filed this appeal.\n<\/p>\n
2. The learned’\u00a2_couf:n’sel l”appellant–accused is
\nabsent. I have heard the   Advocate for<\/p>\n
the respondent; pp *<\/p>\n
 ll In V view.” jjndgment of the Supreme Court,
\nreported in  357 [in the case of Dharam Pal &<\/p>\n
 Vs. Stritev–…Qf’ Uttar Pradesh}, I have perused the<\/p>\n
‘ atreeoi-\u20acls’andrtake11 up the appeal for disposal on merits.<\/p>\n
  case of prosecution in brief is as follows:<\/p>\n
a  accused and PW.6 M Chandra are residents of<\/p>\n
 *Tila~k Nagar, Mysore and they are known to each other. Few<\/p>\n
__\u00a7months prior to 19.3.99. PW.6 had lent a sum of Rs.l60\/–<\/p>\n

\nto the accused. When PW.6 demanded the accused torepay
\nthe money he was dodging PW6.\n<\/p>\n
5. On 19.3.1999 at 2.30 p.m..\n<\/p>\n

\nin Tilaknagar Park they metthe
\nthe accused to repay a sum  “‘i’h’r3  goth
\nwild and stabbed onth\ufb01e  a knife.\n<\/p>\n
When PW6 raised hue  ran away from<\/p>\n
the place. PVtf5+;.y:l(:}.anicl ll_:’shifted_fPW6j’to hospital and he<\/p>\n
was :’adrni–tted5′.Vin!t’K7R_l\u00a7o.sp–ital, Mysore. After receipt of
\nmedicoh legal ‘report; ,.therinvestigating Officer visited the<\/p>\n
HoA.’:’I3iit.a4l recorgiedlthevstatement of PW.6. On the same day,<\/p>\n
 \u00abacctis\u00e9fi  arrested. On the information volunteered by<\/p>\n
 :hii1’l’,x  iiivestigating Officer recovered a knife. The<\/p>\n
lnvestigatin*gA Officer seized blood stained clothes of PW6;<\/p>\n
 AA recorded the statements of witnesses; sent the incriminating<\/p>\n
  laiftiicles to Forensic Science Laboratory and after completing<\/p>\n
__;the investigation formalities filed charge sheet arj inst the<\/p>\n
accused. ‘{‘V~  x -\u00a3”v~-‘x’3\u00e9’i~–‘<\/p>\n
6. During trial, PW’s..1 to 12 were examined,<\/p>\n
documents Ex.P1 to P10 were marked and mate1″ial”<\/p>\n
Viz blood stained knife (l\\\/1.0.1} and blood stainedv <\/p>\n
PW.6 were marked.\n<\/p>\n
7. The defence of accused was .one of total  ” 9<\/p>\n
prosecution has relied on oral ievidence.   medical
\nevidence and recovery_of..knifl*e at tl1e.iristance of accused.
\nPW.6 was the injnred vlf1_tn\u00a7ess;..Vl\u00a73’\u00bb7lZ_;.’S_has deposed that<\/p>\n
during Sh1Varat;l:iri feistivalegof had lent a sum of<\/p>\n
Rs.1:\u20acg0\/;—told?’-‘t.,he_{lacciised.- J On 19.3.1999 ie., on the
\nfollowinigldaylof  PW6 demanded accused to<\/p>\n
repay the lo’an,”accosed became Wild and stabbed on the<\/p>\n
 PW.6 With a knife. The incident of assault<\/p>\n
 ._ ‘o’cco1*redV.bV’in::Tilaknagar Park. PW.6 was shifted by PW’s10<\/p>\n
and 1.91 andhe was admitted in the K.R.Hospital. The Police<\/p>\n
 _ lnsgziector came and recorded his statement. PW.6<\/p>\n
it  underwent operation in KR. Hospital.<\/p>\n

