           the Department of Personal, Administrative Reforms and<br \/>\n           Rajbhasha dated 16.9.1992, the petitioners should be promoted<br \/>\n           without taking such examination on the basis of their seniority<br \/>\n           and minimum qualification. The minutes of the meeting held on<br \/>\n           22.10.2008 and 20.11.2008 were also relied. It is further<br \/>\n           submitted that promotions were granted without examination to<br \/>\n           some persons. It is lastly submitted that either examinations be<br \/>\n           held or promotion be granted without examination.\n<\/p>\n<p>                 Petitioner is relying on paragraph &#8216;Ka&#8217; of the said circular<br \/>\n           dated 16.9.1992, but it only indicates the resolution between the<br \/>\n           representative of the employees and the State Govt. but on such<br \/>\n           resolution decision was taken for filling up 50% of class III posts<br \/>\n           only after passing the limited competitive examination. From the<br \/>\n           said resolution it further appears that there is no provision for<br \/>\n           &#8220;promotion&#8221; from class IV to class III post. Certain percentage of<br \/>\n           class III posts are to be filled up from the candidates having<br \/>\n           required qualification, only after taking limited competitive<br \/>\n           examination.    As such examination were not held for several<br \/>\n           years, it was resolved that if the State Staff Selection Board is not<br \/>\n           constituted by 31.12.2008, and no examination is held, then<br \/>\n           necessary process should be started in terms of the said circular<br \/>\n           dated 16.9.1992. Such suggestions were not accepted by the<br \/>\n           employees and they repeated their demand of giving promotion,<br \/>\n           without examination. On this the Chairman requested the<br \/>\n           Secretaries of Personal and Finance Department to place their<br \/>\n<span class=\"hidden_text\">                           2.<\/span><br \/>\nstand on the circular dated 16.9.1992.\n<\/p>\n<p>      In the meeting held on 22.11.2008 the employees claimed<br \/>\npromotion in terms of circular dated 16.9.1992, on which they<br \/>\nwere given time to go through the written stand of the Personal<br \/>\nand Finance Department. However, it was observed that circular<br \/>\ndated 16.9.1992 is in force in Jharkhand.\n<\/p>\n<p>      Thus, it appears that the circular dated 16.9.1992 is being<br \/>\nmisread\/misinterpreted by the petitioner.       As noticed above,<br \/>\nneither any decision was taken in the circular dated 16.9.1992 to<br \/>\ngrant promotion without examination, nor such decision was<br \/>\ntaken in the meeting held on 22.10.2008 and 20.11.2008.\n<\/p>\n<p>      Further in none of the order passed by this Court it is<br \/>\ndecided that promotion\/appointment can be made from class IV<br \/>\nto class III posts without examination.\n<\/p>\n<p>      According to the petitioners some of the class IV of the<br \/>\nWater Resources Department were given promotion without<br \/>\npassing examination. But, it appears that the promotion granted<br \/>\nto them was set aside by this Court, on the ground that Chief<br \/>\nEngineer could not grant promotion, and such power was vested<br \/>\nwith the Establishment committee. Then, they moved this Court,<br \/>\nbut this Court affirmed their reversion from class III to class IV<br \/>\npost. However, the department was directed to initiate process<br \/>\nafresh, in accordance with law.      When such process was not<br \/>\ndone within the time frame, a contempt case was filed in which<br \/>\ndirection was given to complete the process within a given time.<br \/>\nThen the Establishment committee promoted those employees.<br \/>\nOn the basis of such example, the petitioner can not claim that<br \/>\nthey should be promoted without examination.             As already<br \/>\nnoticed above, even the circular dated 16.9.1992 contemplates<br \/>\nlimited competitive examination.\n<\/p>\n<p>      The stand of the respondents-State is that in terms of<br \/>\nResolution No. 4161 dated 8.7.2008, examination will be taken<br \/>\nby the Member Board of Revenue, Ranchi.\n<\/p>\n<p>      In the circumstances, respondents are directed to complete<br \/>\nthe process of filling up class III posts from class IV posts in terms<br \/>\n<span class=\"hidden_text\">                                    3.<\/span><br \/>\n     of the said Resolution dated 8.7.2008 as early as possible and<br \/>\n     preferably within four months from the date of receipt\/production<br \/>\n     of a copy of this order.\n<\/p>\n<p>           With these observations and directions, this writ petition<br \/>\n     stands disposed of.\n<\/p>\n<p>           Let a copy of this order be handed over to the State<br \/>\n     counsel, as prayed.\n<\/p>\n<p>                                               (R.
