It is not in dispute that under contract between the<br \/>\nparties, there is an arbitral clause in following terms :\n<\/p>\n<p>&#8220;Sole<br \/>\nArbitrator <\/p>\n<p>Municipal<br \/>\nCommissioner, VMC shall be the sole Arbitrator, for any disputes and<br \/>\ndifferences of any kind arising out of or in connection with the<br \/>\ncontractor or the carrying out of the works during the progress of<br \/>\nthe works or after their completion shall be referred to and settled<br \/>\nby Municipal Commissioner, VMC. The decision of the Municipal<br \/>\nCommissioner shall be final and binding to both parties.&#8221;\n<\/p>\n<p>\tSince<br \/>\ndisputes arose between the parties, petitioner under its<br \/>\ncommunication dated 29.6.2009 requested the Municipal Commissioner of<br \/>\nVadodara to act as an arbitrator and resolve the disputes. In the<br \/>\nsaid letter it was stated that :\n<\/p>\n<p>&#8220;By<br \/>\ninvoking above provision, we refer to you, in capacity as Sole<br \/>\nArbitrator dispute which have arisen while execution of subject work.<br \/>\nWe, now, urge you to assume position of Sole Arbitrator, a Quasi<br \/>\nJudicial Authority, and urge you to commence arbitration and inform<br \/>\nus accordingly, so that we can submit our dispute along with detailed<br \/>\nsubmissions for resolution to you as Sole Arbitrator. Urging for<br \/>\nearly action in capacity of Sole Arbitrator&#8221;\n<\/p>\n<p>\tSince<br \/>\ndespite such communication, there was no positive response from VMC,<br \/>\nthe petitioner moved present arbitration proceedings praying for<br \/>\nappointment of arbitrator. In response to notice issued by this<br \/>\nCourt, respondent appeared and filed affidavit dated 14.10.2010<br \/>\nstating that Municipal Commissioner has decided to hear the<br \/>\npetitioner and decide the dispute as sole arbitrator and therefore,<br \/>\nthis petition be disposed of accordingly.\n<\/p>\n<p>\tHaving<br \/>\nheard learned advocates for the parties and having perused the<br \/>\ndocuments on record, in terms of clause-37 of the contract   between<br \/>\nthe parties, Commissioner Vadodara is appointed as sole arbitrator to<br \/>\ndecide all disputes between the parties arising out of contract dated<br \/>\n10.5.2006.