8. During cross~examination, PW.6 has deni-ed the
\nsuggestion that accused did not assault him.
\nexamination of PW6, it was specifically
\nthat at the time of incident, PW\u20ac;’~h’eld.. \u00abthe! “a\u00a2’\u00a21lg\u00a2ci
\nand pushed him. PW.6 has denied
\nbeen suggested to PW.6 thatthe   for
\nfailure of accused to ijepay th.e..llo’an”‘a.;fnount’,-l?W6i\u00a7had taken
\naway the bicycle of  enmity between<\/p>\n
PW.6 and t.he”a_ccuse’d;”‘-l?W\u00a7’6_l’h_as.ljdelnield the suggestion<\/p>\n
thatpthere illfwill”betweenthe accused and PW.6 due to
\nrnonito1’y._ transactioil he lodged a false complaint.
\nThus, from t’l1ept’enors cdfbcrosswexamination of PW.6, we find<\/p>\n
 \u00a7_._oacc_usedl” admitted that there was monitory<\/p>\n
V  transvactiovnrbetween the accused and PW.6.<\/p>\n
being the injured witness would be least<\/p>\n
disposed’ to falsely implicate the accused leaving aside the<\/p>\n
  llculprit. The incident of assault. took placed in a broad day<\/p>\n
 light. within the jurisdictions of Tilaknagar PS. There was<\/p>\n
no identification crisis. The first information was\ufb01lodged<\/p>\n
soon after the occurrence.\n<\/p>\n
9. PW. 10 — Ravikumar and PW. 1} ~_Ki*ish’in,a”who were..
\nin the company of PW.6 at the time not<\/p>\n
supported the case of prosecution.  A. l<\/p>\n
10. PW.1O –\u00ab\u00bb  afriend  PW.6 has
\ndeposed;– that on thellldatelof afternoon,
\nwhen he C_El.I.I:1E.,_ to ].3’arl\u00a5;,i.L:’:$le\\llreral people had
\ngathelreld”etn}vf1:   on umbilical region
\nandlhell  Autorickshaw to K.R.Hospital,
\nMysorel.l”PW’. “treated as a hostile witness. During<\/p>\n
vc_r}osssexaminati.on.,..\u00abPWlO has admitted that, at the time of<\/p>\n
V  i1iciClventj_”vi.tlie_ accused was wearing trousers. PWlO has<\/p>\n
  that he had seen PW6–injured. Therefore,<\/p>\n
ei\/idence of PW1O that PW6 had suffered injury on umbilical<\/p>\n
  if region and he was shifted to the hospital is consistent with<\/p>\n
 the case of prosecution.\n<\/p>\n

evidence of PW.11 a.’oc.ut the”‘ti1::’\u00a2 and p1ace”‘of”occurrence<\/p>\n
and presence of PW6 !.’andV=’ia\u20ac:cuse–d_*\u00bb.near the place of<\/p>\n
 12, g3tt’iit11e__:re1eVa_nt…time, PW.2 — Dr. C.P.Nanjaraj was
\nworkingjas _Surgeon at K.R.I~Iospita1, Mysore.<\/p>\n
P\u00a5\u00a7f.2 ..has.d’ep_oSed that on 19.3.1999 at about 3.15 p.m.,<\/p>\n
  Chandru  brought by CW4 to K.R.Hospital. On<\/p>\n
  PW6, PW2 found an incised Wound on<\/p>\n
1\/,\/’<\/p>\n
1:u_nbi__1ica;i.:’~:region with coils of intestine seen outside. PW.6<\/p>\n
 up was ‘given Tetanus injunction and PW.6 was admitted in<\/p>\n
it ‘..VV’*\u00bbsuArgica1 ward. Later, PW6 was operated by<\/p>\n
 PW. 9-D1’. Srinath. iv ‘<\/p>\n

13. PW.9 has deposedzm that he examined PW:..’6and<\/p>\n
found an injury on the abdomen with <\/p>\n
outside. PW6 had also swelling over the   the it <\/p>\n
same day, surgery was perforrnehdmto’  of<\/p>\n
abdominal cavity was inspectedlL..’E–‘W9  <\/p>\n
intestines that had come ou’t’~w’ere heali._hy’-aiidkthellwoundld<\/p>\n
was closed.\n<\/p>\n

opinion _rnot’r.el’evant.’ to consider evidence of PW9.
\nThe difect ievidence’   PW.6 is consistent with the<\/p>\n
me’di’ca1 evidence’: given by PW’s.2 and 9. The evidence of<\/p>\n
 .jettyV\ufb01itldfindsi__corroh-oration from the evidence of PW2 and<\/p>\n
 vPw;9.., n’<\/p>\n

 .A arrest’—of accused and recovery of a knife from the accused<\/p>\n
it  seizure of blood stained shirt of PW.6. He h 1<\/p>\n
seized<\/p>\n
the blood stained knife on the information volunteered by<\/p>\n
the accused.\n<\/p>\n
15. PW.8 who was then working as-oft. p <\/p>\n
police has given evidence in proof of-‘arrests ot’.a*ec’use_d <\/p>\n
seizure of blood stained knife -t_1_\\\/IO.    it<\/p>\n
16. The contents  Science .\/i.aboratory
\nwould reveal that bloods_tain.ed :shi:rtV:l_(ML_’O,2} of PW6 and a<\/p>\n
knife (M.O.lo).\u00e9gweap\ufb01on\ufb02ol_”p:assau;l’t._were.’ stained with blood.<\/p>\n
The:’iVconten:fs {iii  of ‘Serologist would reveal that
\nbloodstainsl foun.’d~ shirt were of B–group. Thus,
\nthe direct;..ev”icien.ceV.o’f”PW6 finds support from the medical<\/p>\n
 of l5W2..-.Dr.C.P.Nanjaraj 8: PW9wDr.Srinath and<\/p>\n
 da}so”v..fro’\u00a7n.Ap.’i.he contents of report of Forensic Science<\/p>\n
 report. of Serologist. Therefore. I hold that<\/p>\n
prosecution has proved that on 19.03.1999 at 2.30 p.m., in<\/p>\n
*  lithe afternoon near Tilaknagar Park in Mysore City, accused<\/p>\n
 assaulted I-‘W6 with a knife and caused injury to him.<\/p>\n

17’. The next point for consideration is:~<\/p>\n
“Whether the acts committed by
\nwould attract an offence punishable   l *<\/p>\n
section 307′ IPC?”\n<\/p>\n
18. In order to bring hornEe.__g”u._il.t of\u00bb’a_.c.c’used”
\noffence punishable under section 307 xl1.3VC,lthehplrosecution’<\/p>\n
has to prove if by such acts”ac\/Q:use’d._had  death<\/p>\n
of PW6, he would have b_e’enc-g.’Ji.lty__po’f_an offence punishable<\/p>\n
under sect_ion_302  toyestablish this fact.<\/p>\n
pros.ec\ufb01tioriifyhashfto  th”at””a”ccused was aware and he
\nhad intention  by such acts if he had caused
\ndeath of Vlvonldlhave been held guilty of an offence<\/p>\n
 under..section 302 IPC.\n<\/p>\n
V     decision reported in AIR 1965 SC 843 (in the<\/p>\n
‘oase,__vof Prasad v. State of Bihar} at paragraph 7, the<\/p>\n
 in p_Supreine Court has held:–\n<\/p>\n

\nthat the burden is still upon the prosecution to<\/p>\n
establish that the intention of the appellant in<\/p>\n

2.3(l–,_p.r_n–., lVat”.Til_va%:naga;v.._Ear}: was accidental. The quarrel
\nbetWeer1,lacCus’ed'”‘ began when PW6 demanded<\/p>\n
accused to ‘repay loan. The tenor of cross-examination of<\/p>\n
 E’l’i;ifcu1d._._suggest that PW6 had scolded accused for not<\/p>\n
 .  In fact. the incident of assault was preceded<\/p>\n
by a _s’craml3le between accused and PW6. The accused had<\/p>\n
 I Tdealtxa solitary blow on the stomach of PW6 with a knife.<\/p>\n
” -Thn.erefore, I am of considered opinion that. acts cornmltited<\/p>\n
 by accused do not attract an offence punishable under j<\/p>\n
section 307 IPC.\n<\/p>\n

20. It is clear from the evidence Vo1’\u00bb._ri?W2~<\/p>\n
Dr.C.P.Nanjaraj and PW9~Dr.Srinath but for <\/p>\n
intervention, injury inflicted by accus~c–d..__’:woul:d\u00ab. izavet <\/p>\n
endangered the life of PW6.\n<\/p>\n
hospital on 19.03.\u00a3999, {he underwent
\nsurgery, PW6 was dischargle\ufb01hllon_u26iO3.lpl:9\u00e9\u00a79..l:’fi’hereafi:er,V
\nPW6 was under pos’t;4o’pera.:_tiiie  PW6 was
\nnot able to follow his a period of 21<\/p>\n
days after the\ufb01ate \u00e9f iiiicidentyiri”itheflcircumstances, acts<\/p>\n
committed  grievous hurt caused to PW6
\nfalls  ‘within  ,  definition of section<\/p>\n
IPC. it ‘i’he”accused had wielded a dangerous weapon<\/p>\n
  ‘Lhold the accused guilty of an offence punishable<\/p>\n

\nthree years and  \/ default to
\nundergo simple imprisognmelntppl  six months for<\/p>\n
